Injured Motorist Sues Multiple Parties for Failure to Yield Accident

On March 5, 2020, our client was traveling on Washington Street in Toledo, Ohio, when she approached an intersection. While attempting to cross at a green light, a negligent motorist ran a red light, colliding with our client’s vehicle.

Following the collision, our client was transported to the emergency room at St. Vincent’s Medical Center to receive treatment for injuries to her knees, neck, and chest. We also discovered the at-fault driver did not have adequate insurance coverage to compensate our client. Consequently, we are pursuing a claim against our client’s insurance company and the negligent driver.

Damages Sought from the Negligent Motorist

The negligent motorist owed a duty of care to everyone else on the road to follow state and local laws. However, she violated this duty when she ran a red light, demonstrating a failure to yield the right-of-way. As a result of this negligence, our client suffered significant injuries that required extensive medical treatment.

In addition to hospital bills, medical costs, and lost wages, our client also incurred non-economic damages. This includes pain and suffering, mental anguish, and emotional distress. Additionally, our client believes that her injuries will require future medical treatment, affecting her for the rest of her life. On behalf of our client, we are seeking compensation from the at-fault driver to address her losses.

Seeking Damages from State Farm Mutual Automobile Insurance Company

At the time of the car accident, the negligent driver did not have an insurance policy that sufficiently covered our client’s damages. As our client has uninsured/underinsured motorist coverage through State Farm Mutual Automobile Insurance Company, we are asking the court to issue a declaratory judgment in favor of our client regarding her insurance claim. We hope the compensation from State Farm will cover the difference in the negligent driver’s coverage and the value of our client’s damages.
