Toledo Driver Sues for Injuries Sustained in Improper Backing Truck Accident

On July 30, 2020, our client was driving southbound on the intersection of Fearing Boulevard and Hill Avenue in Toledo, Lucas County, Ohio. At the same time, another driver operating a semi-tractor trailer owned by K&B Transportation, Inc. was attempting to make a right turn onto Hill Avenue.

When the truck operator was unable to complete the right turn, she reversed the semi into the front of our client’s car. The force of the impact sent our client’s vehicle off the road.

At the scene of the crash, the defendant was cited for improper backing. Following the truck accident, our client was taken to Toledo Hospital for evaluation and treatment of his injuries. The second defendant, K&B Transportation, Inc., is the negligent driver’s employer and registered owner of the semi-tractor trailer. Consequently, the company is responsible for its employee’s actions.

Additionally, K&B Transportation, Inc. has a responsibility to investigate the fitness of each of their drivers, conduct proper training, enforce regulations, and supervise the actions of their employees before allowing them to operate its commercial vehicles. Therefore, the company is liable for negligently entrusting its commercial motor vehicle to the driver.
