Ohio medical malpractice damage caps | Toledo medical malpractice lawyer

No matter how unfair it may seem, under Ohio law there are some “caps” on the amount of money that a medical malpractice victim can recover. First, the good news: there is no cap on the amount of “economic damages” available to a medical malpractice victim. Economic damages compensate the victim for the quantifiable monetary losses that he or she suffered as a result of the malpractice such as medical bills, lost wages, and other “easy to add up” losses.

The bad news is that there is an absolute cap on the amount of “non-economic damages” available to the plaintiff. Non-Economic damages compensate the victim for non-quantifiable losses such as pain, suffering, and emotional distress.

The basic cap on non-economic damages is the larger of (a) $250,000 or, (b) three times economic damages (subject to a maximum of $350,000 per plaintiff and a maximum of $500,000 per malpractice occurrence). These maximum amounts increase to $500,000 per plaintiff and $1 million per occurrence if the plaintiff has suffered a permanent and substantial physical deformity, loss of use of a limb, loss of a bodily organ system, or permanent physical injury that prevents the victim from being able to independently care for self and perform life sustaining activities.

For example, let’s say that you are the unfortunate victim of medical malpractice and your economic damages (medical bills and lost wages) add up to $50,000. Because you are potentially entitled to either (1) the larger of three times your economic damages (here, $150,000) subject to a $350,000 maximum, OR (2) $250,000, in this situation your non-economic damages would be capped at $250,000.

Continuing with this example, if your economic damages were $100,000, your non-economic damages would be capped at $300,000 (three times your economic damages).

Continuing further with this example, if your economic damages were $500,000, your non-economic damages would be capped at the $350,000 maximum.

Again, it is important to keep in mind that the higher $500,000 and $1 million caps come into play if the plaintiff can meet the “permanent and substantial injury” threshold. Although these caps on non-economic damages do not apply to cases brought under the wrongful death statute, they do limit recovery by a deceased victim’s estate for non-economic damages that the decedent experienced prior to death.

For example, the amount of non-economic damages that a victim’s next of kin could recover for their own personal loss resulting from the victim’s death would not be subject to any caps if the case was filed as a “wrongful death” action. However, the amount of non-economic damages that the victim’s next of kin could recover on the victim’s behalf for the victim’s own personal pain and suffering experienced prior to death would be subject to the caps.

The economic expert then comes into play and calculates the value of those earnings over time so that the difference between the two is clearly understood by the jury.

Two students totaled their pickup truck

18-year-old Kayla G. Dingman was driving her pickup truck heading northbound when she lost control and crashed into several trees.

Dingman ended up pinned inside the truck until EMS personnel arrived on the scene.

Her passenger, 19-year-old Heather L. Norman was able to get free and called 911 to report the accident. It took almost 40 minutes to free Dingman due to the damage the vehicle had.

She sustained serious injuries and was transported by helicopter to Upstate Medical Hospital. Norman was transported to Saint Elizabeth’s Hospital for treatment for injuries that are considered not life-threatening.

Dingman was cited for failing to reduce speed for hazardous conditions and failure to keep right.

Minor children and incompetents in medical malpractice

If at the time of the actual malpractice (or discovery of the malpractice or termination of the physician-patient relationship) the victim is a minor (under eighteen), all applicable statutes of limitations are “tolled” (paused) until the minor reaches the age of eighteen. This essentially means that the one year medical malpractice statute of limitations does not begin to run until the minor victim’s eighteenth birthday. As such, the victim will have one year from his or her eighteenth birthday in which to file a lawsuit or successfully serve a 180-day letter (discussed above).

For example, say that your 16-year-old child becomes the unfortunate victim of medical malpractice when the doctor negligently repairs your child’s broken arm. Because your child was under the age of eighteen at the time of the malpractice, the statute of limitations is tolled (paused) until your child reaches his or her eighteenth birthday. It is on the date of the eighteenth birthday that your child reaches the “age of the majority,” and he or she will then have one year from that date in which to file a medical malpractice lawsuit against the doctor who negligently repaired the broken arm (or successfully serve a 180-day letter).

If at the time of the actual malpractice (or discovery of the malpractice or termination of the physician-patient relationship) the victim is legally incompetent, all applicable statutes of limitations are “tolled” (paused) until the victim becomes competent again. This essentially means that the one year medical malpractice statute of limitations does not begin to run until the date that the incompetent victim is restored to competence. As such, the victim will have one year from the date that he or she is restored to competence in which to file a lawsuit (or successfully serve a 180-day letter as discussed above).

If a malpractice victim was competent at the time of the malpractice (or discovery of the malpractice or termination of the physician-patient relationship), but later becomes incompetent within the one year limitations period, the limitations period is tolled (paused) at that time until the victim is restored to competence. Once the victim is restored to competence, the statute will begin running again right where it left off.

For example, let’s say that a 30-year-old man becomes the unfortunate victim of medical malpractice on January 1, 2012. He is then declared legally incompetent six months later on July 1, 2012. In this situation, the one year limitations period is tolled (paused) on July 1, 2012, until the man’s competence is restored. If competence is restored on January 1, 2013, the one year statute of limitations will start running again on that date, and the man will have until July 1, 2013 to file a lawsuit.

Finally, the Ohio “statute of repose” requires that any medical malpractice claim must be brought within four years of the malpractice, except that a claimant has one full year from discovery (even if this exceeds four years) for claims discovered after three years, or for claims based on a foreign object being left in the body.

In summary, calculating the proper statute of limitations can be complicated, and an error can result in serious and irreversible consequences. That is why it is so important to promptly consult a knowledgeable medical malpractice attorney at the first moment that you suspect that you or a loved one has been the victim of medical malpractice.

State Run Hospitals

Although the state of Ohio is generally immune from lawsuits, the state has waived its immunity for lawsuits against hospitals owned or operated by “political subdivisions” (i.e. state or county-owned hospitals). However, although these state facilities can be sued, they can only be sued in the Ohio Court of Claims. The Ohio Court of Claims is a court of limited jurisdiction which hears cases where the state has waived its immunity. This is somewhat advantageous for the defendant medical providers because Ohio Court of Claims cases are tried in Columbus before a judge, not a jury.

