Severely Injured Prison Guard Fights for Fair Compensation
The personal injury lawyers at the Charles Boyk Law Offices are currently representing a prison guard who was attacked by several inmates while working at the Toledo Correctional Institution. Our client was a model employee at the facility with over three years of experience and dedication to corrections in Ohio.
This incident resulted in serious harm to our client. The injuries ranged from a facial laceration to lasting mental anguish. As the courts have noted, this attack left our client with severe physical and psychological injuries. Following these injuries, our client’s initial filing for workers’ compensation was granted for his physical injuries.
As treatment continued and our client began seeing a psychiatrist it was determined our client was suffering from Post-Traumatic Stress Disorder (PTSD). This condition prevents our client from fully participating in life and his profession. In response to this, we acted quickly and motioned to have his PTSD diagnosis included in his workers’ compensation.
The Ohio Industrial Commission agreed with our client and expanded his compensation to cover his diagnosed PTSD, noting their finding was based on persuasive reports prepared by highly trained medical professionals. After this motion, our client’s employer, the Toledo Correctional Institution, appealed this decision in order to exclude PTSD from our client’s compensation.
On this appeal, the District Hearing Officer affirmed the previous decision and ordered our client’s compensation include his PTSD diagnosis. On another appeal, the employer sought to appeal this previous order to the Ohio Industrial Commission – this appeal was also denied.
In another appeal effort, our client’s employer is appealing these rulings to the Court of Common Pleas of Lucas County, Ohio. It is our hope that this court reaffirms previous decisions and ensures that our client can receive compensation for both his traumatic physical and psychological injuries.
