Apartment Complex Drowning Lawsuit Settled
Last month, a settlement was reached in a pool drowning case that involved two children. On April 23, 2012 two children ages 5 and 7 wandered away from their family’s apartment to go to the playground at the apartment complex. Their father had left to go to the gas station while their mother was making a bottle for their younger brother when they wandered off unnoticed.
The playground that the two were playing on was just a few feet from the pool. While they were playing they went over to the fence around the pool and found a hole in it and crawled through.
Both boys drowned in the pool.
The management and employees at the apartment complex denied the claim that there was a hole in the fence, but other residents testified that there were multiple holes in the fence in the months leading up to the drowning. They also testified that other children had been getting into the pool area through the hole and that the hole was so old they too had used it to get into the pool when they were younger.
This case was settled for a confidential amount but is a testament to what hard work on a lawyer’s part can do to win a case.