Although the law provides that claims against the state are generally subject to a two year statute of limitations, the law also provides that there is an exception if there is a shorter statute of limitations applicable in “similar suits between private parties.” Because a similar suit between private parties (i.e. a private patient and a private hospital) would be subject to the one year statute of limitations discussed above, our firm has taken the stance that we file all medical malpractice lawsuits within the one year statute of limitations (unless we choose the 180-day letter route). This is true even if the defendant is a state run hospital. You should also note that political subdivisions are completely immune from liability for punitive damages.

A Semi truck lost control on I-76

A driver of a semi-truck, loaded with large rolls of paper, lost control of the vehicle on I-76 while going around a curve. The truck flipped over and then hit guardrail. The guardrail cut through the truck's cabin, barley missing the driver.
The highway had to be shut down for a few hours to clean up the mess.
That cause of the accident remains unknown at this time. The driver was able to escape with minor injuries. The driver’s name has not been released.

Tow Truck Driver Killed

46-year-old Joseph Ricciardelli, who worked for Emerald Towing, was on the scene to assist the Highway Patrol by removing the vehicle of a suspect that had been arrested.
Ricciardellli had secured the vehicle on his tow truck and was picking up the safety cones when 59-year-old Johnnie Knowles, who was traveling north on the highway in a 1995 Toyota Camry, swerved left in an attempt to avoid a rear-end collision when the vehicle in front of him slowed down.
Knowles then hit Ricciardellli who was still in the lane which was closed down.
Ricciardelli was air lifted to Delray Medical Center, where he died.
Knowles sustained minor injuries and was taken to Bethesda Memorial Hospital.
The fatal accident investigation is still open and no charges have been filed at this time.

FedEx Truck Causes Chemical spill on Interstate 75

A FedEx truck carrying double trailers overturned in the southbound lanes, spilling formaldehyde causing two other wrecks shortly after that due to traffic backed ups.
According to reports the FexEx truck crashed near Carbondale Road and mile marker 326, leading to all southbound lanes being blocked.
A female motorist was hurt in one of crashes that occurred after the truck wrecked and was taken to a hospital with minor injuries.
Her name was not released.

5 Vehicle Toledo Crash Leaves 8 Injured and 1 Dead

Around 12:56 p.m. on Thursday afternoon a crash involving 5 vehicles occurred on westbound Cherry Street just before N Summit Street in Toledo. A Ford Econoline was stopped at a red light when all of a sudden it was hit from behind by a mini-van appearing to be going over 60 mph. This then caused a chain reaction of vehicle hitting vehicle at the stoplight.
The driver of the mini-van was Ronald Carpenter, 69, of Toledo had appeared to suffer a heart attack leading to the accident. He was taken to Mercy St. Vincent Medical Center and was pronounced dead at 1:39 p.m. He was a retired factory worker and leaves behind a wife and nine children. Mrs. Carpenter said he enjoyed fishing and loved to make sure she was happy.
Steve Morgan, 30, of Toledo was driving aside Mr. Carpenter at the time of the accident and said he saw him blank out and his head go back and start to speed up. Jerome Jackson, 32, of Toledo was the driver of the Econoline and only suffered minor injuries. Also involved in the accident was Jeremy Miller, 25, of Toledo; Joseph Adamson, 32, of Sylvania; Monica Adamson, 30, of Sylvania; Shanice Franklin, 20, of Toledo; Kristen Wolfe, 49, of Toledo; Bobby Winston, 37, of Toledo; and Perry Graves, 29, of Toledo. All have been reported to only suffer minor injuries.

Man Dead After Single Vehicle Accident

Friday morning Nicholas Haynes, 26, of Summerfield Township, MI lost control of his pick-up truck on Sylvania-Petersburg Road in Summerfield Township. The vehicle overturned and Mr. Haynes was ejected from the truck. He was pronounced dead at the scene.

Jeep Employee Files Suit Seven Years After Shooting

Seven years ago Paul Meldon was a 22-year-old employee for Chrysler during the time of a shooting that occurred at the Toledo Jeep Assembly Complex. The shooting took place on January 25, 2005 when Miles Myers, a disgruntled fellow employee, came into the plant with a shotgun and killed one man, left two injured, and also took his own life.

Mr. Meldon has undergone several surgeries in the past years due to the serious injury he suffered at the time of the shooting. He is seeking $500,000 in damages from the company. He states that Mr. Myers came into the plant undetected and that the security firm Wackenhut, who was hired to prevent things like this from happening failed to do their job. Also the company now G4S Secure Solutions, lost an important checklist detailing what steps employees had taken the day of the shooting. G4S spokesperson had no comment on the matter.

Vehicle Hits Semi Truck; Leaves Two Injured

Medical malpractice and wrongful death

Medical malpractice that results in death gives rise to two distinct causes of action: (1) a “survival action” medical malpractice claim for the victim’s personal pain and suffering prior to death, and (2) a “wrongful death” claim for the loss suffered by the victim’s spouse and next of kin after the victim’s death.

As discussed above, a medical malpractice claim is subject to a one year statute of limitations (with the possibility of a 180 day extension if a 180-day letter is properly served). However, a wrongful death action is subject to a two year statute of limitations, and this is true even if the wrongful death comes about as the result of medical malpractice. So, it is possible that a wrongful death action may still be available even if the underlying medical malpractice action is time-barred.

In addition, the Ohio Supreme Court has adopted a “discovery rule” that can extend the two year wrongful death statute of limitations. Under the discovery rule, the two year period in which to file a lawsuit starts when the plaintiff discovers, or in the exercise of reasonable care should have discovered, that a wrongful death has occurred. The start of the limitations period is delayed until triggered by a “cognizable event” that alerts the plaintiff of the potential for a wrongful death claim. The discovery rule was adopted to prevent the unfairness that would occur if the statute of limitations were rigidly followed. Such unfairness would exist in a wrongful death action where the victim's survivors are not immediately aware that a wrongful death has occurred.

