Ohio worker injured on job suffers severe injury

In July of 2008, our client's employer rented a Galion Roll-O-Static roller, or "Galion roller," for use at its worksite. The Galion roller was different to the roller the employer owned, and different than the one our client was familiar with using.

Our client's supervisor instructed him to use the Galion roller to grade a slope of a hill at the worksite. The work required driving the Galion roller on the incline of the hill.

While our client was operating the Galion roller on the incline of the hill as instructed, the engine of the machine stalled, causing it to begin rolling down the hill. Unable to stop the roller, our client jumped off the machine.

The next memory our client had was waking up in the Intensive Care Unit four days later at St. Vincent Mercy Medical Center. He was told that he had a subarach hem-coma (bleeding on the brain) and FX Trimalleolaropen, (severe ankle fracture).

The ankle fracture required three surgeries as well as hardware to be placed on the anklebone. The accident also left our client with an injured right shoulder, which would "freeze up" and become immobile. He has also suffered from depression, posttraumatic stress syndrome, post-traumatic vertigo (dizziness), femoral cutaneous nerve syndrome (pinched nerves that prevent feeling in the front of the thigh), and a left knee meniscus tear from the work injury.

Neither supervisor nor the employer provided our client with an operator's manual for the Galion roller before he was instructed to operate it, nor did they provide him with any training about how to operate the roller. No safety equipment had been provided for him to wear during its operation.

The Galion roller would not stop on an incline in the event of a dead or stalled engine if the forward/reverse lever of the roller was placed in the center position, but the supervisor and employer never informed our client of this fact. They also failed to inform him that in the event the Galion roller stalled, he should engage the parking brake and/or emergency brake to stop it from rolling down an incline.

According to the complaint we filed in the Lucas County court of Common Pleas, the supervisor and the employer had knowledge that requiring our client to use the Galion roller on the hill at the worksite was a dangerous process, and that subjecting him to using the roller would cause him harm and possible injury, yet they still had him operate the machine.

It is believed that our client's injuries are permanent in nature and will require future medical care, future medical care costs, and he will continue to endure great pain, suffering, mental anguish, and emotional distress. Additionally, our client has suffered a loss of wages.
