$370,000 Settlement – Man Suffers Hearing Loss and Herniated Disc in Auto Collision

In 2017, our client sustained numerous serious injuries when he was involved in a motor vehicle accident. The defendant driver was stopped at a stop sign when he failed to notice our client approaching and pulled out in front of our client, causing a collision between the two vehicles. Due to the impact of the collision, the airbags in our client’s car deployed and he hit his head. Our client was transported to an area hospital in order to treat his injuries.

At the hospital, our client was diagnosed with injuries to his lower back, neck, and knee. Upon his discharge from the hospital, he followed up with an orthopedic surgeon. After a series of tests, our client was diagnosed with a herniated disc and severe narrowing of the spine. In an attempt to avoid an invasive surgical procedure, our client underwent a series of steroid injections. However, the injections failed to mitigate his pain and our client was subsequently required to undergo a surgical decompression procedure. While after the surgery our client showed initial improvement, he soon began experiencing pain and abnormal sensations that caused numbness in his back and leg. He was then required to undergo yet another surgical decompression procedure. After this second invasive intervention, our client’s surgical wound became infected. This complication required debridement and the need for a wound vac. Five months after this second surgery, our client’s wound still was not considered healed.

Our client also suffered hearing loss as a direct result of the accident, beginning the day after the accident. When his hearing difficulties did not improve a week after the accident, our client sought additional medical treatment. He was diagnosed with hearing loss and tinnitus in his right ear and restricted hearing in his left ear. Due to the hearing loss, he was required to undergo a surgical procedure in which his surgeon made an incision in his eardrum to relieve the pressure in his ear. While the procedure was successful, our client never fully regained his hearing.

Our firm was retained to assist our client in his recovery and our team worked tirelessly to ensure that our client got the recovery he deserved. Initially, we filed suit in the Common Pleas Court of Lucas County, but we were successful in avoiding trial as we were able to obtain a large settlement from the defendant’s auto insurance policy. The settlement we were able to secure for our client will go a long way to account for his pain and suffering and will ensure that he can receive the necessary medical treatments he will now require in the future.
