Family Sues for Injuries and Losses Following Distracted Driving Accident

Family Sues for Injuries and Losses Following Distracted Driving Accident

On August 16, 2018, our client, then 17 years old, was driving southbound on Dublin Road in Dublin, Ohio, with his 14-year-old sister in the passenger seat. He was following his parents, who were driving in a separate vehicle.

Our client came to a stop on Dublin Road and waited for oncoming traffic to clear so that he could make a left turn on Locust Hill Lane. At the same time, the driver behind him dropped a lit cigarette between his legs.

As the distracted driver leaned down to grab the cigarette, he rear-ended our client’s stopped vehicle. The force of the collision caused our client’s vehicle to flip onto its roof and travel off the roadway. The vehicle finally came to a rest upside down. Our client’s parents were witnesses to this accident, but fortunately, they were not hit.

After the wreck, our client was taken to Nationwide Children’s Hospital for treatment. Meanwhile, medics began treating his sister at the scene of the accident. The defendant received a traffic violation for inattention.

Our client and his sister suffered serious injuries and unnecessary harm due to the other driver’s negligence. Additionally, their parents, the additional plaintiffs in this case, experienced significant emotional distress as a result of this accident. Our attorneys at Charles E. Boyk Law Offices are pursuing a legal claim on behalf of this family to obtain compensation for all their injuries and losses.

Our Clients’ Case Against the Negligent Motorist

All drivers on state roads must follow traffic laws and pay attention to their surroundings. However, the defendant drove while distracted, failed to keep a safe distance ahead, and negligently struck our client’s vehicle.

Because of this, our client suffered serious injuries, including lacerations, a concussion, and serious injuries to his head, neck, arms, back, legs. He has also developed post-traumatic stress disorder. As our client underwent intensive medical care, he incurred expensive medical bills.

Our client’s sister also suffered severe injuries, including lacerations and severe injuries to her head, neck, arms, back, and legs. Her parents have incurred economic losses due to these medical expenses. Both our client and his sister believe their injuries are permanent and will require additional medical care in the future.

This entire family has experienced great pain, suffering, mental anguish, and emotional distress. Additionally, both parents have been deprived of the love, affection, services, consortium, and society of their children.

The parents have also been unable to perform daily activities with their children and have suffered a loss of enjoyment of life. Hoping to obtain full compensation for our clients, Charles E. Boyk Law Offices is seeking claims against the at-fault driver and our clients’ uninsured/underinsured motorist policy.
