Lawsuit Filed of Behalf of Man Assaulted by Dick’s Sporting Goods Employee

Charles E. Boyk Law Offices has filed a lawsuit against Dick’s Sporting Goods, Inc. and Carl V. Stahl for injuries and damages sustained by the late Aaron Buckenmeyer after loss-prevention-officer Stahl assaulted him at a Dick’s Sporting Goods location in Toledo, Ohio.

TOLEDO, Ohio – On July 2, 2020, Aaron Buckenmeyer, 36, was violently assaulted by a loss prevention officer at the Dick’s Sporting Goods location at 5001 Monroe Street in Toledo, Ohio. The attack on Mr. Buckenmeyer, lasting approximately five minutes, was caught on video by bystanders and shared widely, creating outrage both locally and nationally.

This week, Charles E. Boyk Law Offices, LLC filed suit against Dick’s Sporting Goods, Inc. and Carl V. Stahl, the loss prevention officer. The lawsuit is filed on behalf of Mr. Buckenmeyer’s estate, due to his death in December 2020.

The complaint alleges that Aaron Buckenmeyer was a customer at Dick’s Sporting Goods last July when Stahl approached him in a threatening manner and, without provocation, grabbed Mr. Buckenmeyer by the neck and slammed him forcefully to the ground, placing him in a chokehold against the floor and beating him. According to the complaint, Stahl continued to use a chokehold even as Mr. Buckenmeyer, an asthmatic, called out that he was having trouble breathing and bystanders shouted that he had asthma.

The complaint further alleges that no Dick’s Sporting Goods employees or managers intervened to stop the beating, which left Mr. Buckenmeyer’s face bloodied. Afterward, the complaint claims that Mr. Buckenmeyer was transported to the hospital for evaluation of serious injuries, while Toledo police officers arrested Stahl.

“I was shocked when I saw the video of Stahl beating Aaron Buckenmeyer,” says Katie Harris, an attorney at Boyk Law who represents the estate. “This was unprovoked, unlawful, and senseless. Not only do we believe Stahl should never have been employed by Dick’s Sporting Goods in the first place, but the lack of any intervention as he beat a man bloody for almost five minutes was unconscionable. This is the kind of thing that should never happen to anyone.”

The Buckenmeyer lawsuit makes claims against both Stahl and Dick’s Sporting Goods, alleging that the store is liable for Stahl’s unlawful assault and was also negligent in employing him. Punitive damages are sought against both defendants.

Videos and photos of Defendant Stahl beating Mr. Buckenmeyer were shared widely last year on YouTube and social media, and by local Toledo news sources, and TMZ put the footage on a national stage.

The complaint asks that Stahl and Dick’s Sporting Goods, Inc. be held accountable and ordered to pay compensatory and punitive damages for his conduct.
