Driver Sues for Injuries Sustained in a Failure to Yield Collision

On August 27, 2020, our client was traveling southbound on Auburn Avenue in Toledo, Lucas County, Ohio, when a negligent driver traveling northbound made a left turn in front of her. This motorist’s failure to yield caused the front driver’s side of our client’s car to collide with the front passenger side of her vehicle. At the scene of the accident, the Toledo Police Department cited the at-fault driver for a “right-of-way when turning left” violation.

At Charles E. Boyk Law Offices, we believe no one should have to suffer at the hands of a careless driver. So, we are pursuing a claim against the other motorist for all damages resulting from the crash.

Assigning Liability

The defendant had a duty of care to follow state and city traffic laws while operating her vehicle, as do all drivers. Her failure to yield to the right of way is considered a breach of that duty of care. Additionally, the traffic citation the defendant received constituted negligence per se. As the other driver is solely responsible for the wreck, we are seeking compensation from her on behalf of our client.

Assessing Our Client’s Damages

The defendant’s reckless actions caused our client to sustain serious injuries, including damage to her back, right leg, right knee, left leg, left knee, and right shoulder. Because of these injuries, she incurred financial losses due to her necessary medical treatment. Not only has our client suffered physical pain and economic loss, but she has experienced emotional distress as well.

Unfortunately, our client believes her injuries are permanent, meaning she will continue to incur economic and non-economic damages. Consequently, we are fighting for compensation that will cover all her current and future needs.
