Infant Formula Litigation Update
Charles E. Boyk Attorneys are actively handling Similac and Enfamil infant formula lawsuits for families whose premature babies suffered or died from necrotizing enterocolitis (NEC) after taking one of these formulas.
NEC requires aggressive medical intervention. In one case we filed, our client’s premature baby was fed a Similac cow milk-based formula. She quickly developed multiple organ failures and had to undergo a triple organ transplant. Her prognosis, like many premature infants who developed NEC after being given this formula, is bleak. Our firm continues aggressively investigating and litigating these cases to hold these manufacturers accountable.
East Palestine, OH Train Derailment
On February 3, a Norfolk Southern train carrying over 100,000 gallons of ultra-toxic and dangerous chemicals derailed in East Palestine, Ohio. The derailment resulted in a massive inferno, spewing poisonous fumes into the air. The images grabbed the nation’s attention and put a spotlight on the safety practices of the railroad industry.
Estimates are that more than a half million individuals have been adversely impacted. The widespread harm caused by Norfolk Southern Corporation’s negligence resulted in lawsuits by the State of Ohio and the Department of Justice. It also prompted a class action.
Judge Benita Pearson, who is overseeing the litigation, selected a team of complex litigation attorneys to lead and oversee the coordinated action. Among those selected was Boyk Law attorney Wes Merillat. Our firm currently represents business owners, property owners, and individuals forced to leave their homes. We are committed to holding Norfolk Southern fully accountable for the harm it negligently caused.
Sex Abuse Litigation – Confidential Settlement Reached Against Oscar Winner
Our firm is committed to providing representation to victims and survivors of sexual assault and abuse. We have a dedicated team of attorneys and staff to expertly handle cases on behalf of those who are victimized. We have represented clients against medical professionals, schools, universities, businesses, employers, nursing homes, clergy, and recently, against a Hollywood Oscar winner whose films have grossed billions.
Our client, a citizen from South Africa, had been sexually victimized by this individual. We were able to reach a confidential, out-of-court settlement for her.
Commercial Trucking Settlement
As a paramedic and father of two, our 33 yr. old client was living a very fulfilling life – helping others and providing for his family. But when a commercial truck disregarded the emergency lights and sirens on his ambulance and caused a T-bone collision, the first responder went from a care provider to a care recipient.
Our team of medical experts, vocational experts, and an economist helped demonstrate how extensive our client’s injuries and economic damages were. After extensive efforts, our firm’s PI and workers’ comp teams were able to reach a life-changing, confidential settlement with both defendant’s insurer and Workers’ Comp.
Camp Lejeune Litigation
From 1953 to 1987, at least one million enlisted servicemen and women, their families, and civilian staff were poisoned by contaminated water at Camp Lejeune. Recognizing this, the Camp Lejeune Justice Act (CLJA) was signed into effect on Aug. 10, 2022.
Before the CLJA was enacted, litigation was previously denied to those who were affected, but now these individuals will finally be able to have their day in court. Despite what many national advertisements claim, pursuing a claim is an involved process. Boyk Law has a dedicated team investigating, filing, and working to obtain justice for Camp Lejeune victims.
Breast Implant Cancer Litigation
In July 2019, at the FDA’s urging, Allergan issued a voluntary, worldwide recall of its Biocell® textured breast implants and tissue expanders because women with the implants developed breast implant-associated anaplastic large cell lymphoma (BIA-ALCL), a rare form of non-Hodgkin’s lymphoma.
Though BIA-ALCL has occurred in some patients with smooth implants, research revelated that Allergan’s BIOCELL Natrelle textured implants have a six times higher rate of BIA-ALCL cancer development than other types of implants or tissue expanders. Reports show that BIA-ALCL is diagnosed an average of 8 years after implant surgery. Allergan was aware of a link between its implants and BIA-ALCL in 2011 but continued to market them without warning.
Charles Boyk Law represents women in this litigation, which has been centralized in the United States District Court, District of New Jersey.
3M Earplug Litigation
In one of the largest mass tort litigations in history, more than two hundred thousand current and former service members are suing 3M and one of its subsidiaries, alleging its Combat Arms version 2 earplugs were defective and left servicemembers with hearing loss and tinnitus.
3M has lost 10 of the 16 cases that have gone to trial so far, with a total of $265 million awarded to plaintiffs in those cases. This litigation has been centralized before U.S. District Judge Casey Rodger, Northern District of Florida. After failing to shield itself in bankruptcy proceedings, 3M has returned to mediation to reach a global settlement.