In a wrongful death claim, the surviving children and other next of kin may recover compensation for (1) loss of support from the reasonably expected earning capacity of the decedent; (2) loss of services of the decedent; (3) loss of the society of the decedent, including loss of companionship, consortium, care, assistance, attention, protection, advice, guidance, counsel, instruction, training, and education; (4) loss of prospective inheritance; and (5) mental anguish. A knowledgeable attorney will be able to assign a value to each of these components and maximize the monetary award in a given case.

Teenage Girl Killed After Crash with Snowplow

Around 2 p.m. Saturday a pickup truck driven by Christian Kellerbauer, 18, of Toledo crashed into a snowplow at southbound State Rt. 25 by Reitz Road in Perrysburg. Marvin D. Conner, 47, of Pemberville was the driver of the Perrysburg Township snowplow. The snowplow truck was stopped in the median and was trying to turn onto Reitz Road.

Kellerbauer and his passenger, Olivia Renee Waller, 18, of Toledo were trapped in the truck and were not wearing seatbelts. Waller was pronounced dead at the scene and Kellerbauer was flown to the University of Toledo Medical Center in serious condition. Mr. Conner was not injured in the accident and lanes were closed for several hours after the crash.

Jury Awards $14 Million in School Bus Crash Lawsuit | Ohio Personal Injury Attorney

A Pennsylvania jury awarded $14 million to Ashley Zauflik, 22. Ashley lost her left leg when she was struck by a school bus when she was in high school. However, it is probable that the reward will be reduced due to state law. Zauflik spent a month in a medically induced coma and had her left leg amputated after the January 2007 accident that occurred in the Philadelphia suburbs. According to the National Transportation Safety Boards found that the driver had stepped on the accelerator, rather than the brake, before crashing in to a crowd of students during dismissal at a high school.

It is expected that the trial judge will reduce the award to $500,000, the cap allowed under a 1980 Pennsylvania law that protects municipalities and school districts.

Ashley testified that the crash left her “disfigured” and struggling with depression. She also claims that she has had trouble using a prosthetic leg and relies instead on crutches or a wheelchair to move about.

The award includes $11 million for pain and suffering and other non-economic damages, and about $3 million for past and future medical expenses.

Affadavit of Merit in Toledo medical malpractice

Another hurdle that plaintiffs have to overcome before pursuing a medical malpractice claim in Ohio is getting a doctor to prepare an “affidavit of merit.” As of 2005, Ohio law requires that any complaint for a lawsuit claiming medical malpractice must have an affidavit of merit attached.
The affidavit of merit is a sworn statement that must be completed by an expert witness (this will usually be the doctor that the plaintiff retains as his or her expert). The affidavit of merit must outline the doctor’s education, licenses, and work experience. It must indicate that the doctor devotes at least one-half of his or her professional time to active clinical practice in his or her field of licensure, or to its instruction at an accredited school. Further, the affidavit must include statements that the doctor: (1) has reviewed all medical records reasonably available, (2) is familiar with the applicable standard of care, and (3) is of the opinion that the defendant medical care provider breached the standard of care and caused the plaintiff’s injury. In addition, the affidavit of merit should state what the standard of care was in the given case and should specify how it was breached.

Two people were killed and Four Injured

31-Year-Old Marvin Deleon-Quinonez was pronounced dead at the scene when his car crashed into a construction vehicle.
According to reports, Deleon-Quinonez’s car was heading north in the right lane when he swerved to the left and ran into the back of a vehicle used to protect workers on construction sites
His passenger that was sitting behind him, Tono Alarcon, whose age is not known, died after being taken to the hospital. The other back-seat passenger, Freddy Morena, age also not known, suffered serious injuries and was also taken to the hospital.
The front-seat passenger, 25-year-old Byron Cardona Aguirre, was not seriously injured, and was taken to the hospital for further evaluation.
The two construction workers, whose names were not released, sustained minor injuries.
The crash is currently still under investigation.

63-Year-Old Man Killed By a Lion

63 -year-old Joe Ramonetha, was killed by a 10-year-old female white lion named Nyanga, after a gate was left open as he prepared the animals' food.
According to reports, the Zoo staff heard Ramonetha screaming and went to help. When they arrived, he was bitten once on the neck and was already dead when he arrived in hospital.
Louise Gordon, a spokeswoman for the zoo, said it had happened "so fast, like a car crash – you just don't expect it".
The lioness attacked Ramonetha in a passageway which the creatures cannot normally access, meaning, a gate was left open. The Lion was sedated with a tranquillizer dart and returned to where she belonged.
Zoo officials say, there will be a full investigation and they will decide then what to do with Nyanga. They feel that this was just an instinctive reaction on her part, perhaps because he tried to run away. She didn't take his body away like prey. She bit him once in the neck and that was it.

Car Hits a Boulder and Two were Injured

Around 10:45 p.m. Friday night in South Toledo a car driven by Nicholas H. Martinez, 17, went off road after he lost control. The vehicle then hit a landscape boulder and overturned near South Avenue and Henderson Street.

He was trapped in the car for a brief moment until firefighters could get him out. Mr. Martinez was then taken to the University of Toledo Medical Center in critical condition. The passenger, Kelsee Lee Barrett, 16, had minor injuries and was released to family at the scene. Another passenger fled the scene of the crash by foot and has not been identified.

'06, '07 Trailblazers Under Probe

Federal safety regulators are now investigating the 2006 and 2007 Chevy TrailBlazers for driver’s side door fires. Just last week Toyota Camry and RAV4 were being investigated for the same occurrence. So far none of the vehicles under investigation have been recalled. The safety agency is trying to see if there is a link to the suppliers of the switchers, but so far neither company has told who the company is that supplies the part.

