Toledo Driver Sues for Injuries Sustained in Improper Passing Accident

On July 22, 2020, our client and a passenger were driving along Glendale Avenue in Toledo, Ohio, when they lawfully stopped and waited to make a left turn into a nearby parking lot. At the same time, another driver was approaching our client’s vehicle from behind. As our client began making the left turn, the negligent driver attempted to pass him by crossing left of center, colliding with his car.

From the accident scene, our client was sent to St. Luke’s Hospital, where he was treated for severe wrist fractures and other personal injuries. The at-fault motorist did not have adequate insurance coverage to compensate our client for the full scope of his injuries. Fortunately, our client is covered by an uninsured/underinsured motorist policy, through which we are seeking additional necessary compensation for his damages.

Suing the At-Fault Driver

The negligent driver had a duty to operate her vehicle in accordance with state and local laws. She breached this duty by failing to safely travel left of center when attempting to pass our client on the road. Because of her negligent actions, our client sustained severe damage to his wrist and other areas of the body.

Our client has incurred extensive medical costs as a result of this accident, including hospital bills and lost wages. Additionally, he has experienced non-economic damages such as pain and suffering. Because our client’s injuries are believed to be permanent, he expects this accident to continue to affect his daily life. To account for these losses, we are pursuing compensation from the negligent driver.
