Wrongful Death Case Settled Against Contra Costa County

A wrongful death lawsuit was recently settled for against Contra Costa County for $11.7 million. The case was settled on behalf of William Tindale who died as a result of a poorly maintained road. William died on August 20, 2008. He was on his way to a job at a hospital early in the morning when he pulled over to help someone whose car ran off the roadway and overturned.

The car had lost control on a curve that was covered with gravel. William was out of his vehicle on his way to help when another car ran off the road in the same spot. Mr. Tindale was killed on impact. Five days previous to this accident a woman was also killed when she lost control of her car in that construction zone.

The wrongful death lawsuit was filed by his wife, Laura, and their daughter, Erin, who was ten at the time of his death. The verdict calls for $1.5 million in economic damages and $10.2 million for emotional pain and suffering. The family was packed and ready to go on vacation in Yosemite the week of the accident.
