Boyk Seeks Compensation for Client Injured in Swanton, Ohio Automobile Collision

On that day, our client was driving eastbound on Airport Highway in Swanton. At the same time, the defendant, who was operating a vehicle owned by Lapoint Auto Sales, drove his vehicle from a private drive located to the left of Mr. Mosher’s path of travel and struck the front passenger’s side of our client’s vehicle. The defendant owed our client a duty of care to adhere to the traffic laws of Ohio and the City of Swanton not to operate the vehicle in a way that could cause an accident and subsequent injury to the plaintiff.
Damages Resulting from a Car Collision
As a direct and proximate result of the defendant’s negligence and breach of his duty of care, our client sustained serious personal injuries including, but not limited to, his neck, right shoulder, and right wrist.
Lapoint Auto Sales was the titled owner of the vehicle the defendant was operating. Since it was found that the defendant was driving while under the influence of drugs when he struck our client’s car, we are also asserting a claim against Lapoint Auto Sales because it owed a duty of care not to negligently entrust its vehicle to an inexperienced, reckless, incompetent, or dangerous driver.
We allege that Lapoint Auto Sales knew or reasonably should have known that the defendant was a dangerous driver and that by negligently entrusting its vehicle to him, Lapoint directly and proximately caused the collision described herein. As a result of this negligence, plaintiff Mosher sustained serious personal injuries that he is seeking compensation for with the help of Charles E. Boyk.
