Injured Driver Sues for Damages and Uninsured/Underinsured Motorist Coverage after Rear-End Collision

On May 9, 2018, our client was traveling westbound on Bancroft Street in Toledo, Ohio, when they were rear-ended while stopped at a traffic light. The Toledo Police Department arrived at the scene of the accident and issued a citation to the defendant for failing to keep an assured clear distance ahead. As revealed by the citation, if the defendant had kept a clear distance ahead, the crash could have been avoided. As a result of the accident, our client sustained serious injuries and had to be transported to Toledo Hospital Emergency Room to undergo immediate treatment.

Exacting Damages

The plaintiff endured serious injuries to their neck and left shoulder from the collision. They required repeated hospital visits and incurred medical care bills and other economic damages, including lost wages. Moreover, the plaintiff experienced great pain and suffering, mental anguish, and emotional distress. Our client has reason to believe their injuries are permanent and require future medical care.

Additionally, our client is suing Geico, their insurance carrier. The plaintiff pays for uninsured/underinsured motorist benefits that should cover the damages of our client if their needs exceed the policy limits of the defendant’s insurance plan. Our client believes that the defendant’s automobile policy is inadequate and wants to ensure that they will receive the compensation that they will need to make a full recovery.

Lastly, our client’s spouse is filing a lawsuit against the defendant. As a result of the accident, the spouse has been deprived of the love, affection, services, consortium, and society of their spouse. Further, the spouse has experienced that the quality of their life and ability to carry on normal activities have been impeded because of the collision.

As a result of the current claims, our client hopes to receive an amount exceeding $25,000, including interest, costs, reasonable attorney fees, and other such relief that the Court deems fair. Our client is also asking the Court to issue a declaratory judgment in their favor stating that they are entitled to uninsured/underinsured motorist coverage under the policy issued by Geico.
