Settlement – Man Sustains Serious Injury When Driver Fails to Stop at Stop Sign

In May 2019, our client was traveling eastbound on State Route 613 in Allen Township, Ohio, approaching the intersection with I-75, when he sustained serious injuries in a motor vehicle collision because the defendant driver failed to stop at a posted stop sign and struck our client’s vehicle. Our client was transported from the scene of the accident by ambulance to Blanchard Valley Hospital to treat his injuries.

At the hospital, it was determined that our client was suffering from injuries to his shoulder, hip, and hand. He then sought further treatment from an orthopedic surgeon, who determined that he had sustained multiple tendon tears to his right shoulder and that surgical intervention was necessary to repair our client’s injuries. Our client also required extensive physical therapy for the injuries to his lower back and hip.

We were contacted by our client’s wife to assist them in their recovery. Due to a successful negotiation, we were able to avoid the need for our client to undergo stressful litigation as we were able to obtain a large settlement for him.

Passenger Vehicle Struck by Tractor-Trailer. Resulting in Eight Car Pile-Up

In the summer of 2018, our client and his spouse were traveling on I-280 on what seemed like a normal day. Unfortunately for out client, the operator of a tractor-trailer was not paying attention to the road, and rear-ended our client. The impact threw our client’s vehicle from the road, resulting in an eight-car pileup. 

As can be imagined, the damage to our client and their vehicle was tremendous. Emergency crews had to cut our client out of their vehicle due to the extensive damage. Our client suffered a crushing injury to their lower extremities, a hematoma to their leg, and several lacerations and contusions. Our client underwent numerous treatments and rehab as a result. 

Due to the severity of their injuries, our client was out of work, could not enjoy their hobbies, and faced a long road to physical recovery. With this in mind, our attorneys zealously represented our clients in seeking treatment and avenues to recovery. 

Though the trucking company at first offered a settlement in the amount of $40,000, our attorneys knew that we could get more for our client. After rounds of negotiations and advocating, we achieved a $215,000 settlement for our client without stepping into court.

Couple on Motorcycle Hits Fallen Utility Pole Across Highway, Recovers $195,000 in Settlement

Late one July evening, a couple was enjoying an evening motorcycle ride on a rural highway outside of Cincinnati, Ohio. Unknown to our clients, a few miles up the road a vehicle had driven off of the road, struck a utility pole, causing the utility pole to split and fall across the opposite lane. Due to the night conditions, our clients did not see the fallen utility pole, struck it with their motorcycle, and were sent flying through the air ultimately crashing to the pavement below. 

As can be imagined, any accident involved a motorcycle can result in devastating injuries. Both clients suffered extensive damage to their bodies including close head injuries, broken bones, sprains, spinal damage, and multiple abrasions and lacerations. 

Though it may seem like recovery was not possible due to the nature of the accident, our attorneys pursued a claim against the driver of the vehicle that struck the utility pole. After months of pursuing a claim, our attorneys reached a $195,000 settlement for our clients.

Semi-Truck Merges into Client’s Lane, Dragging Client for 100+ Yards, Client Had to be Cut out of Vehicle, Recovers $185,000

Over Memorial Day Weekend, our client was traveling from their home in Kentucky to Michigan to visit friends and family. However, while on I-75, a semi-truck merged into our client’s line. Our client, driving a compact car, was sideswiped by the semi-truck, but the semi-truck continued to drag our client’s vehicle for over 100 yards.

Our client’s car was totaled, and first responders had to cut our client out of the vehicle because of the damage caused by the impact and being dragged for so long.

Our client reported various injuries, including a skull fracture, neck injuries, including injuries to both ankles, legs, and arms.

Without stepping foot into a court room, our attorneys and staff fought and received a $185,000 settlement four our client. This settlement will compensate our client for the various medical expenses they incurred, along with recognizing the pain and suffering our client faced in having been involved in such a terrible situation.

Minor Soccer Player Suffers Devastating Nose Injury, Undergoes Multiple Failed Surgeries, Pursues Medical Malpractice Claim and Receives $170,000 Settlement

In 2015, a minor went to a soccer game with their youth group at a local church. After the game, the participants gathered to enjoy group-facilitated games and activities. Our client, in course of the activity, was blindfolded and told to follow the voice of those around them. Unfortunately, our client collided with a steel pole causing significant injuries to their nose. 

