Injured Driver Pursues Damages Against State Farm

Injured Driver Pursues Damages Against State Farm

In October 2018, our client was driving through an intersection in Findlay, Ohio, when a negligent driver ran a stop sign and struck the front passenger side of our client’s vehicle. In addition to property damage, our client sustained severe injuries.

Our client pursued a claim against the at-fault driver and obtained a policy limits offer. Unfortunately, the at-fault driver only had state minimum coverage of $25,000, which was not enough to cover our client’s injuries and damages. Because our client’s own auto insurance policy through State Farm provided up to $100,000 in coverage for injuries caused by uninsured and underinsured motorist coverage, we have filed suit against State Farm to obtain a judgment that will cover the rest of our client’s damages.

Pursuing Underinsured Motorist Coverage

Although our client was able to settle her claim against the negligent driver, her damages exceeded their insurance policy limits. This is not uncommon when negligent drivers only have state minimum liability coverage. Due to the serious and permanent injuries to our client’s neck and right shoulder, she incurred substantial medical expenses after the car accident, along with suffering pain, mental anguish, and emotional distress.

This collision completely altered our client’s life, and she requires compensation to reflect her lifelong damages. Luckily, because she had an insurance policy that provided uninsured and underinsured motorist coverage, we can pursue this claim in court against State Farm to account for the damages that exceed the opposing party’s insurance company.
