On or about July 7, 2020, our client was driving southbound on North Clinton Street in Defiance, Defiance County, Ohio. As our client approached an intersection at Sessions Street, another motorist driving a vehicle owned by J & J Lawn Services, LLC attempted to turn left at that same intersection.
The negligent driver failed to yield to the right of way and turned in front of our client, causing the two vehicles to collide. At the scene of the accident, the police cited the defendant for failing to yield to the right of way when turning left. On behalf of our client, we are seeking compensation from both the at-fault driver and J & J Law Services, LLC.
Determining Liability for the Accident
The negligent motorist failed to yield while making a left turn, causing a severe collision. The traffic citation he received at the scene of the crash constitutes negligence per se, proving he is liable for the accident.
The second defendant, J & J Lawn Services, LLC, also bears liability for the collision. All businesses have a responsibility to properly screen and train their drivers. Consequently, they can be held liable when their employees cause dangerous accidents.
Assessing Our Client’s Injuries and Damages
Due to the accident, our client sustained injuries to his neck, back, left hand, right knee, and left shoulder. His injuries have caused him great pain, suffering, severe mental anguish, and emotional distress.
In addition to the physical and mental pain he has experienced, our client also incurred financial losses due to the costs of medical treatment. Because his injuries are believed to be permanent, he will likely continue suffering economic losses. In this case, we are seeking compensation to cover all of our client’s short-term and long-term damages.
