Driver Pursues Claims Against Negligent Motorist and Insurance Company for Damages

In the Common Pleas Court located in Lucas County, Ohio, our clients are pursuing a personal injury case against a negligent driver and their own insurance company after they both sustained multiple injuries in a car accident.

On July 31, 2018, our client was lawfully operating a vehicle in Toledo, Ohio while his wife was a passenger. While traveling westbound on Central Avenue, their vehicle was struck by the defendant when he suddenly turned left in front of oncoming traffic. The defendant was cited for Reckless Operation and Rules For Turns At Intersections by the Toledo Police Department.

Establishing Fault

The defendant owed our clients a duty of care to operate his vehicle in accordance with the laws of the State of Ohio and the City of Toledo and failed in that duty by turning left in front of them. As a result of the defendant’s negligence, the plaintiffs both suffered serious personal injuries including injuries to the neck, back, shoulder, torso, ribs, and chest. The plaintiffs both have been required to undergo medical care and have incurred substantial medical costs as a result of the accident.

In addition to physical injuries and medical costs, the plaintiffs endured pain, suffering, emotional distress, and economic loss. The injuries that the plaintiffs sustained are believed to be permanent in nature and will require future medical care and costs, as well as resulting in future pain and suffering.

Additionally, at the time of the accident, the defendant was not the titled owner of the vehicle he was operating. The titled owner of the vehicle had a duty not to entrust their vehicle to a negligent driver. Because the driver was inexperienced or careless and the titled owner should have known that, that duty of care was breached. What’s more, at the time of the accident, the at-fault parties did not have the necessary insurance to cover the total damages and costs from the accident. For this reason, the plaintiffs are seeking monetary compensation from their own insurance company under an uninsured/underinsured motorist policy.
