Confidential Settlement – Worker Loses Five Toes and Part of Foot in Accident due to Unsafe Work Enviroment

Our client sustained a serious injury in April 2020 when he was involved in a preventable workplace accident in Toledo, Ohio. As our client was assisting with crane operations, he was tasked with establishing a safety barrier around the crane as required by site-specific safety protocol. However, the crane operator failed to get an all clear from a spotter. As the operator lowered the crane, a portion of the crane lowered onto and crushed our client’s foot. Once freed from under the crane, our client was immediately rushed to a nearby hospital due to severe crush injuries to his foot. Unfortunately, the injury was so severe that our client was forced to have two of his toes amputated. Following the surgery to remove his two toes, gangrene and infection set in. To prevent further serious and potentially life-threatening consequences, doctors informed our client that they would have to amputate his remaining three toes and part of his foot. Following this horrific event, our client required extensive medical treatment and rehabilitation. He additionally continued to experience significant pain, limitations, and mobility issues. Even though this accident happened in Toledo, Ohio, our client himself did not live in Ohio, which led him to originally contacting an out of state attorney. Charles E. Boyk Law Offices was contacted by this out of state attorney and retained as local counsel to assist them and the client with the legal aspect of the case. Through investigation and retaining an expert, it was revealed that the crane operator took an unapproved shortcut to save effort and failed to ensure that all safety precautions were taken when lowering the crane, making this a completely preventable accident. Our office worked seamlessly with the other attorneys on this case to accomplish a common goal, secure a settlement that would properly compensate our client for the life-altering injuries he sustained due to someone else’s negligence. $850,000 Settlement – EMT Sustains Severe and Permanent Injuries when Car CrashesO AMBULANCE

On a morning in April 2019, our client was working as an EMT in Hancock County, Ohio. Our client’s squad received a call to which they promptly responded to and attended to their patient. En route to the hospital, with lights and siren activated, our client was in the back of the ambulance, along with another EMT, providing medical assistance to their patient. The EMT driving the ambulance encountered heavy traffic at an intersection as it traveled, prompting the ambulance driver to sound his air horn to get through traffic. As the ambulance started to enter the intersection, a commercial box truck turned left in front of the oncoming ambulance. While the ambulance attempted to take evasive action, it collided with a portion of the box truck. The ambulance then traveled off the road, over a curb, striking a utility pole, and crashing through a brick building. As our client was in the back of the ambulance he was violently tossed around. As a result of this accident, our client sustained multiple serious injuries, including several fractured ribs, a concussion, and a closed head injury. Following the accident, our client required extensive medical treatment and unfortunately was never able to return to his career as an EMT due to the extent of his injuries. $100,000 Policy Limits Settlement – Motorcyclist Killed in Accident

In July 2022, our client was involved in a tragic fatal accident in Toledo, Ohio. Our client had been operating his motorcycle eastbound on West Sylvania Avenue near its intersection with Corey Road. At the same time another driver was traveling in the opposite direction of our client. As both our client and the other driver approached the intersection, the traffic light turned yellow. The other driver then attempted to make a left-hand turn onto Corey Road and in front of our client and causing him to strike our client and his motorcycle. Unfortunately, our client was pronounced deceased at the scene. Following this tragic event, our client’s wife reached out to our office to help her navigate the legal aspect following her husband’s death. After a Farming Implement Accident Kills Devoted Father of Two, Family Recovers Confidential Settlement

Our client, a 64-year-old devoted father, was riding his motorcycle on a country road when a tractor towing a hay rake failed to yield the right of way when turning left at an intersection. Five-Car Accident Caused by Intoxicated Driver Kills Two, Family Recovers $500,000 Policy Limits

In April of 2022, the daughter of our client was a passenger in a vehicle heading northbound on I-75 in Henry Township. At the same time, an intoxicated driver headed southbound on I-75 rear-ended another car, which caused that car to swerve into the median, crash through the median, and make head-on impact with the vehicle in which our client’s daughter. The severity of the impact resulted in the death of our client’s daughter, as well as the death of driver of the vehicle that made head-on impact. The intoxicated driver was arrested on multiple felonies. Boyk attorney Wes Merillat resolved a wrongful death action on behalf of the daughter’s estate against the at-fault driver. Though nothing can ease the pain of losing their daughter, our clients were awarded a $500,000 policy limits settlement for their loss.

