In a recent case, our client was working as a plumber on a construction site in Ohio. After a heavy rain, water had collected in a trench. Workers began using a large tool called a compactor to fix the gravel in the trench and remove water. Instead of using a safe ramp, the workers began to lower the heavy tool into the trench with chains and a backhoe

Our client was driving from his college when a car ran through a red light and struck his car on the passenger side. He managed to get out of the car. While he was calling 911, he had a stroke and fell onto his left shoulder. EMS took him to Miami Valley Hospital. Our client was prescribed Elmiron, a medication containing the active ingredient pentosan polysulfate, to treat bladder pain and discomfort associated with interstitial cystitis. $300,000 SETTLEMENT – Woman Rear-Ended at High Speed Suffers Serious Nasal Fracture

Our client was traveling southbound on North Holland-Sylvania Road and was just a few blocks away from her home when she was involved in a serious car accident. As our client was approaching the intersection with Bancroft Street, traffic was heavy, and the light ahead had turned red. Our client properly slowed down, however, the driver behind her did not. The driver behind our client failed to notice traffic ahead of her coming to a stop and was traveling approximately 40-50 miles per hour, even though the speed limit was only 35 mph. This driver collided with the rear end of our client’s car with so much force that our client’s vehicle was propelled forward into the vehicle in front of her. Upon impact our client was flung forward into her steering wheel. As a result of the accident our client suffered a whiplash injury and a severely fractured nose. Due to the severity of the fracture, our client underwent surgery to repair her nose. Several months later as the injury healed, she began having difficulty breathing through her nose and was required to undergo surgery again. Following this second surgery she continued to experience obstructed breathing, ear pain, sinus pressure, and migraines. Additionally, the surgery had left her nose significantly deformed. Due to these continued problems, our client was forced to undergo a third surgery and she may require additional surgical intervention in the future.

$262,686.70 SETTLEMENT – Wrongful Death Due to a Fatal Boat Accident on Lake Erie

Our client was a passenger on a 28-foot boat, enjoying a fishing trip with friends on Lake Erie. Tragically, at around 10:00pm, the boat crashed into a break wall in Ashtabula. It was speculated that alcohol was a contributing factor in the accident. The Coast Guard arrived on the scene, finding five passengers. One passenger was unresponsive, treated by the Coast Guard officers, but sadly passed away due to his injuries.

Our firm was contacted by the passenger’s wife and stepson to represent the estate. Charles Boyk and his team filed a wrongful death action against the driver of the boat on behalf of the estate. Soon after, the boat driver’s insurance company asserted an interpleader action, requesting that the Federal Court accept their liability insurance limits of $300,000.00. Since several passengers were injured, in addition to the passenger who lost his life, the insurance company believed their limits were insufficient to fully compensate all parties. The insurance company requested that the Court distribute the $300,000.00 among the parties as it saw fit.

After the Court defaulted one party for their failure to assert a claim within the timeframe prescribed by law, Attorney Charles Boyk began negotiating with the remaining injured party to work out a fair allocation of the policy funds. After several discussions, our office resolved the matter and obtained a court order that allocated the majority of the $300,000 policy limits to our client, the decedent’s estate. The remaining portion was awarded to the remaining injured party. In the end, the decedent’s estate received a settlement of $262,686.70.
