$100,000 Settlement – Ohio Woman Injured in Auto Accident in Kansas

In 2013, our client, a resident of Ohio, had been in Kansas visiting her daughter when she was involved in a motor vehicle accident. Our client’s daughter was driving when the defendant driver failed to yield at an intersection, striking her daughter’s car head-on. The impact of the accident knocked our client unconscious. Our client was transported by ambulance to a nearby hospital to assess her injuries. Kansas Highway Patrol responded to the scene and after an investigation cited the defendant for causing the accident.
At the hospital, our client was found to have sustained a concussion and injuries to her shoulder, arm, wrist, and neck. Fortunately, her injuries were not life-threatening, and she was able to be discharged from the hospital with instructions to follow up with her primary doctor. Upon follow up with her physician, our client’s doctor conducted more tests and instructed her to begin physical therapy. Our client began physical therapy, but the pain in her shoulder did not subside. She returned to her physician and he recommended that she seek treatment from an orthopedic surgeon. Our client’s orthopedic surgeon then performed more tests and concluded that she needed to undergo surgery to repair her shoulder injury. During the surgery, the full extent of our client’s shoulder injury was revealed, and it was found that she had been suffering from a complete rupture of her rotator cuff. Even though the surgery was successful, our client still dealt with continued pain.
Prior to the accident our client was in great physical condition and had just started a new job. However, after the accident, our client had great difficulty doing tasks and activities that she was once able to do with ease. She also unfortunately lost her job due to her new company being unable to accommodate the time off she needed to heal from her injuries and the surgery.
Our client contacted us to for assistance in her recovery shortly after the accident occurred. We completely avoided the need for litigation due to a successful negotiation, and we obtained a policy limits settlement for our client that will go a long way to assist her in her recovery and account for the medical expenses she has incurred.
