While lawfully turning left on a road in Toledo, Ohio, a motorist crossed the center line in an attempt to pass our client. However, as the other motorist began to illegally pass our client, our client engaged in a left turn, resulting in the other motorist crashing into the driver’s side of our client’s vehicle.

Our client suffered several injuries, including a fractured wrist that has left our client unable to enjoy the things in life that they previously enjoyed. In addition to the physical injuries, our client was left with a fear of operating a motor vehicle, the stress of being unable to enjoy hobbies and recreational activities, and the inability to spend quality time with their family.

Aware of these hardships, our staff and attorneys aggressively pursued the other motorist, in which we filed a law suit, took six depositions, and went through mediation. Ultimately, trial was not necessary, and our staff and attorneys fought for and received a $100,000 settlement for our client.

While stopped at a red light on Talmadge Road, in Toledo, attempting to turn onto I475, our client was rear-ended when a driver, presumably distracted, did not see the red light.

Due to the impact, our client suffered immediate strains, including a strained neck. However, our client faced the most difficulty adjusting to an injury sustained to their right shoulder. In talking with our attorneys and staff, our client outlined that they faced difficulty reaching, grabbing, stretching, and conducting basic daily activities. In addition to the physical injuries, our client was faced with lofty financial obligations that their insurance did not cover arising from the wreck.

Armed with this, our attorneys aggressively pursued a claim against the at-fault driver, which quickly resulted in a $100,000 settlement. With this settlement, our client will be alleviated of financial hinderances arising from the wreck, and can begin the road to a full recovery.

Our client contacted us to investigate the death of her husband who died on March 31, 2017, at the age of 62.  He and our client were married in 1976. They had known each other since kindergarten. They had two adult children and had 5 grandchildren. A 6th grandchild was born after he passed.  On May 31, 2018, we commenced a wrongful death lawsuit against a Findlay physician and his practice group.

The decedent was 62 when he scheduled an appointment with his primary care physician on March 30, 2017.  He “hit a wall” upon his normal walk and even had problems walking up the stairs. He communicated this, as well as episodes of shortness of breath and heart palpitations to the Defendant physician.  At that appointment, he was examined, and an EKG was performed.  It was Plaintiff’s position that the EKG was not read properly and showed a cardiac episode. The reading stated: “non-specific ST & T wave abnormalities”.  There were several previous readings in his chart for comparison.  The defendant physician scheduled him for various tests at later dates.

Less than 24 hours later, our client’s husband was dead.  The autopsy revealed a pair of myocardial infarcts; one occurring 5-7 days earlier and the one that killed him, occurring 6-7 hours before his death.  The Plaintiff contended that the defendant doctor failed to diagnose an acute cardiac event which should have resulted in direct admission to the hospital.

All defendants denied the allegations of negligence and discovery ensued.  On February 5, 2021, the parties participated in a mediation that resulted in a confidential lump sum settlement for our client.

On August 3, 2018, our client was traveling southbound on Interstate 280 in stop-and-go traffic when his and seven other vehicles were rear-ended by a commercial tractor-trailer. Three people lost their lives in the tragic event. Our client was severely injured in the crash and experiences lasting trauma to this day.  Our client had stopped for traffic, looked in his rear-view mirror and saw a truck coming at him at a high speed.  The impact sent our client’s car flying off the road. When EMS arrived on the scene of the accident, he had to be extracted from the vehicle from the passenger side rear door due to damage to the driver’s side.  Our client reported a loss of consciousness, hitting his head and waking up in the back of his vehicle.  He was transported to St. Vincent Mercy Medical Center for evaluation and treatment.  In addition to a head injury, our client also suffered severe injuries to his right leg, requiring surgery, physical therapy, pain management, and more. He faces lifelong chronic pain and swelling in his right leg which will alter his daily activities for the rest of his life.

On January 18, 2021, a mediation was conducted, and due to successful negotiations, the parties reached a confidential settlement.  We were able to avoid the need for trial and the stress that it would have caused our client to relive the events of that day and all the pain and suffering that followed.

On March 8, 2019, our client stopped at a red light on Talmadge Road, when he was read-ended by a man driving a Chrysler 300 who did not realize the light had turned red.  Our client went to St. Anne Mercy Hospital for evaluation and treatment following the accident.  Following the accident, he had immediate right shoulder and neck pain rated at a level of 8/10.  Radiology studies were negative, and our client was discharged, but continued to have significant pain.  On March 18, 2019, he was evaluated by orthopedic surgeon, Nabil Ebraheim, who diagnosed subacromial impingement syndrome. Injections were provided to alleviate the pain and physical therapy was started.  Ultimately, our client was diagnosed with a full thickness supraspinatus tear (rotator cuff) with tendonitis, which required surgical repair.

Prior to litigation, the initial offer by the insurance company was under $25,000.00.  Following our client’s deposition testimony, and before mediation, the insurance company tendered their full policy limits of $100,000.00.  The successful strategy of filing this matter into litigation and partaking in formal discovery allowed us to secure the full policy limits available for our client without the need of taking the case to trial.

This accident occurred on July 3, 2020, at approximately 10:00 PM on State Route 109 in Liberty Township, Ohio. The tortfeasor drove off the east side of the roadway, striking a utility pole and causing the pole to come crashing down and lay across the roadway. The pole was not visible to other motorists as it laid across roadway.  Moments later, our clients, who were traveling southbound on SR 109, on a motorcycle, at approximately 50 mph, without warning or notice, smashed into the downed pole and were ejected from the motorcycle. Our clients and the motorcycle flew through the air before skidding across the road.  Our female client’s injuries were more severe, and the highlight of this case of interest.

