Employee Injured in Crash Files Suit Seeking Workers’ Compensation

On April 22, 2019, an emergency medical technician of Seneca County, Ohio was working in an ambulance when the vehicle was hit by another car, causing an accident. Our client was attending to a patient in the back of the ambulance when another vehicle made an illegal turn in front of the medical technicians and struck the front left side of the ambulance. To avoid further collision, the ambulance swerved, causing it to run over a curb, smash through a utility pole, and strike a building.

During this collision, the plaintiff was violently thrown across the ambulance, and an oxygen canister struck his head. The plaintiff reported immediate pain in his left shoulder, ribs, neck, head, and face and was transported to Blanchard Valley Hospital for medical treatment.

Filing an Ohio Workers’ Compensation Claim

The Ohio Bureau of Workers’ Compensation was notified of our client’s work-related accident shortly after. The plaintiff filed a claim seeking compensation for the multitude of injuries the accident had caused.

Our client later filed a C-86 Motion for additional allowances due to a cerebral concussion that he incurred. Yet his employer, Blanchard Valley Health System, rejected his request, so the Ohio Bureau of Workers’ Compensation referred him to the Industrial Commission of Ohio for a hearing. Our client’s motion was granted because it was determined that his cerebral concussion was a direct and proximate result of his work accident, but his employer continues its attempts to dispute the claim.

Seeking Workers’ Compensation

Our client is ultimately seeking a determination of his eligibility to continue to participate in the Workers’ Compensation Fund as a result of his injury that occurred within the scope of his employment, as well as an allowance for his cerebral concussion.
