In 2015, our client sustained numerous injuries in a motor vehicle accident. As she was traveling along Hill Avenue in Toledo, Ohio, she proceeded through an intersection as she had a green light to do so. As our client was moving through the intersection, the defendant driver failed to yield when she was attempting to make a left turn, colliding with our client at 45 miles per hour. Our client was taken by emergency medical services to The University of Toledo Medical Center to treat her injuries.

At the hospital, our client was found to have sustained a fracture to her knee and a concussion. She also was experiencing severe back and shoulder pain. Our client was admitted to the hospital, and the following day she underwent a surgical procedure to repair the injury to her knee. To fix her knee, our client’s surgeon was required to place a plate and seven screws in her knee. Upon discharge from the hospital, our client began physical therapy to regain her strength and mobility. As a single and working mother, our client’s injuries severely impacted her life. She was unable to work for over a year, and it was difficult for her to be the active mother she once was due to her inability to bear weight on her knee for a significant period of time. Even as our client’s injuries healed, she still experienced severe continued pain that made it difficult for her to do tasks she once completed with ease. Nearly a year and a half after the accident, still dealing with pain, our client was required to undergo an additional surgery to remove the metal hardware from her knee and it was also necessary for her surgeon to perform a fat pad debridement of her knee at that time.

In 2015, our client, a resident of Lucas County, was a passenger in a car that was traveling in Lambertville, Michigan when he was involved in a motor vehicle accident. The defendant driver was working and driving a company van when he pulled out in front of the car our client was a passenger in, causing a head on collision. Our client and the other passengers of the vehicle were all transported by emergency medical services to an area hospital to treat their injuries. Upon an investigation, the defendant was found to be at fault for the accident and was appropriately cited.

At the hospital, doctors diagnosed our client with a fracture to his left leg as well as a spinal fracture. He was admitted to the surgical intensive care unit and subsequently underwent a surgical operation that required screws to be placed in his spine to repair the injury. Upon his discharge from the hospital, he spent a week in an inpatient rehabilitation facility regaining his strength. As a result of this accident, our client suffered from severe continued pain due to the injuries he sustained. He also was required to undergo an additional painful surgery to remove the screws that had been placed in his spine.

Although this accident occurred just over the Ohio-Michigan border in Lambertville, Michigan, both our client and the defendant were residents of Ohio. This required our team to decide which state’s laws applied, which was critical for evaluating theories for our client’s recovery. Our team of attorneys conducted thorough and careful research, ultimately deciding that Ohio law was applicable in this case. Through negotiations, we were successful in avoiding trial and obtained a satisfactory settlement for our client.

In July 2016, our 48-year-old client was attending an event at the SeaGate Convention Center in downtown Toledo, Ohio when she slipped on clear liquid and fell to the ground. Landing hard on her left knee. Although the people working at the SeaGate Center during the event admitted that they had known about the spill, no warning signs or cones had been placed to alert attendees of the danger, and the area had not been blocked off in any way to prevent pedestrian traffic through the area.

Our client’s left knee was particularly vulnerable as she already had a history of problems with it. An ambulance took her immediately from the convention center to the emergency room, where x-rays revealed that she had suffered a complex fracture to her left kneecap. After an initial period of immobilization and instructions not to bear weight on her knee, our client was able to begin physical therapy. Unfortunately, she continued to have serious swelling throughout therapy and experienced a clicking sensation in her knee and other difficulties with activities. Our client was also required to be off work for an extended period of time due to her injury, and this created a serious financial burden on her due to lack of income. It was a long road to recovery and our client never reached the baseline she was at prior to her slip and fall. Eventually, she was diagnosed with chondromalacia of her patella and had to undergo an arthroscopy – a surgical procedure to investigate the potential causes of her pain.

Due to her injuries from slipping on a spill that the convention center was aware of, our client experienced permanent changes to her life. She lives with ongoing pain, stiffness, and swelling and is no longer to engage in the same work or recreational activities she enjoyed before her injury. This took a very serious emotional toll on our client, leaving her feeling disappointed and depressed on many days.

In our negotiations with the insurance company, they were unwilling to offer a fair settlement value for our client’s injury. Because of this, we filed a lawsuit against numerous parties including the owners of the building, the company that leased it, and the company that was hosting the event our client attended. By actively pursuing a case in court, we were able to secure a significantly higher settlement for our client – almost four times the initial offer. This allowed our client to achieve a substantial recovery as she works to close this terrible chapter in her life.