Drunk Driving Accident Leads to Permanent Pain

Our client was a passenger in a car driven by her boyfriend and was driving along State Route 51 near its intersection with Bradner Road. At the same time, another driver who was driving under the influence of alcohol approached the intersection and ran the stop sign, colliding with the vehicle in which our client was a passenger. Lake Township police found open containers of alcohol in the other driver’s vehicle. After the accident, our client began experiencing significant neck and shoulder pain, for which she sought treatment through the emergency room, orthopedics consultations, physical therapy, chiropractic sessions, trigger point injections, and epidural steroid injections. Negligent Driver Runs Stop Sign and Injured Driver Recovers $250,000 Policy Limits

In March of 2021, our client was driving in Monroe County, Michigan, and approached an intersection. At the same time, another driver negligently failed to stop at the intersection stop sign and turned into our client’s lane of travel. As a result of the ensuing collision, both vehicles sustained disabling damage and our client suffered a fracture of the right ankle with persistent marrow edema, avascular necrosis of the right ankle, and injury to her right iliac crest. $1,800,000 Settlement – Car Accident

In April of 2021, our client and their grandchild were traveling on a frequented street. However, an oncoming vehicle went left-of center and struck our client and child. Because of the impact, our client became pinned between the steering wheel and dashboard, requiring an extraction by firefighters and other first responders. The grandchild had relatively minimal injuires.

An investigation by the Ohio State Highway Patrol uncovered that the at-fault driver was intoxicated at the time of the collision, and further blood tests showed that the at-fault driver had Fentanyl in his system.

The injuries suffered by our client were extreme, leaving the client immobile for an extended period of time, and their family having to perform simple life tasks for them, such as bathing, dressing, and food preparation. After the collision, our client was life-flighted to a local trauma center, where they spent nearly one-month hospitalized, including five separate surgeries.

Though our client will still have to receive routine treatment and rehabilitation, the $1,800,000 settlement our attorneys recovered will allow the client to pay medical bills, compensate for the horrific experience, and allow our client to relocate to a much more suitable home and allow for financial stability.

$1,250,000 Settlement – Truck Accident

Our client was a Perrysburg Township police officer involved in a crash while in the scope of his employment. He was stopped at a red light when a semi-truck, traveling at a speed of 60 mph, failed to stop and slammed into the rear of his vehicle. Our client was transported to the hospital with complaints of extreme back pain.

Our client suffered serious back injury as a result of the automobile collision. Imaging revealed he had a residual L5-S1 disc herniation, increase in fluid in the thecal sac, and disc protrusion at the L4-L5 level indenting the anterior thecal sac. He underwent three separate surgeries and physical therapy. However, he continued to experience chronic pain and began having bouts of depression and anxiety with reported sleep disturbances. Our client then had an undocumented suicide attempt and began psychological treatment.

Prior to this tragic accident our client was a healthy, physically fit, 28-year old father of three. He was a proud veteran of the Iraqi War and a former volunteer firefighter. After the accident our client was unable to return to work. He and his wife struggled to keep the family together in a safe comfortable home. Our client was eventually diagnosed with anxiety disorder and was told he would have to live his life with chronic pain. Due to the physical nature of his employment, he was medically disqualified and was told he would not be able to return to work in that field.

We represented this client on a Workers’ Compensation claim and secured him full benefits. After the Workers’ Compensation claim settled, we pursued a lawsuit in Lucas County for his loss of employment. We negotiated an out of court settlement with the negligent driver and the driver’s employer in the amount of $1,250,000.00.

$1,110,000 Settlement – Wrongful Death Auto Accident

On an icy morning in January, our client offered to drive his wife to work due to inclement weather conditions that had begun overnight. The loving couple bundled up and left early allowing plenty of time for slow travel into work. Our client and his wife were traveling westbound on US Route 6 in Wood County, Ohio when man driving a truck eastbound on US Route 6 failed to maintain control of his vehicle and crossed the center line. He struck the vehicle that our client and his wife were traveling in, forcing the vehicle into a guardrail. Once the vehicle came to rest our client checked on his wife, then exited the vehicle to assess the damage. Due to heavy front-end damage, our client was unable to get his wife from the vehicle and had to wait until help arrived. Responding Sherriff deputies put our client into the back of their cruiser to assess whether medical attention was needed. While in the back of the car, our client was informed that his wife of nearly twenty years succumbed to internal injuries and passed away. Our client was in shock and left to deal with the guilt that he left his wife to die alone and cold, trapped in a mangled vehicle.

Our client was transported to Wood County Hospital where he was treated for injuries including a sprain of both ankles, swelling to his knees and cuts to his hand. After he left the hospital, he needed an additional five weeks of assistance from Home Health Care. Our client saw an orthopedic doctor for treatment to his ankles, knees and hand. He then began a long road of occupational and physical therapy.

After all the treatment, our client still experienced physical discomfort, however the worst pain he experienced was the heartbreak from losing his loving wife. He was quoted saying, “I know nothing in this world can bring her back, so I have to live with the mental anguish of living my life without her and her smile and kisses and hugs. I have lost my most precious gift.” Although no amount of money can replace a lost life, our office fought hard to get our client just compensation.

The at-fault driver of the truck had liability insurance that had a limit of $50,000.00 in coverage. Luckily, our client had made the smart decision to carry umbrella coverage with his own insurer. By pursuing claims against not only the at-fault driver but also our client’s own insurer we were able to obtain an additional $1 million dollars in coverage. The total amount recovered was $1,050,000.00 for the wrongful death of the client’s deceased wife, and $60,0000.00 directly to our client for his own personal injuries sustained in the collision
