$195,000 Settlement – Man Partially Severs Leg in Sawmill Accident

In 2012, our client sustained serious injuries when he was involved in an accident at the home of his boss. The defendant was the owner of the golf club where our client worked and had requested that our client stop at his farm on his way home from work to assist him with a sawmill that was not working correctly. When our client arrived, he was led to the sawmill where the defendant stood at the controls and our client stood at the bed of the sawmill, inspecting the engine. Without warning, the saw head and blade were turned on, and while our client tried to quickly get out of the way he was unable to move quickly enough. The blade caught our client’s leg, severing the nerves, muscle, and bones of his lower left leg. Our client was quickly transported by ambulance to a nearby hospital to treat his injuries.

At the hospital, it was determined that the sawmill had caused extensive damage to our client’s leg and that he was suffering from fractures of his tibia and fibula bones as well as tears to the tendons in his leg. Our client was required to undergo extensive emergency orthopedic surgery to stabilize his leg. He was admitted to the hospital for the next four days until he was stable enough to continue his recovery at home. Due to the nature of his injury, our client was unable to bear weight on his leg for an extended period of time. Our client was eventually cleared to begin physical therapy to begin rehabilitating and strengthening his injury.

A year after the accident our client was required to undergo a revision surgery for his leg fracture. While the surgery was successful, one of his follow up appointments revealed that our client contracted a staph infection in the surgical incision which required additional appointments with infectious disease specialists and several months of antibiotics.

We initially filed suit in court on behalf of our client, however, due to a successful negotiation we avoided the need for trial as we obtained a satisfactory settlement for our client. The settlement we were able to obtain for our client will go a long way to account for the injuries and trauma he sustained in this horrific accident.