So far there have been 12 complaints for the Trailblazer having smoke or fire occur in the passenger side door. No one has been reported injured and no vehicle has been destroyed from the fires at this time. The Buick Ranier, GMC Envoy, and Saab 9-7X have the same power switches in their doors, but there have not been any reports about them yet. Both Chevy and Toyota are said to be cooperating with the investigation.

Less Deer Taken This Hunting Season

In 2010-11 hunting season there were a reported 239,379 deer taken during hunting season, but this past year there was only 219,698 killed. This is a very big difference in just one year. Hunters had two new methods of reporting their deer this year. The new methods were to call in the number or to go online. Combined these new methods were used 80% of the time.

Ohio is ranked eighth in annual hunting related sales and 10^th in jobs that are associated with the hunting industry nationally. Every year hunting takes in $859 million with sales from equipment, fuel, food, lodging, and more. Lucas County went up from 678 deer last year to 705 this year.

Hunter's Remains Found After Being Reported Missing

Stephen Dempsey, of Ashville, Ohio was reported missing by family members January 13 after not coming home from a hunting trip. Human remains, believed to be Dempsey, were found at a campsite were crews had been searching for Mr. Dempsey. Sheriff Shawn Justice said a short time before the remains were discovered a shotgun had been found next to the campsite in a creek hidden by debris.

The remains have been sent to the Montgomery County Corner for identification.

Man Shot and Killed on Game Lands

Nikolas J. Neric, Brooklyn, OH was shot and killed during what seems to be a hunting accident in Farmington Township. It was the last day of a four0day muzzleloader-hunting season at Grand River Wildlife Area.

Jamey Graham, Ohio Department of Natural Resources spokesperson, said that the case is still being investigated and are not sure if either Mr. Neric or the shooter were there participating in the hunting season.

A man called 911 saying that his brother had accidentally shot someone. And said that the man shot was not wearing orange and didn’t have a gun either. The name of the shooter has yet to be released.

The General Requirement of Medical Expert Testimony

In the context of alleged medical malpractice, it is usually not sufficient for the plaintiff (or the plaintiff’s lawyer) to simply stand up in court and claim that a doctor gave bad care which caused harm or injury. If that were the case, medical malpractice lawsuits would be relatively simple. Rather, whether the doctor has treated the patient with the proper standard of care and skill must be determined from the testimony of medical experts.
The reason for the expert testimony requirement is straightforward. In order to establish medical malpractice, the plaintiff must prove that a medical professional caused injury by doing something that a medical professional of ordinary skill, care, and diligence would not have done under similar circumstances. Because the vast majority of medical malpractice cases involve a medical professional’s skill and judgment, the plaintiff must present medical expert testimony to establish (i) the relevant standard of medical care, (ii) a breach of that standard, and (iii) that the breach of the standard led directly to the injury.
Although there is an exception to the expert testimony requirement for matters within the “common knowledge” of laypersons (i.e. everyone knows that a doctor replacing the wrong knee is highly improper), most medical malpractice cases are not within the “common knowledge” of laypersons. For example, most people do not know how many incisions should be made during a hernia repair or whether a doctor should inspect the intestines by hand before closing the patient back up. That is why most medical malpractice cases require the testimony of a medical expert who can explain to the jury what the proper standard of care should have been, and how it was breached. Such an expert must practice in the same or a substantially similar specialty as the defendant medical provider.
Sometimes, the best candidate to be an expert witness on a given case is a client’s subsequent treating physician. For example, say that you go to Dr. Smith to perform surgery on your broken foot, and Dr. Smith botches the surgery and actually makes your foot worse. You then follow up with Dr. Jones who is flabbergasted at how bad Dr. Smith performed the surgery. At this point, Dr. Jones would likely make an excellent candidate to be an expert witness on your case because he is very aware of the situation and may be inclined to help you pursue compensation from Dr. Smith.
Of course, it is not always the case that a subsequent treating physician will be interested in helping to pursue a medical malpractice action (or there may not even be a subsequent treating physician). If that is the situation, your lawyer will begin to search for a knowledgeable expert for your case who will be able to provide the testimony that you need in order to see your case through from start to finish.

Man awarded $2.3 million in Kroger lawsuit | Toledo personal injury lawyer

Craig Walters was recently awarded $2,365,238.40 by a judge that determined Kroger destroyed and manipulated evidence.

The lawsuit stemmed from an incident that occurred in May of 2008. Mr. Walers was shopping at his local Kroger. Crushed fruit fell on the floor near the deli area and he slipped and fell on it. A study in The New England Journal of Medicine has found that frivolous lawsuits where a healthy patient successfully sues a doctor are very rare and are far outnumbered by the number of cases where someone that was truly injured by medical error went uncompensated. Further, Harvard researchers have found that 1% of patients treated in New York state hospitals are injured, and one-quarter of those die, because of medical negligence. Nationwide, that would have translated to 234,000 injuries and 80,000 deaths from negligence in American hospitals for a year. However, according to a recent Healthgrades study, only 2% of all people injured actually file legal claims for compensation.

According to a 2006 article from the Harvard School of Public Health published in The New England Journal of Medicine, most medical malpractice claims that lack evidence of an error are denied any compensation. In the study, trained doctors reviewed a random sample of 1,452 closed medical malpractice cases to determine whether a medical injury had in fact occurred, and if so, whether the injury was due to a medical error. The researchers found that for only 3% of the claims there were no verifiable medical injuries. Most of the claims that were not associated with errors or injuries did not result in any compensation. However, most of the claims that involved injuries due to error did result in compensation.

These studies show that the country’s “tort law” based medical malpractice system is not biased in favor of patients. In fact, the medical malpractice system allows many medical providers to escape liability after committing malpractice. Therefore, if you believe that you have a legitimate medical malpractice case, you should not be deterred by any type of “stigma” that the insurance industry has tried to associate with medical malpractice claims. You have rights in such a situation, and you should act quickly to protect them.

Toledo Teen Shot in Overnight Home Invasion | Ohio Personal Injury Attorney

On the night of Wednesday February 8, 2012, a masked man walked into a house and shot a 19-year-old in the leg. The incident happened around 2 a.m. at a house on the 500 block of Clark Street near Woodville Road.

