Aggravation of a preexisting condition:

If you have a condition or disability at the time of the accident you are not permitted to any damages for that condition or disability but you are permitted to damages for any aggravation of the pre-existing condition or disability from the injury. You are still permitted to damages if this pre-existing condition made you more prone to the possibility of the injury than a normally healthy person would have been and even if a normally healthy person would not have sustained a significant injury.
