$95,000 Settlement – Man Sustains Broken Arm in Motorcycle Accident

In July 2017, our client sustained several injuries when in was involved in a motor vehicle accident. Our client was at traveling eastbound on Kibby Street in Lima, Ohio, and approaching an intersection, when the defendant driver failed to yield to our client, turning in front of him and causing a collision. Our client, who was riding his motorcycle, tried to avoid the collision, however, was unable to. Our client went to a nearby hospital for treatment and was admitted overnight for observation.

Our client was found to have sustained road rash to his arm and shoulder, numerous lacerations to his hands, and broken bones in his arm and hand resulting in the need for his left arm to be placed in a cast. Due to his arm being placed in a cast, our client was off work for four months which resulted in a significant financial strain on our client.

$93,000 Settlement – 14-Year-Old Hit by Car While Riding Skateboard

In 2015, our young client sustained serious injuries when he was hit by a car. Our client was riding his skateboard along the side of the road, with the flow of traffic, when the defendant driver struck him with her passenger side mirror. The impact caused our client to be thrown forward, lose consciousness, and be thrown to the side of the road.

At the hospital, our client was found to have sustained a traumatic brain injury, concussion, and a brain bleed. While our client’s injuries were substantial, luckily they were non-life threatening and he was able to be discharged from the hospital the day after the accident, with instructions to follow up with a neurosurgeon. $90,000 Settlement – Man Suffers Fractured Sternum and Spinal Cord Injury in Auto Accident

In 2015, our client was traveling eastbound on U.S. 20 in Sylvania, Ohio, when he was involved in an automobile accident. As our client approached the intersection of U.S. 20 and the Interstate 475 entrance ramp, the defendant driver failed to yield the right of way to oncoming traffic while attempting to make a left turn onto the ramp, colliding with our client. Our client was transported from the scene of the accident by ambulance to a nearby hospital to treat his injuries. The defendant was found to be at-fault and was issued a citation by the Sylvania Police Department.

At the hospital, our client was found to have sustained a compression fracture to his spinal cord as well as a fractured sternum. These injuries not only caused our client a great amount of pain, but also created complications for the ongoing health conditions our client already suffered from. Prior to the accident, he was able to manage these medical issues and live independently without assistance. $90,000 Settlement – Woman Transporting Shelter Dogs Injured When Semi-Truck Rear Ends Her Bus

In 2017, our client sustained numerous injuries as a result of a motor vehicle accident. As our client was traveling eastbound on U.S. 30 in Hancock County, Ohio, the defendant semi-truck driver rear ended our client. The impact of the collision caused our client’s bus to travel off the road and roll over several times. The Ohio State Highway Patrol responded to the scene and issued the defendant a citation for failing to maintain assured clear distance. Our client was transported by emergency medical services to an area hospital to treat her injuries.
At the hospital, our client was found to have sustained injury to her head, arms, back, and neck, and she was found to have suffered cervical and thoracic disc bulges. These injuries seriously impaired her mobility and caused her to have weakness in her extremities, dizziness, and ongoing headaches. Not only did our client suffer the pain of numerous physical injuries, but she also sustained substantial monetary and emotional losses. At the time of the accident, our client had been driving a bus full of dogs, transporting them from the no-kill animal shelter she volunteered at. The van was carrying a variety of animal supplies, personal items, as well as 16 dogs. $90,000 Settlement – Woman Suffers Torn Shoulder Tendons in Workplace Injury

In 2012, our client was working as an assembler at a manufacturing plant in Forest, Ohio, when she sustained serious physical injuries. On the day of this accident, she was working to take apart a fixture on a press operating machine when she felt something pop in her right shoulder. Following this incident our client believed she had just pulled a muscle, but her neck, arm, and shoulder all began to swell and turn purple. This prompted our client to seek medical treatment. $90,000 Settlement – Elderly Woman Sustains Sternal Fracture In Auto Accident

In July 2019, our 79-year-old client sustained several injuries when she was involved in an automobile accident. As our client was traveling southbound on Byrne Road in Toledo, Ohio, the defendant driver was attempting to turn left onto the intersecting road when she pulled out in front of our client causing a collision. $90,000 Settlement – Eight-Year-Old Girl Sustains Internal Trauma and Fractured Clavicle in Auto Accident

In June 2014, our client was riding in her father’s truck traveling eastbound on Mermill Road in Portage, Ohio, when they were involved in a motor vehicle accident. The defendant driver failed to stop at a posted stop sign, causing a collision with the family’s truck. Our client was taken by ambulance to Wood County Hospital to treat her injuries. The defendant was issued a citation and found to be at fault for causing the accident.

At the hospital, doctors determined that our client had suffered trauma to her abdomen, a fractured clavicle, and several contusions. She was transferred to Toledo Children’s Hospital, where she underwent a surgical repair of her bowel and treatment for her other injuries. Our client then remained in the hospital for four days to continue healing. As a result of the accident and her injuries, our client suffered from severe continued pain, immobility, and weakness.