A witness stated that he/she and the victim were watching television when the suspect entered the home, shot the teen in the leg, and left the house without saying a word. Another witness described the suspect to be about 5’ 11’’ tall and about 180 pounds. He also said that he was wearing tan pants, a black hooded sweatshirt and a black mask.

There has been no news released on the victim. At this time, police have no suspects in this case.

Increased Failure Rates Found in All Modern Metal-On-Metal Hip Implants | Ohio Personal Injury Attorneys

Bill Doing Away With Label on "Pit bulls" Sent to Kasich For Signature | Ohio Dog Bite Attorney

After 25 years, Ohio may be doing away with its law that automatically declares the “pit bull” to be an inherently vicious dog.

The House voted 67-30 to send House Bill 14 to Gov. John Kasich’s desk.

The current law defines a “vicious dog” as one that, without provocation, has seriously injured a person, killed another dog, or belongs to the general breed of a “pit bull.” Under this law, owning these dogs triggers additional liability insurance, restraint, and other requirements and increases the chances that a pit bull could be euthanized if pickup up on the street.

House Bill 14 would redefine current designations of “vicious” and “dangerous” dog and create a third lesser category of “nuisance” dog, create venue for dog owners to appeal law enforcement’s labeling of their dogs, and place a burden to prove the classification by clear and convincing evidence on the dog warden.

Supreme Court Rules Against Patient Injured by Generic Drug ? Toledo personal injury attorney

The case of PLIVA Inc. v. Mensing involved Ms. Mensing was suing the manufacturer of the generic drug, metoclopramide. She said that they failed to warn her in her developing of tardive dyskinesia, which is a disabling neurological condition. PLIVA argued that there was a conflict between state and federal law that dismissed the suit in state court and that under the Hatch-Waxman Amendments that generic drugs are approved once they have the same active ingredients, are bioequivalent in terms of the subscribers absorption in the body, and the packaging has warning and labeling that matches the name-brand’s word for word. So there for could not change any warnings on their packaging. Ms. Mensing then argued that with the “Changes Being Effected” CBE regulations that a generic manufacturer can change warning before approval by the FDA. She also stated that the manufacturer admitted to not taking the steps for a stronger warning to the FDA.

The Supreme Court sided with the manufacturers because of they by federal law could not change the warning labels from the name-brand product even with the CBE process.

Many think that this is bad news for patients who take generic products, because 70% of prescriptions are generic drugs and this could lead to millions of people being injured from this.

The highway patrol have reported that a tanker truck was involved in an accident about 10:30 a.m. yesterday morning.

The authorities report that the truck hit an electric pole which brought down power lines. This accident caused the gasoline tanker to catch fire.

The driver of the truck, 46-year-old Jose Calderon, was removed from the truck and taken to the hospital by ambulance. He sustained non-life threatening injuries.

A crash between a car and a tractor-trailer has left 3 people hospitalized on Tuesday.

The state police reported that three women, one of them being pregnant, were taken to a local hospital.

The resucuers had to cut the roof off of the car so that two passengers could get out.

An interstate was shut down in Akron after a semi truck flipped over on its side.

The crash happened on Interstate 76 westbound ramp to I-77 south at the Akron central interchange.

According to reports the truck lost control coming around the ramp and fell over on its passenger side blocking the ramp.

The truck was hauling tractor tires. There was no fuel spill, and no danger to anyone in the area. No other vehicles were involved.

The driver was not hurt in the crash.

Michael Garczynski, 34, was arrested by The U.S. Marshal’s Northern Ohio Violent Fugitive Task Force at his girlfriend’s home on the 6000 block of Red Oak Drive in West Toledo Wednesday. Garczynski was accused of being the cause of an accident that involved five people crashing into a ditch on State Rt. 199 near Perrysburg on November 17.

Deputy U.S. marshal, Rodney Hartzell, said that they had received a tip of Garczynski’s whereabouts at his girlfriend’s house, but also said that there had been a few false tips made from people that knew the suspect just to throw them off. Those accused of doing so will have warrants out for their arrest for knowingly giving false tips.

On Wednesday Ohio State Highway Patrol, led by Lt. Glenn Peterson, were investigating an accident that accorded on the Ohio Turnpike where a tractor-trailer rig went into the closed lanes of a work zone just west of State Rt. 53. The truck hit three workers and crashed into three maintenance vehicles.

Driver of the truck was Edward Mills, 53, of Doylestown, Ohio was taken to the

neurological intensive-care unit at Mercy St. Vincent Medical Center in Toledo and was unavailable to be interviews by officials. Foster John Fletcher, 53, of Perrysburg was a turnpike assistant maintenance foreman was hit and killed during the accident. The other two surviving workers were James Roudebush, 55, of Millbury and Anthony J. Stout, 24, of Clyde, Ohio were taken to The University of Toledo Medical Center and are still in critical condition. The two survivors also could not be interviewed as of yet.

Lt. Peterson said that it is still uncertain what caused this accident but they were looking into the speed of the rig. Also that from interviews with some of the witnesses at the site of the crash they saw the truck slowly veer into the closed work area.

A tractor-trailer rolled over and caught fire on Wednesday. The truck was one of five vehicles that was in the accident.

The accident happened along I-95 during rush hour. Rachel Wood, 31, entered the highway and while in the shoulder of the road, struck a 2010 Nissan Frontier. The Frontier then swerved into the middle lane and struck the tractor-trailer. The trailer then flipped onto its side and struck a concrete barrier, causing it to catch fire.

The driver of the truck, Nerys Granados, along with the driver of the Nissan and some passengers were taken to a nearby hospital. Granado sustained serious but non-life threatening injuries.

A pick-up truck collided with a tipping semi-truck at the intersection of Wynn Road and Navarre Avenue in Oregon, Ohio.

