Madison County Driver Sues for Injuries Sustained in Hit and Run

Madison County Driver Sues for Injuries Sustained in Hit and Run

On April 9, 2020, our client was driving westbound on I-70 in Madison County, Ohio, when he noticed another motorist speeding and driving aggressively toward him. Our client and the reckless driver pulled over to the side of the road and stopped their vehicles. As our client exited his vehicle, the defendant reentered the roadway, violently striking our client, who was on foot at the time.

The force of the impact caused our client to be thrown into the air. As he landed on the road, he was knocked unconscious. The defendant fled the scene and avoided police custody for several days following the collision. Police charged the reckless driver with aggravated vehicular assault and failure to stop after an accident.

After the collision, our client underwent medical treatment for his severe injuries. Unfortunately, he has not regained consciousness. Given his incapacitation, our attorneys at Charles E. Boyk Law Offices are working to seek compensation for all his injuries and damages related to the accident.

Establishing the Other Driver’s Negligence

The negligent driver had a duty to operate his vehicle lawfully and take caution near others on the road. He breached these duties by driving recklessly and aggressively striking our client. The defendant also fled the scene of the accident, demonstrating a conscious disregard for the rights and safety of our client. The at-fault driver’s aggravated vehicular assault and failure to stop charges constitute negligence per se, strengthening our client’s claim for compensation.

Assessing Our Client’s Injuries and Damages

Due to the at-fault motorist’s actions, our client suffered catastrophic injuries, including severe brain trauma, blunt force trauma, facial fractures, and multiple rib fractures. Our client remains in an unresponsive state, completely dependent on the care of his family members.

Because of the extensive medical care needed to treat his conditions, our client has incurred significant economic losses as a result of the accident. He has also experienced great pain and suffering, mental anguish, and emotional distress. In addition to these economic and emotional losses, our client has been unable to participate in the daily activities and hobbies he previously engaged in.

If the negligent driver had operated his vehicle lawfully, our client’s injuries and damages could have been avoided. On behalf of our client and his family, our attorneys are seeking compensation to address all of these economic and non-economic damages.
