Motorcyclist Injured After Accident with Public School Bus

In July of 2019, our client was lawfully riding his motorcycle on a street in Ottawa County, Ohio. At the same time, a public school bus driver employed by the Ottawa County Transportation Agency (OCTA), was traveling in the opposite direction.

The accident occurred when the bus driver failed to yield to the right of way and made a left turn into our client’s immediate path. As a result of this negligent act, our client was forced to lay down his motorcycle on the roadway to avoid an even worse collision, causing significant injuries to his left thigh, left foot, and right shoulder. He was then taken to a local hospital for emergency medical care.

At the scene of the accident, the bus driver was cited for failure to yield to the right of way, as she breached her duty to drive safely on state roads.

Establishing Negligence

The negligent driver had a responsibility to exercise caution and adhere to traffic laws while operating the large school bus. She breached her duty of care when she failed to yield to the right of way to our client and impeded his travel, cutting him off.

The OCTA also has a responsibility to investigate the credentials and fitness of the drivers they employ to operate school buses. The agency breached its duty of care by hiring a negligent and reckless driver.

Damages Sought

Our client sustained serious personal injuries as a direct result of the negligence of the OCTA employee. These injuries required intensive medical treatment, which caused our client to incur costs associated with that care. In addition to lost wages and other economic damages, our client has experienced pain and suffering, mental anguish, and emotional distress.

Our client and his medical team believe his injuries will be permanent in nature and require future medical care. This continued treatment will cause our client to incur further economic losses.