Cody Van Hersett, 16, a sophomore from Clay High School Oregon, Ohio was traveling westbound on Navarre Ave January 12 in the afternoon when he hit a semi-truck that was turning left from Navarre Ave onto Wynn Road head on. Harsett was pronounced dead at the scene. Driver of the semi-truck Lyle Schmidt, 78, of Merrill, Wisconsin was not injured during the accident. He had been a truck driver since 1960 and had driven over four millions with out an accident.

Mr. Schmidt was charged but pleaded no contest to one second-degree misdemeanor count of vehicular homicide, which carries a maximum penalty of 90 days in jail. Judge Jeffrey Keller of Oregon Municipal Court sentenced him to up to 90 days in jail Monday, but if he does not violate probation will only receive 70 days. Lyle Schmidt was also ordered to two years probation, pay $830 in fees and court costs, and loss of his driver’s license for two years. Mr. Schmidt was very emotional and was not allowed to face the family of Cody when he apologized for what had happened.

Ohio is the only state that labels pit bulls automatically as “vicious”, but that may come to an end. “Vicious dog” is currently defined by law as “one that, without provocation, has seriously injured a person, has killed another dog, or is of the general breed known as ‘pit bull’”. The new bill will take pit bull off of that law. Rep. Barbara Sears is the one that has sponsored the bill and the House passed it 69-29 last spring. Many people are against the law being changed because pit bulls have been used to guard drugs and be involved in dog fighting.

House Bill 14 will just changed the label “vicious dog” just to ones that have injured a person and those that have would be confiscated and euthanized. Also there will be a new “dangerous dog” classification, which is for dogs that have caused minor injuries to a person that wasn’t provoked, killed another dog, or is a three-time offender under a new “nuisance dog”. A nuisance dog will be the minimum classification by one that without provocation and not in the premises of the keeper, has chased, menacingly approached, or attempted to bite a person. If the dog is classified as “dangerous” than pay $50 to the county auditor to register the dog and get tags that make clarify it as dangerous. Also they will have to let the local dog warden when the animal gets loose, bites someone or animal, and also the transfer of ownership or if the dog dies. The last part of the bill makes felons have to wait a three-year period before they can own certain dogs.

3 injured in crash on State Rt. 116 | Van Wert Ohio car accident lawyers

An accident on Saturday left 3 people injured, one seriously. The accident happened on State Rt. 116 when Morgan Pugh, 17, was southbound on Ringwal when she failed to yield to a car driven by Eileen Manken, 56.

Manken's vehicle was struck on the right side, and both vehices traveled off the southeast corner of the intersection, struck some signs, and rolled before stopping in a field.

The fire departmen had to free Ms. manken from her vehicle. Both she and her passenger were taken to parkview Hospital. Ms. Pugh was taken from the scene to Van Wert Hospital and later flown by helicopter to Parkview. She is listed in serious condition.

The crash remains under investigation.

Reports say a tanker truck driven by 53-year-old Edward Mills swerved through the cones where four Ohio Turnpike workers were in the area performing repairs to a bridge.

One of the workers started blowing an air horn to warn other workers. Nate Overmyer was able to move out of the way of truck.

The condition of Mills is unknown. This accident is still under investigation.

As realtor Robert Fenlon, 50, approached a house that he was scheduled to show to prospective buyers, homeowner Mary Kay James, opened the door and let her three unleashed dogs out into the yard. The dogs chased Fenlon and one of them jumped on his chest and knocked him to the ground.

During the assault, James stayed in her house and did not call the dogs back. She only came out of the house when police summoned her and paramedics were treating Fenlon.

Fenlon suffered from a broken wrist that required an external fixator and surgery that cost around $39,000 in medical expenses. Due to the permanent injury to his wrist, Fenlon could no longer work as an air conditioner repairman making around $32 and hour. Fenlone is unable to earn the same amount as before the injury and estimated his loss of income between $256,000 and $512,000.

Fenlon sued James, alleging she failed to control her dogs when she knew they had violent tendencies and failed to keep reasonable control over them as required by state law. Before the accident, James had been cited three times for allowing her dogs to escape, preventing neighbors from leaving their homes. Police also recorded aggressiveness in the dogs when they previously visited the house and witnessed one dog nipping at a child.

James argued that the dogs never bite Fenlon and that he was negligent in knocking on the bay window rather than the front door and kicking one of the dogs.

Fenlon was awarded $273,100. After he filed a motion for delay damages of $54,900, the parties settled on $300,000 plus costs.

On I-75 Saturday morning the back of a rescue squad vehicle was extremely damaged after a semi truck crashed into it while firefighters were arriving on the scene of a previous accident.

The impact caused the ambulance to hit another semi, which drug the ambulance for several hundred yards.

Two firefighters were injured.

The family of Timothy Pittas, 26, who died on December 12th has filed a lawsuit against Qualityscapes Inc.

Timothy was killed while working for for the family landscaping business. His clothing became stuck in the auger of a salt spreader. The lawsuit is against the manufacturer of the salt spreader. Upon further investigation into these salt spreaders, it was found that Timothy was not the first victim, and that these salt spreaders are quite dangerous.

The salt spreader did not have an emergency shutoff device nor did it have a guard to prevent clothing from becoming entagles in the auger. The machinery also did not come with any sort of warning in which they stated that clothing could become caught.

The lawsuit seeks more than $50,000 in damages.

A 45-year-old Ohio woman was injured when her SUV was struck by an oncoming train.

According to reports Theodore was driving in his 2002 Dodge Caravan at when he signaled for a right turn from Route 57. As the truck was passing from behind on the left, Thompson attempted make his and the two vehicles collided.

The widow of a man killed in an accident with a flatbed trailer has filed a lawsuit against the driver of the flatbed.

The accident happened on the night of June 30th. Stephen Hutinett, 52, was driving his Ford F-150 pickup when it cillided with a faltbed trailer that was bbeing towed by a dump truck. Stephen was killed upon impact and his wife, Sharon was seriously injured.

