Wood County Family Sues for Injuries Sustained in Head-On Collision

Wood County Family Sues for Injuries Sustained in Head-On Collision

On December 8, 2020, our client was driving northbound on State Route 25 in Center Township, Wood County, Ohio, with his wife and three-year-old daughter in the car. The defendant was driving southbound on the same highway when they drove left of the center and sideswiped another vehicle before colliding with our client’s car head-on.

The collision caused our client’s car to logroll before coming to a rest. Our client lost consciousness had to be mechanically extracted from the vehicle. His wife (the second plaintiff) was able to crawl out of the broken windshield after the crash. Both clients and their daughter suffered severe injuries as a result of this accident.

At the scene of the accident, the Wood County Sheriff’s Department stated that the defendant contributed to the catastrophic crash by driving left of center. As the negligent driver died from his injuries, Charles E. Boyk Law Offices is seeking compensation from his estate for our clients’ injuries and damages.

Establishing The Defendant’s Negligence

The negligent driver had a duty to operate his vehicle lawfully and take caution near others on the road. He breached his duties by failing to maintain reasonable control of his vehicle, driving left of center, and colliding head-on with our clients’ vehicle. The defendant’s reported contributing circumstances constitute negligence per se, strengthening our client’s claim.

Seeking Compensation for Clients’ Injuries & Damages

Due to the at-fault driver’s negligence, our clients suffered permanent, life-altering injuries. The father suffered multiple spinal fractures and a foot fracture that required a surgical implant. The mother suffered injuries to her lumbar spine, right shoulder, and head. Our clients’ three-year-old daughter also suffered severe neck injuries.

All of our clients had to undergo professional medical treatment, resulting in hospital bills, lost wages, and other related costs. Due to the permanent nature of these injuries, our clients believe that they will continue to incur medical costs. Additionally, our clients experienced great pain and suffering, severe mental anguish, emotional distress. They are also unable to participate in the same activities or hobbies as they did prior to the accident.

As a direct and proximate result of the negligent driver, our clients have experienced a loss of spousal consortium, being deprived of the love, affection, services, and society of each other. Our clients also experienced a loss of familial consortium as they have been deprived of their child’s love, affection, services, consortium, and society. Our clients’ quality of life has been severely impaired due to the negligence of the defendant. Our attorneys are seeking compensation to address all these economic and non-economic losses.
