Nursing Home Abuse Lawsuit

Last year a resident of a nursing home in Niles, Ohio, Eva Gorosic, walked out of the facility during cold weather conditions and died of hypothermia. The estate of the deceased is now suing Grace Woods Senior Facility, and Andrea Clark, an employee of the nursing home.

The lawsuit states that Grace Woods and Clark “negligently failed to provide [Gorosic] with adequate, appropriate, and timely medical treatment, nursing care, and other services, consistent with the program for which she contracted.”

On April 9, 2012, when Gorosic walked out of the Grace Woods facility, Andrea Clark was the only resident-care assistant, responsibly for 30 residents. Gorosic left her room between 4 am and 6am, and when was nowhere to be found within the facility after a search, Niles police were called at 6:30 am.

The lawsuit against Grace Woods and Andrea Clark explains that Gorosic was subject to nursing home negligence. She suffered “injuries to her head, arms, knees and other parts of her body, suffered great pain of body and mind, suffered mental anguish, emotional distress, humiliation and loss of dignity, and died.”

An investigation was conducted by the Ohio Department of Health after the death of Gorosic, and the results found that there was a “real and present danger” to residents of the facility. As of May 2012, the facility supposedly corrected the violations.

Andrea Clark was convicted of misdemeanor patient abuse on April 4, 2013 and is now on one year probation. The estate’s lawsuit is also seeking other damages that we do not have the details of.
