Underinsured Motorist Claim Filed After Negligent Driver’s Policy Limit Was Reached

Our clients, a husband and wife, are proceeding with a claim against their own auto insurance company for underinsured motorist coverage after a negligent driver’s policy limit was reached and our clients’ damages were greater than that limit. This negligent motorist rear-ended our client on May 25, 2018 after he failed to maintain a safe distance from our client’s vehicle. Due to the impact, our client was then pushed off the right side of the roadway and came to a stop after landing in a ditch.

Our clients’ insurance company issued a policy to them that covered uninsured and underinsured motorist damages. This coverage allows them access to additional compensation for damages when an at-fault driver does not have enough liability coverage to pay their full damages. Our clients are expecting the defendant to be held responsible for paying under the policy mentioned, as well as any further relief the court deems necessary.

Through this claim, our client seeks compensation for medical expenses, serious and permanent injuries to her neck, chest, hip, ribs, and back, as well as brain injury, and emotional distress. In addition to past medical expenses, these injuries will require future medical costs. Our client’s relationship has also suffered as a result of the injuries caused by this accident, so we are pursuing a loss of consortium claim for the loss companionship, society, and services that has occurred due to this crash.
