What Are The Characteristics Of A Workers’ Compensation Claim?

Self-Insured vs. State-Funded Employer

One of the things that affect Ohio workers’ compensation claims is the type of employer that you have. Your claim can differ depending on whether your employer is a state fund employer or a self-insured employer. Either way, you deserve compensation for your injuries, but the process will differ depending on the type of employer that you have.

A state fun employer has a state insurance fun so they pay a premium but do not play workers’ compensation claims directly. Those workers with state fund employers will not receive workers’ compensation money without a Bureau of Commission order.

If you have a self-insured employer, your employer would directly pay your workers’ compensation and benefits. Your employer essentially makes the decision of whether or not to pay your claim initially, and if they do not, you would file a motion and your claim would go through a hearings process.

How does a VSSR claim relate to your claim?

VSSR is a “Violation of a Specific Safety Requirement” and there are various codes and regulations related to it. If your employer does not comply with the codes and regulations that are outlined in the Ohio Administrative Code, injury is a likely outcome. If a worker is injured in a violation of VSSR, they are entitled to compensation.

Most of the time when VSSR is involved in a workers’ compensation claim, the worker and the employer settle the case without a hearing. If it does go to hearing, a hearing officer decides whether the case is a VSSR and how much extra money the worker is entitled to.
