What is a Non-Complying Employer? A non-complying employer is someone that has not paid into Worker’s Compensation. The employee actually benefits in this situation because the employee still has a right to file an Ohio Worker’s Compensation claim and is able to have all the same legal rights as a claim where the employer had paid into the Bureau of Worker’s Compensation.
