In 2016, our client was traveling northbound on Byrne Road in Toledo, Ohio, when he was involved in an automobile accident. As our client was driving down the road, the defendant driver failed to yield the right of way to oncoming traffic while attempting to make a left-hand turn and collided with our client. Our client was transported from the scene of the accident by ambulance to a nearby hospital to treat his injuries. At the hospital, it was determined that he had sustained a severe fracture to his left leg. The defendant was found to be at-fault and was issued a citation for failure to yield.
Not only did our client have to undergo a painful surgery to repair his broken femur, but he also required months of physical therapy and then suffered related complications that severely impacted him and his independence. Prior to the accident, our client was a very active 78-year-old man, who still worked part time at a local grocery store. Since he was unable to bear any weight on his injured leg after the accident, he was unable to go to work, something he took pride in and enjoyed doing. He also was unable to do day-to-day activities and was forced to rely on his daughter more than he ever had prior to the accident.
Due to a successful negotiation, we avoided the need for our client to ever set foot in a courtroom as we obtained a satisfactory settlement for him. The amount we were able to obtain for our client against the defendant from the defendant’s liability insurance policy was not enough to adequately compensate our for the extent of his injuries. Luckily, our client was covered under an underinsured motorist policy and we were able to add value to his recovery by obtaining an additional settlement under that policy.