In the Spring of 2018, our client was traveling on a county road in Sandusky County, Ohio when they were rear-ended by motorist. The force of the impact propelled our client’s vehicle into a nearby ditch. As can be imagined, our client suffered serious injury, including: a concussion, neck and rib pain, back pain, cervicalgia, hyperreflexia, post-concussion syndrome, and various others. Particularly troublesome, our client was the owner and operator of a successful small business. Because of these injuries, our client was unable to return to work in a normal capacity, and their business suffered from the absence.

Somewhat unique to our client’s position, their damages exceeded the policy amount of the at-fault party’s insurance. Because of this, our attorneys pursued a claim against the underinsured insurance carrier to recover an amount that would cover all of our client’s damages. Successful in doing so, our attorneys recovered an additional $175,000 that assists our client in bringing normalcy to their life.

In 2015, our client was driving along Reynolds Road in Toledo, Ohio when she was involved in a multi-vehicle car accident. As our client was approaching an intersection, she properly slowed with the flow of traffic. The defendant driver, however, had dropped a water bottle and had bent down to retrieve it from the floorboard of his car. Failing to see our client stop, the defendant rear-ended our client’s car. The impact of this collision sent our client’s car forward, into the car in front of her. The defendant was found to be at-fault for causing the accident and was issued a citation for failure to control and inattention.

Our client did not seek treatment immediately following the accident. However, as time went on and she continued to experience arm and neck pain, she sought medical treatment. Upon assessment, doctors discovered that our client had sustained a concussion and was suffering from whiplash as a direct result of the accident. In order to treat these injuries, our client began physical therapy and was referred to a pain management clinic. Unfortunately, these non-invasive medical treatments failed to reduce her pain and she was therefore required to undergo an invasive and painful surgical procedure. After the surgery, our client began physical therapy to rehabilitate the injury. Despite the surgical intervention and many treatment options our client pursued, she still suffered from severe continued pain.

As our client was driving on I-475 she was involved in an auto accident that resulted in serious injuries. The defendant had been pulled off the side of the road assisting her daughter, whose vehicle had broken down. As the defendant attempted to re-enter the flow of traffic, she pulled out in front of our client’s car, resulting in a significant collision between the two vehicles. Our client appeared to have a seizure at the scene of the collision and was transferred by emergency medical services to a nearby hospital to have her injuries evaluated. After an investigation, it was determined that the defendant was at fault for the accident, and she was cited for failure to yield.

At the hospital, our client was diagnosed with a severe concussion, a mild traumatic brain injury, and bulging discs, and there was also a concern that she may be suffering from seizures. She was admitted to the hospital, where she remained for four days. She was discharged from the hospital and subsequently admitted into an inpatient rehabilitation center, where she remained for two weeks. Once home, our client continued to suffer extensively from chronic pain, headaches, stuttering, dizziness, stress, and anxiety. Our client also suffered from anxiety, depression, cognitive deficits, and her physical capabilities were severely limited due to the accident.

While this accident took a huge physical and mental toll on our client, it also had a significant impact on the lives of her husband and two young children. Due to the injuries she sustained, our client has been unable to take part in the activities that the family once enjoyed doing together.

In 2011, our client sustained several injuries when she was involved in a multi-vehicle accident. Our client was struck by a car that was spinning out of control, and the impact then caused our client’s vehicle to travel across several lanes of traffic and to collide with another car. The force from the multiple collisions caused our client to lose consciousness. She was transported via ambulance to Toledo Hospital, where she was admitted to the Neurological Intensive Care Unit to treat her injuries. Our client was found to have suffered from a traumatic brain injury, a large scalp laceration that required 15 staples, and a contusion to her right ear. She remained in the hospital for monitoring for the next five days.

Once our client was stable enough to be discharged from the hospital, she was admitted to an inpatient rehabilitation facility for four days as she was suffering from cognitive deficits because of her brain injury. At the rehab facility, our client was required to undergo speech and physical therapy in efforts to rehabilitate her injuries. Once our client was discharged to go home, she still required extensive rehabilitation and continued to suffer from headaches, memory problems, and dizziness.

In 2014, while our client was driving in Fostoria, Ohio, his car was struck by the defendant’s car head on when the defendant failed to yield right of way to our client. After an investigation, the defendant was found to be at fault for the accident and was cited. Our client was transported to an area hospital to assess his injuries.

