Toledo Motorcycle Accident Victim Sues Board of Education for Damages

On September 24, 2019, our client, a resident of Toledo, Ohio, was operating a motorcycle on Central Avenue when a Toledo Public Schools Bus, driven by an employee, suddenly cut him off and forced him to take evasive action to avoid a collision with the rear of the bus. In doing so, the plaintiff locked up the motorcycle’s brakes and laid the bike down on the roadway, causing him to suffer significant injuries.

Our client sustained injuries to his left leg and foot that required substantial medical care, including surgery. On September 27, 2019, a mere three days after the accident, our attorneys sent a spoliation letter formally demanding that the video footage from both buses be retained and preserved. On October 25, 2019, our office was notified in writing that the school did not have any video footage from either bus because the SD cards overrode themselves.

Approximating damages from a motorcycle accident

The driver of the bus had a duty to exercise caution for the safety and welfare of other motorists. This duty of care includes the obligation to adhere to the laws of the State of Ohio and any applicable school bus regulations and policies. The driver of the bus breached their duty and was negligent in keeping a proper lookout, completing an unsafe lane change, and cutting off the biker in his lane of travel, directly causing the plaintiff to crash the motorcycle he was operating.

As a direct and proximate result of this negligence, our client sustained serious personal injuries requiring medical and hospital care. This caused them to incur substantial medical bills, along with property damage, lost wages, and other economic losses.

Furthermore, the client believes his injuries are permanent and will require future medical care and costs, and that he will continue to endure great pain and suffering, mental anguish, and emotional distress. The defendant is liable for the injuries to the plaintiff resulting from its employee’s negligent operation of a motor vehicle.