Unfortunately for our client, they underwent several surgeries to no avail. The operating doctors struggled to effectively set their nose and refused to conduct any sort of reconstructive surgery. Because of this, our client struggled to breath, could not participate in sports, and struggled with day-to-day activities. Finally, after years of struggling, our client received a full rhinoplasty. However, the rhinoplasty failed, and our clients nose caved in. 

Through working with several medical professionals and advocating on behalf of our client, we pursued recovery for the failed surgery and botched medical practices. As a result, our client has been compensated for her suffering and is on the road to a successful recovery.

$110,0000 Settlement – Motorcycle Driver Suffers Fractured Foot When he is Hit by a Truck

Bicycle Rider Hit By Car Received Policy Limits Settlement

A Lucas County man was riding his bicycle in the early evening hours of September 2021.  As he approached the intersection of Bancroft and Robinwood he witnessed a vehicle begin through the intersection, and another run a stop sign.  The car that ran the stop sign struck the other vehicle in the rear end.  This collusion caused the vehicle to spin out of control and strike our client who was still on his bicycle. Our client was transported by ambulance to St. Vincent Mercy Medical Center.  Our client sustained a broken left arm that required surgery with hardware to repair the damage.  He also sustained a right dislocated elbow, and a right PCL tear in his knee.  Our attorneys were able to obtain a quick policy limits settlement of $100,000 from the insurance company.  The firm was also able to obtain an additional $25,000 from our client’s medical payments coverage; for a gross settlement of $125,000.

Driver Rear-Ends Client in Toledo, Suffers Severe Spinal Injury along with Others – Client Quickly Receives $105,000 Settlement

In June 2020, our client was stopped at a redlight at the intersection of Alexis and N. Detroit in Toledo. Though lawfully stopped, our client was rear-ended by another vehicle, driven by a distracted driver. The impact was so forceful, the rear-ending vehicle became lodged underneath the rear of our client’s vehicle. 

Our client suffered significant injuries to their legs, back, and spinal cord. Because of these injuries, our client was forced to miss several weeks of work, along with several rounds of surgeries, including the placement of rods and screws in their lower spine. When asked how these injuries most impacted their life, our client responded that it is “forever having pains and discomfort and possibility of lifetime pain management.” Our client continues to rehabilitation and pain mitigation efforts, along with therapy due to the fear of driving after having suffered such a troubling auto accident.

Employee of Car Dealership Crosses Center Line, Collides Head On With Client, Injuries Include Whiplash, Sprains, Lacerations, and Wrist Damage, Resulting in Several Surgeries

In the Fall of October, 2018 our client was traveling in Fulton County, Ohio. Unbeknownst to him, an employee of a car dealership was about to pull out of the lot. As the employee did so, they crossed the center line, traveled in the wrong direction, and hit out client head-on.

As a result of the head-on collision, our client suffered several injuries, including multiple muscle strains, whiplash, lacerations, and a prolonged injury to their right wrist. Our client has a family, and worked full-time to support their partner and several children. Because of this injury, our client struggled to make ends meet financially, do basic household chores, and be there for their children.

In conducting discovery and investigation into the employee of the car dealership, our attorneys and staff discovered that the employee of the car dealership has had several convictions for drug crimes and a history of license suspensions. Because of this, our attorneys not only pursued a negligence claim for failure to drive safely, but also a claim against the car dealership for negligently entrusting the task of driving to the employee.

We were able to reach a $100,000 settlement for our client after filing a lawsuit and conducting extensive depositions.

Vehicle Strikes Client as Client was Turning Left, Suffers Wrist Fracture and Other Injuries, Boyk Attorneys Recover $100,000 Settlement

While lawfully turning left on a road in Toledo, Ohio, a motorist crossed the center line in an attempt to pass our client. However, as the other motorist began to illegally pass our client, our client engaged in a left turn, resulting in the other motorist crashing into the driver’s side of our client’s vehicle.