At the hospital, our client expressed complaints of right shoulder, elbow, and wrist pain as well as neck pain and numbness. He was discharged from the hospital and instructed to follow up with a local doctor. Upon a follow up, his doctors recommended that our client begin physical therapy to help with the wrist and neck pain he was experiencing. Unfortunately, the physical therapy failed to relieve our client’s pain and he was referred to an orthopedic surgeon and neurologist to further evaluate his injuries. It was determined that our client was suffering from a pinched nerve in his spine. In attempts to reduce his pain, our client required two sets of painful nerve root block injections. However, these injections failed to bring him any relief. It was then decided that he would need to under a surgical operation to repair his injury. While the initial surgery went well, our client faced a series of complications because of the surgery. The surgical site became infected, and a fall resulted in further pain for our client. As a result, our client still continues to experience substantial pain in his neck, shoulder, and arms.

Our services were retained shortly after the accident occurred and we filed suit in the Hancock County Common Pleas Court on behalf of our client. Due to a successful negotiation, we avoided the need for trial and obtained a satisfactory settlement for our client. In February 2019, our client was invited to a friend’s home to enjoy an evening of watching movies. This friend, the defendant, also extended her invitation to our client’s dog. As soon as our client and her dog entered the defendant’s home that evening, one of the defendant’s dogs lunged at our client’s dog and began viciously attacking her. Terrified at the sight of her dog being mauled, our client jumped into action in attempt to break up the fight. As she attempted to separate the two dogs, one of the defendant’s other dogs began attacking our client, biting her face and legs. When the dogs were finally separated from our client and her dog, she realized the extent of the injuries to her and her beloved dogs. The vicious attack, which occurred mere months before our client’s wedding, resulted in gaping wounds to our client’s face and legs, injuries that were severe and permanent both physically and psychologically. Our client’s dog also suffered extensive physical injuries, adding to our client’s emotional trauma.

Though our client’s initial physical injuries have healed, she is left with permanent scarring that she must look at daily as a constant reminder of the horrific dog bite attack. Her injuries went beyond the physical injuries she sustained, as she continues to suffer from the psychological trauma of the incident. She suffers from post-traumatic stress disorder causing her to have panic attacks around dogs resembling pit bulls, and she now fears taking walks, hearing barking, and seeing dogs that resemble the defendant’s dogs.

Our office originally filed suit in Lucas County for claims of strict liability and negligence. Luckily, due to a successful negotiation we obtained a settlement for our client without her ever needing to set foot in a courtroom for trial. While no amount of money can undo the physical and psychological trauma our client has endured, she received a fair settlement that will allow for her to continue to recover and heal from the traumatic incident.

In January 2014, our client was driving northbound on Monroe Street through the intersection of Collingwood. As he drove through the intersection, another driver ran a red light, causing a collision with our client. Emergency medical services took our client from the scene to a nearby hospital to assess his injuries. After an investigation, the defendant was found to be at fault for the accident and was cited.

At the hospital, our client was diagnosed with a fractured leg and knee injury. He was discharged from the hospital and instructed to follow up with an orthopedic surgeon. After examining his injury, an orthopedic surgeon determined that surgical intervention was necessary to correct the fracture. Two days later, our client underwent a painful surgery to repair the injury, which required the placement of surgical screws in his leg. Following surgery, our client was unable to put any weight on his injured leg for nearly four months, which caused him to become extremely dependent on his girlfriend. He also required months of physical therapy to aid his recovery, and even as the injury healed, he suffered from constant pain and swelling in his leg and knee.

While there is never a “good” time to be involved in a car accident, this accident could not have come at a worse time for our client. He had just relocated from Florida to Toledo, Ohio to take a new job as an economist for a local company. The job presented a huge opportunity for our client, as the position included a leadership role within the company. The accident, injury, and many appointments that our client had to deal with required him to take time off work and work from home for a long period of time. Due to having to work remotely, his talents were not fully realized.

Prior to this accident, our client was a young and active individual who took joy in playing sports. He was also a runner and competed frequently in 10k races. However, as a result of his injury, his surgeon stated that he will never be able to run or participate in strenuous physical activity again, and that the injury he sustained is permanent. He will also require future surgeries that will cause him pain and additional medical expenses.