30-Year-Old Woman Suffers Serious Neck Injury in Rear-End Collision with Uninsured Driver

Our client was 30 years old, driving for her job with a railroad company, when she stopped for traffic in a busy part of town. An uninsured man who was driving behind her failed to stop in time and struck our client, causing a significant impact. Our client immediately went to the emergency room with neck pain. She underwent physical therapy and chiropractic treatment for months without experiencing significant improvement in her pain, and she continued to experience discomfort related to a popping in her neck even a year after the collision occurred. Unfortunately for our client, in addition to the ongoing pain she suffered after being struck by an uninsured driver, she was also off work for approximately a year and a half because with her occupation, the physicians could not release her to work until her condition had substantially improved.

Because our client was struck by an uninsured driver, we got to work right away to pursue a claim with her own uninsured motorist coverage under her personal auto insurance policy. Initially, the insurance company denied coverage. It claimed that because she was on the job at the time of the collision, itdid not have to cover her for her injuries. By researching the issue thoroughly and presenting arguments in favor of our client, we were able to persuade the insurance company that its initial assessment was wrong. It agreed to cover our client and offered the policy limits of $100,000.00 to settle her uninsured motorist claim.

Unfortunately, the hurdles to a good result did not stop after the policy limits offer. Our client’s employer claimed that it was entitled to a huge portion of her settlement that would have essentially left her with nothing. When attempts to negotiate with the employer went nowhere, we filed a lawsuit on our client’s behalf naming the uninsured driver, our client’s uninsured motorist carrier, and the entities that were claiming they were entitled to compensation out of her settlement. By forcing the issue by suing the parties claiming subrogation rights, digging deep into Ohio law, and strongly advocating on our client’s behalf, we were eventually able to negotiate a settlement that put our client in a substantially better position than she would have been if no one had been willing to take on the subrogation battle.

$85,000 Settlement – Woman Suffers Ruptured Discs Due to Motor Vehicle Accident

When our client slowed for traffic as she was driving along U.S. 224 in Hancock County, Ohio, the defendant driver who was traveling behind our client was unable to stop and struck the rear of our client’s vehicle. Immediately following the accident, our client was transported to a nearby hospital to assess her injuries. After an investigation, the defendant was found to be at-fault for causing the accident and was cited for failing to maintain assured clear distance and speeding.

At the hospital, our client told doctors that she was experiencing neck and back pain and after a series of tests, she was diagnosed with acute myofascial strain, lumbar strain, and a contusion to the lumbar area. Our client was treated for her injuries and discharged from the hospital with the instructions to follow up with her primary care provider. At the follow up, our client’s physician instructed her to begin physical therapy to assist her recovery. Our client began physical therapy, but the treatment did not bring her relief and she continued to experience significant pain in her back. Due to the lack of progress, her physical therapist ordered an MRI, which revealed that our client was suffering from two levels of ruptured discs in her back. It was her doctor’s belief that these injuries were a direct result of the accident. It was then recommended that she undergo surgical intervention to treat the injuries and she subsequently underwent a microdiscectomy and a spinal fusion.

We were contacted by our client shortly after the accident to assist her in her recovery. Due to a successful negotiation, we obtained a satisfactory settlement for our client and avoided the need for her to go through a stressful trial.

Man Suffers Serious Shoulder Injury When Rear-Ended By Negligent Driver

Our client was 36-years-old with a history of prior shoulder problems when he was rear-ended by a negligent driver in downtown Toledo, Ohio. After giving our client his insurance information, the other driver left the scene before police could be called. Our client went directly to the emergency room for treatment and then followed up by reporting the incident to police.

Although wearing his seatbelt at the time of the rear-end collision, our client was violently jolted in his seat as a result of the impact from the other vehicle. Immediately after the crash, he suffered a headache, shoulder pain, neck pain, and lower back pain. He was diagnosed with numerous conditions at the emergency room, including reflex sympathetic dystrophy of his left arm and shoulder. Our client had to undergo aggressive physical therapy and later aquatic therapy, but these failed to provide him with relief. An MRI eventually revealed swelling over our client’s humeral head and in other areas around his shoulder. Having found not relief from therapy, our client followed up at the University of Toledo Medical Center, where he was finally diagnosed with a rotator cuff injury. He continued to treat with a pain management doctor due to ongoing excruciating pain that significantly limited his ability to carry on normal daily activities. Through pain management injections, our client was able to find some relief. Unfortunately, the type of injections performed posed additional significant health risks such that our client eventually chose to live with constant pain rather than risk injury to his carotid artery.

Our client was a physically fit, active middle-aged man at the time of this rear-end car crash. After the collision, he experienced serious limitations in all physical activities including his ability to play with grandchildren. No longer able to perform his prior job, he depended on his wife for financial support. On some days, he was in so much pain that he was completely unable to use his left arm.

The at-fault driver’s had insurance, but the policy limits for his auto liability coverage were the state minimum of $25,000 per person. Luckily, our client had uninsured/underinsured motorist coverage under his own auto policy with a different insurance company. By pursuing a claim against our client’s own insurer in addition to the claim against the person who rear-ended him, we were able to secure an additional $65,000 for our client, bringing his total settlement to $90,000. Although our client will continue to live with pain, we were able to fight hard against all potential parties to maximize his recovery in this situation.
