Truck Driver Severely Injured During Unloading Incident
On October 22, 2019, our client was helping unload a trailer at Union Tank Car Company’s facility when he was knocked from the cargo box to the ground by sheet metal as it was being moved by a crane. As a result of this incident, our client sustained multiple serious injuries to his lungs, ribs, and clavicle.
Our client is pursuing legal damages against Union Tank Car Company for negligence and breach of duty of care. Since our client was a self-employed truck driver, he does not have the responsibility of unloading his cargo. Despite this, the Union Tank crane operators directed our client to assist them in unloading the sheet metal and declined to do their jobs unless he assisted.
As the second load of sheet metal was being moved from the truck, our client gave numerous verbal warnings that the crane was not hooked properly, and that the operator should refrain from moving the load. Yet, the crane operator repeatedly ignored our client’s warnings and continued to lift the sheet metal with the equipment, consequently knocking our client from the trailer to the ground.

The impact our client sustained has caused extensive personal injuries. These injuries forced him to undergo multiple surgeries and could require substantial future medical care. Additionally, he is now burdened with considerable medical costs, economic hardships due to lost wages, severe mental anguish, and emotional distress.
Our client also has two children who have been impacted by this incident by affecting their enjoyment and quality of life. It has also affected their ability to carry on the normal activities of daily life with their father as a result of this incident.
