Injured Motorist Sues Multiple Parties for Damages Caused by Wood County Accident

On the evening of July 16, 2019, our client was traveling on Curtice Road in Wood County, Ohio. As our client was lawfully operating her car, a negligent motorist failed to yield the right-of-way when attempting to make a left turn. As a result, the other driver’s vehicle collided with our client’s car. Following the accident, the Northwood Police Department arrived on the scene and cited the negligent driver for failing to yield the right-of-way. Our client received medical treatment at the Bay Park Hospital for injuries sustained during the accident.

Damages Sought from the Negligent Motorist

The negligent motorist owed a duty of care to operate her vehicle in accordance with the laws of the State of Ohio and other traffic laws established by local officials. However, she violated this duty when she failed to yield the right-of-way. As a result of the collision, our client suffered significant injuries to her neck, back, head, and other areas.

The medical care required to treat these injuries caused our client to suffer economic damages, including lost wages and hospital bills. Additionally, she has experienced pain, suffering, and mental anguish. Our client believes her injuries are permanent and will require future medical attention, resulting in further damages. As a result of these losses, we are seeking a damages award in favor of our client.

Relief Sought from Erie Insurance

The negligent motorist’s insurance policy does not cover all the damages our client has sustained. Thus, our client is also seeking relief from Erie Insurance through her uninsured and underinsured motorist coverage. On behalf of our client, we are asking Erie Insurance to adhere to its obligations under the policy issued and pay damages in excess of the negligent driver’s liability coverage.