The lawsuit alleges that the trailer broke away from the dump truck and went into the path of Stephen's truck. The lawsuit also states that safety chains were not used, the trailer's rear brakes weren't working, and there were no working trailer lights. Both the driver of the dump truck and the owner of the trailer are named as defendants in the lawsuit.

A plastic manufacturer is being prosecutes after one of its employees severed a finger in an accident while on the job.

The worker, who was employed by DuBois Ltd, was working at their factory when his finger got trapped in the rotating dial of a color dosing unit. This is a machine that will add the color to plastic.

His finger, the left middle, was very badly injured and had to be amputated above the knuckle. On top of this he had to go through ten months of physiotherapy. He was unable to return to work for several weeks.

Through the investigation it was found that the safety guard which would prevent workers from contacting the machine, was removed. Dubois Ltd was fined for this incident.

One person has died from what officials preliminarily believe was a hunting accident.

A 911 call from Daniel Miller came in around 2:38 p.m. on January 10, 2012. Daniel informed 911 dispatchers that the shooting happened around 1:45 p.m.

Miller told dispatchers that his brother saw the victim, who was fatally shot, in Grand River Wilderness Area.

The Ohio State Highway Patrol is still investigating the shooting because it occurred in a state park. The Trumbull County Sheriff’s Office is also assisting in the investigation.

A settlement was recently reached for the wrongful death case of two workers who were killed while on the job.

The two workers were about 40 feet up on a radio tower when a bucket truck that was being operated by an employee of Barnhart Crane & Rigging Co. backed over a guy wire that supported the tower. As a result of one guy wire breaking, another wire failed as well and the tower collapsed. The two men fell to their death depite being correctly tied off to the tower and practicing all fo the proper safety precautions.

Upon further investigation it was found that these deaths were entirely preventable. The driver of the truck admitted that he knew the location of the guy wires that he eventually struck. The driver did not use a spotter while he was backing up, which is company guidelines.

The two cases were settled for $3 million each by the familes of te two who lost their lives.

3 Men Injured in an Industrial Accident | Sandusky Ohio Workers Compensation lawyer

The names of the three men seriously injured in an industrial accident in Sandusky County Friday morning have not yet been released.

According to reports, at the Martin Marietta Magnesia Specialties LLC plant, a 24-foot-tall rebar-strengthened concrete form collapsed.

Two of the men were flown to the University of Toledo Medical Center, the former Medical College of Ohio Hospital, and the third was taken by ambulance to Mercy St. Vincent Medical Center, Woodville Township.

When firefighters arrived, two of the workers had been pulled from underneath the collapsed structure, and the third was pulled out by other construction workers at the site. The men were alert and talking.

Both Martin Marietta and the Health and Safety Department are investigating the incident.

A 54-year-old man was killed in his own driveway yesterday. Jack Drobot was splitting wood on his property and had been talking with a truck driver in his driveway. He climbed onto the side panel of the truck's cab.
After the conversation was finsished, Drobot got off of the truck, but the driver did not see him when he went to do a U-turn and his back tires ran over Jack.
He was taken by ambulance to a nearby hospitla where we was prnounced dead. The truck driver was driving under a suspended license at the time.

Eira Thomas was walking her one-year-old cocker spaniel along the beach when she and her dog were attacked by a group of five dogs. The dogs appeared to be Rottweilers.

Ms. Thomas had to be taken to the hospital while her dog, Bella, had to be put down. She stated that as they were walking along the beach the dogs just came out of nowhere and attacked.

A man arrived on the scene a short time later apologizing for his dogs and stating that he didn't realize she was there.

Ms. Thomas left the scene and rushed Bella to the hospital becuase of the serious injuries she sustained and then went to the hospital herself immediately after.

The police have not been able to locate the man and his five dogs though. They are continuing the investigation and looking for anyone who might have some information.

The Charles Boy Law Offices would like to extend condolences to frineds and family of Cody Van Hersett. Cody was killed after school on Thursday afternoon when his pickup truck crashed into a semi.
The accident happened around 2:30p.m. at the intersection of Wynn and Navarre in Oregon. Cody was 16 and a sophomore at Clay High School. He played hockey, was active in school and loved by many.
The driver of the semi, 78-year-old Lyle Scgmidt, was not hurt during the accident. Van Hersett died on the scene.
The crash remains under investigation.

Shauna Cooke was bitten several times on her hands, legs and side after she tried to separate two of her dogs that began fighting.
A neighbor said Cooke's family didn't want to talk with the media.
Reports say, six dogs in Cooke's care apparent went up to a fence after they spotted a person walking a dog along the street. Two of Cooke's dogs began fighting with one another, and Cooke intervened.

Reports say If the pit bull is also not put down, they will face a 20,000 fine. Police were waiting last night to talk with Cooke's husband before possibly euthanizing the pit bull.

A Nebraska Supreme Court has ruled that a woman that was seriously injured in a fall down an empty elevator shaft at her workplace can sue a real estate company operated by her employers. Darlene Howsden was an employee of a Lincoln funeral home in 2009 when she attempted to cut through a makeshift hallway that employees often used. The hallway was through an elevator shaft by the top of an elevator car that usually rested on the basement floor of the building. Ms. Howsden was unaware that the car was not on the basement floor and fell 16 feet to the building’s basement floor and was severely injured.

She received workers’ compensation benefits but decided to sue the real estate company that owned the mortuary to recover additional damages. Roper’s Real Estate tried to convince the court that it is owned and operated by the same shareholders as Roper & Sons Inc. which operated the mortuary making workers’ compensation benefits Ms. Howsden’s sole remedy for damages. However, the court did not agree.

Ms. Howsden can now proceed with her lawsuit for unspecified damages, including lost wages, pain and suffering for the back injuries she received.

