$120,000 Settlement – 20-Year-Old Man Ejected from Car Suffers Collapsed Lung and Multiple Fractures When Driver Loses Control of Vehicle

In January 2014, our 20-year-old client was a passenger in a vehicle being operated by the defendant. Our client and the defendant were traveling southbound on I-71 near Delaware, Ohio when the defendant lost control of the vehicle while traveling 75 miles per hour. Unable to regain control of the vehicle, the defendant crashed into the center median, at which point the car flipped over and landed on a nearby guardrail. Due to the impact, our client was ejected from the car, crashing through the window. Emergency medical services transported our client to Grant Medical Center to treat his injuries.

At the hospital, our client was diagnosed with a collapsed lung, multiple fractured ribs, a fractured clavicle, a fractured scapula, concussion, and deep scalp laceration. He remained in the hospital for the next five days before he was able to go home. Once discharged from the hospital, our client required six weeks of intense physical therapy in order to continue to heal from his injuries.

Prior to the accident, our client was a young and healthy man. As a result of this traumatic accident, he experiences continued pain, decreased mobility throughout his body, and severe facial scars. Along with the permanent nature of his injuries, our client also incurred a substantial amount of medical bills that he otherwise would not have incurred. He will also likely require future surgeries to further treat his injuries. Also, due to the significant amount of trauma to his scapula and clavicle our client is now at an extremely high risk for developing degenerative disease in his lumbar spine that would lead to more pain and functional limitations for him.
