Policy Limits Plus Workers’ Compensation Benefits For Pedestrian Hit By Car

Our client was working for one company and parked in the parking lot of another employer where he was assigned to work. An employee of another subcontractor hit him as he was walking to the entrance. Our client suffered a closed fracture of the left femur resulting in surgery, and in-patient and outpatient rehabilitation. We were easily able to obtain the policy limits on the auto claim. The difficulty was winning the workers’ compensation claim by proving that he was in the “zone of employment” for a fixed situs employer. He was required to park in the parking lot and was within 30 feet of the entrance to obtain his badge. This allows the client to get his medical bills, lost wages, and eventual permanent partial disability.
