There are four former railroad workers who have recently filed a lawsuit against BNSF Railway. They are alleging that their lung cancer and/or lung disease was caused by conditions that were present in their workplace.
The four men allege that exposure to dusty working conditions resulted in damage to their lungs and respiratory systems. Their lawsuit states that exposure to toxic ballast rock, gravel, coal dust and certain kinds of fibers caused the men to contract occupational lung diseases.
The men worked with tools and machinery that stirred up large amounts of toxic particles and dust. BNSF failed to provide ventilation, warnings, and protection.
Two of the men who worked on the railroads did so in the 1940’s while the other two were employed beginning in the late 1960’s. They are all members of the Navajo Nation.
