Bicyclist Seeks Compensation for Collision with Uber Driver

Our client was riding his bike home from Bowman Park in Toledo, Ohio on June 25, 2018 when he was struck by a car. As our client was crossing an intersection using the crosswalk, a negligent driver did not adhere to the posted road signage and drove through a stop sign, hitting our client in the crosswalk on his bicycle.

The negligent driver who hit our client worked for Uber and was transporting a customer at the time of the crash. The Uber driver was looking at his phone and was not paying attention to the road, which resulted in the collision between our client and the car.

After the crash occurred, the negligent driver got out of his vehicle and began taking a video using his cell phone. He was also verbally abusive to our client at the scene of the collision. Then, the driver got back into his vehicle and fled the scene to drop off the Uber customer he was driving, before returning to the scene of the accident.

Our client required medical care and presented to the emergency room to be treated for serious injuries, including damage to his left knee resulting from the accident.

Determining Fault for an Uber Crash

The at-fault driver owed a duty of care to operate his vehicle safely and to respect the rules of the road. However, the defendant breached this duty by operating a vehicle while being distracted, failing to stop at the appropriate signage, and by entering a crosswalk while a cyclist was using it with the right of way.

As a direct result of the defendant’s negligence, our client was seriously injured and required immediate medical treatment and subsequent surgery.

Additionally, our client suffered great pain, suffering, severe mental anguish, and emotional distress due to the accident caused by the distracted driver. Our client believes that the injuries he sustained are permanent and will require future medical care and costs associated with the medical care.

Calculating Damages for a Claim

On behalf of our client, we are seeking damages for medical costs, pain and suffering, reasonable attorneys’ fees and costs, and other relief.

In addition to the compensation we believe our client is owed, we also believe that the defendant should be subject to punitive damages for his disregard of the rights and safety of our client.

We also seek damages from Uber, because it should be held liable for the negligent acts of its drivers. Uber encourages—and in some cases requires—drivers to utilize their cell phones while driving, a fact that contributed to the negligence of the driver who collided with our client. Furthermore, they should be held accountable in their duty to conduct a proper background check on the driver that struck our client.
