On December 2, 2018, our client was walking in the Hollywood Casino parking garage just outside of Toledo when she was struck by a negligent driver. The accident occurred while our client was standing behind her own vehicle and the defendant was parked across the aisle. As the defendant reversed her vehicle, she slammed into our client. As a result, our client was thrown against another vehicle and violently struck her head, causing her to lose consciousness.
Our client was quickly transported to the Bay Park Hospital Emergency Department nearby to treat her serious injuries. These injuries included facial lacerations, whiplash, and a serious concussion, as well as injuries to her elbow, knee, neck, and back.
Approximating Damages of a Car Accident Claim
Our client has incurred significant medical bills and continues to endure pain and suffering and physical limitations as a result of the accident. The defendant’s actions constitute negligence per se as she failed to operate her vehicle in a safe manner in accordance with Ohio traffic laws and failed to exercise due care to avoid hitting pedestrians.
As a direct result of this negligence, our client has suffered permanent personal injuries and related economic damages. It is expected that our client will require future medical care and costs and will continue to endure great pain and suffering, emotional distress, and mental anguish.
Our client’s claim asks the defendant motorist to be found responsible for her negligence and is seeking judgement in excess of $25,00, in addition to any other relief that the court deems just.
