On June 26, 2020, our client was driving on Starr Avenue in Oregon, Lucas County, Ohio, when the cars ahead of him began to slow. Our client slowed down with the flow of traffic, but the driver behind him did not. This negligent motorist rear-ended our client, causing him to suffer severe injuries.
At the scene of the crash, the Oregon Police Department cited the other driver for speeding, and our client was transported to the hospital for emergency treatment. This unfortunate event could have been avoided if the negligent motorist had driven at an appropriate speed. On behalf of our client, we are suing the defendant to hold him accountable for his reckless actions.
Establishing Negligence and Assessing Our Client’s Damages
All drivers have a responsibility to follow state traffic laws and keep others safe, but the defendant failed to do that. He breached his duty of reasonable care by speeding, following too closely, and striking the rear end of our client’s car. As the speeding ticket constitutes negligence per se, there is no question that this motorist is responsible for the accident.
This rear-end collision caused our client to sustain serious injuries to his neck, for which he required extensive medical treatment. Because his condition is believed to be permanent, he will undoubtedly continue to incur medical costs.
Our client will also continue to endure great pain, suffering, and anguish. To offset his physical and psychological pain and financial losses, we are seeking compensation from the other driver.