Fire and Rescue appeared on scene. Our client was secured to a cot and was loaded into the ambulance. Both clients were then taken to a local hospital for evaluation and treatment of their injuries.  While at the hospital she was found to have a neck injury, chest injury, abdominal injury, back injury, extremity injury, and a concussion. She underwent a CT to her abdomen and pelvis, CT of cervical spine, CT of her head/brain, x-ray of her right hand, and x-ray of her left shoulder. The CT of her cervical spine showed mild eccentric osteophyte disc bulge and mild left neural foraminal narrowing at both level C4-C5 and C6-C7.

Due to the severity of our client’s injuries, she required extensive medical treatment.  On September 24, 2020, she underwent surgery, and a local neurosurgeon performed an anterior cervical discectomy arthrodesis and anterior instrumentation C5-C6.  The neurosurgeon noted that she showed a large, herniated disc at C5-C6 and was brought in for an anterior cervical discectomy and fusion at the level where she has significant cord compression as well as root compression. Once the C5 and C6 were undercut there was clear good decompression of the spinal cord.  Following surgery our client underwent physical therapy, completing land and aquatic treatments. She continues to follow up with her neurosurgeon and will do so for the foreseeable future.

The full $100,000.00 policy limits were offered to the client due to the nature and severity of the injuries that she sustained because of this accident.  This case was settled in the pre-litigation phase and did not require filing of a lawsuit.

In June 2020, our client was riding as a passenger in a friend’s vehicle when she sustained multiple serious injuries when the vehicle was involved in an auto accident. The car our client was riding in failed to stop at a posted stop sign and collided with another car that was traveling on the intersecting road. The force of the collision caused both cars to travel off the road and into an old brick schoolhouse. Our client was transported to Toledo Hospital via emergency medical services for treatment of her injuries.

At the hospital, our client was found to have sustained numerous severe injuries. She was diagnosed with a fractured pelvis, a collarbone fracture, a fracture to her right ankle, broken ribs, a ruptured bladder, a punctured lung, and internal bleeding. She was admitted to the ICU and was required to remain in the hospital for the next two weeks following the accident. Due to the severity of the fracture to her collarbone, our client was required to undergo a surgical repair with placement of metal implants to stabilize the injury.

We were contacted by our client’s mother to assist in her daughter’s recovery after this horrific accident occurred. Through successful negotiations, we avoided trial and obtained a large settlement for our client. In April 2018, our client was working as a medical supply technician at a hospital in Cleveland, Ohio. At the time of the accident, he was transporting a cart of medical supplies from one floor to another. As our client pushed the cart onto the elevator, the doors closed, the lights went out and the elevator violently plummeted to the basement level. Once the elevator stopped, our client located the alarm button and called for help.

When the elevator doors finally opened, the elevator floor was not flush with the basement floor and our client had to be assisted out of the elevator by another employee. Our client immediately felt sharp stabbing pains in his left leg and neck, causing him to seek immediate medical attention. As a result of the accident, our client sustained serious personal injuries to his back and neck, and he also incurred serious psychological injuries including PTSD and a phobia of elevators.

We initially filed suit in court on behalf of our client, however, due to a successful negotiation we avoided the need for trial as we obtained a satisfactory confidential settlement for our client.

In June 2020, our client was traveling in Blanchard Township, Ohio when she sustained serious injuries in a motor vehicle accident. As our client was heading northbound on U.S. 68 approaching the intersection with State Route 60, the defendant driver, who was traveling eastbound on State Route 60 failed to yield the right of way to our client, causing a collision. The impact of the accident caused our client’s vehicle to travel off the road, flip, and land on its side.

The Hardin County Sheriff’s Office responded to the scene and after an investigation cited the defendant driver for failure to yield. Due to the severity of her injuries, our client was taken from the scene of the accident to a nearby hospital via Life Flight. At the hospital, she was diagnosed with a severe open right ankle fracture. She then remained in the hospital for the next six days and was required to undergo surgery to repair the injury to her ankle.

We were contacted shortly after this horrible accident to assist our client in her recovery. Through successful negotiations, we avoided the need for lengthy litigation and obtained a satisfactory settlement for our client. In 2019, our client was traveling along State Route 15 in Defiance, Ohio when he was involved in a motor vehicle accident as he slowed down to turn into a private drive. The defendant driver following behind our client’s vehicle failed to keep an assured clear distance and struck the rear end of our client’s car. The Defiance County Sheriff’s office responded to the scene and after an investigation, cited the defendant for failing to maintain assured clear distance. After the collision, our client was taken by private transportation to a nearby hospital for treatment of his injuries and subsequently began treating his injuries with an orthopedic doctor.

Our client’s orthopedic doctor diagnosed him with a tear to the tendons in his left shoulder. Our client then began physical therapy and underwent several injections to treat his injury. Once he had completed this course of treatment, our client was still experiencing a great amount of pain, at that time it was recommended that our client undergo surgery on his left shoulder. Following the surgery, our client began physical therapy again to continue rehabilitating the injury.

Prior to the accident, our client worked as a motorcycle mechanic. Due to the accident and his injuries, he was forced to take four months off of work resulting in a significant wage loss. While he was able to return to work for a period of time, eventually, due to the restrictions and limitations he incurred in the accident, our client was unable to do his job fully and he, unfortunately, lost his job.

We were retained to assist our client shortly after the accident occurred. We completely avoided the need for our client to ever set foot in a courtroom and through successful negotiations we obtained a satisfactory settlement for our client. The settlement we recovered on our client’s behalf will go a long way to account for his pain and suffering.