The death of a Norfolk, VA., sanitation worker was casued by safety lapses and equipment failures. 51-year-old Jerry Holton, was crushed inside a recycling truck in February. The factors that Ohio courts seem to consider when deciding whether to set aside a settlement agreement are as follows:

No evidence of actual negotiation. In situations where there is no indication that there was any sort of negotiation between the insurance company and the victim, but rather the insurance company “threw out a number” and the victim quickly accepted, there is a chance that the settlement may be set aside.
Payment only for medical bills incurred. If the victim was only awarded money for his or her medical bills and nothing else, that factor may weigh in favor of the settlement being set aside.
Neither the victim nor the insurance company were aware of the victim’s injuries. Even if there is some type of negotiation, if neither the victim nor the insurance company were on notice of the true extent of the victim’s injuries at the time of the settlement, that may provide an argument for the settlement agreement to be set aside on the basis of a “mutual mistake.”
The settlement amount is the exact same as the amount of property damage. If the victim was only awarded money for the amount of property damage to the vehicle and nothing else, that factor weighs in favor of the settlement being set aside. Such a payment would indicate that neither the insurance company nor the victim contemplated the potential for incurring medical bills as a result of the accident.
The release was signed a few days after the accident. If the release in question was signed very shortly (i.e. within the same week) as the accident, that factor weighs in favor of the settlement agreement being set aside. This scenario seems to indicate an over eager insurance company taking advantage of a victim by the promise of getting them cash fast.

There may also be other arguments that a victim can make based on the given situation. However, it is important to keep in mind that a victim who settles early will be facing a steep uphill battle if they have to fight to get the settlement agreement set aside. In fact, chances are that even if someone has one or more of the above factors working in their favor, the court will still defer to the black and white language of the settlement agreement, particularly if it indicates that the settlement is for “all injuries, whether known or unknown.” That is why it is so important to speak with an attorney immediately following any motor vehicle accident or other personal injury claim.

A mail man was bitten on the hand and thigh on Monday while he was on his normal mail route. Around 11 a.m. two pit bulls attacked Mark Albert, 35.

Alberti was taken from the scene to a nearby hospital where he was treated for the wounds he sustained. He was released a short time after.

Alberti has been working for the postal service since 2001. He tried to use pepper spray on the dogs, but it did not deter them. While he was being attacked a couple of women drove by and threw rocks at the dogs, causing them to run away.

The dogs' owner is 26-year-old Reginald Gray. He said that his children had let the dogs out without his knowledge.

A lawsuit was recenty settled that involved a highway contruction zone incident and two injured workers. The lawsuit stems from an incident in December of 2009. On that day a 24-year-old driver of a Sara Lee truck was traveling on U.S. 31 in an active construction zone where the speed limit was 35 mph. The driver of the truck was going 65 mph and wad not being attentive to the road conditions. He failed to observe that a contruction truck, which was parked in accordance with regulations. The construction truck had activated the flashing amber strobe lights. The impact of the collision caused the truck to hit and injure two workers who were near the truck.

One of the workers who was hit was a 22-year-old from Mexico who came to the U.S. to work and support his family. As a result of his injuries one of his legs had to be amputated below the knee.

The other worker was a 26-year-old husband and father to a three-year-old son. This you man's leg was crushed as well and hos leg had to be amputated above the knee. His spleen was also removed, which destroyed his ability to fight off desease and infection. The state police have released information saying that a 26-year-old man died after his motorcycle was struck by a turning vehicle.

Jancy Briles, a member of the team’s public relations staff, is suing companies involved in building or designing steel and fabric structure. The Cowboys were conducting a rookie minicamp when the 88,000 square food building fell in a wind storm on May 2, 2009. After investigation, the National Institute of Standards and Technology determined that the structure should have been able to withstand wind guests between 55 and 65 mph.

An Ohio man was killed last week in a head-on collision with a pick-up truck. The accident happened about 5:15 p.m. On December 18 on State Route 183.

According to the State Highway Patrol, James Wriston's Monte Carlo was hit head-on by a Dodge Ram who went left of center as they attempted to pass a vehicle.

Mr. Wriston, 41, was pronounced dead at the scene of the accident. Two people in the truck and a passenger in the car were injured as well.

The names of the Victims in An accident involving a 1989 Peterbilt semi truck and a GMC pickup that happened on Tuesday, December 6 at the intersection of Avenue 36E and Highway 80 in Wellton, Arizona, have not been released.
According to reports, the GMC pickup failed to stop at the stop sign on Avenue 36E and pulled out in front of the semi truck which was carrying manure, totaling both Vehicles.
Two people were taken by helicopters to Phoenix-area hospitals.
Firefighters found the semi truck completely crushed and upside down with fuel leaking onto the ground and onto the driver. The GMC pickup was about 70 yards from where the wreck occurred, and it was completely crushed as well.
Firefighters were able to remove both drivers, there was no passengers I neither vehicle.
The physical status of the two victims is currently unknown.

On Wednesday, a double tanker truck carrying 8,800 gallons of gasoline and burst into flame on the eastbound Pomona Freeway.
The tanker stopped under the Paramount overpass and the big rig driver along with a passenger managed to get out of the truck in time without getting hurt.
No one was injured, but it was reported that a firefighter suffered a broken leg while fighting the blaze.
The incident caused extensive structural damage to the overpass and a portion of it is scheduled for demolition.
The biggest inconvenience will be to motorists who have to find alternate routes until the freeway is reopened.
The cause of the fire is not known at this time but is currently under investigation.

A delivery truck ran into the rear of a tractor trailer on Monday afternoon. The passenger in the delivery truck, Steven Stewart, was killed in the collision. Steven,49, was from Albany, NY.

Eastbound lanes were closed from 4:30 to 10 p.m. Traffice got by on the left shoulder.

Graeme Scott was laying pipes into a trench in Glasgow's Cranhill Park when the trench collapsed.

A Co-worker of Scott, Thomas Brand jumped down into the trench and could tried to save him, however he was unsuccessful. Scott had been covered in debris and soil.

Scott died of a chest injury and probable suffocation caused by the trench collapsing on him.

Reports say that on the day of Scott's death, under the direction of foreman William Parry, neither of the two trench boxes, given to the men to work inside while in the trench, were used.

Police said, "The purpose of the trench box is to provide a safe working environment for those working within the trench by supporting the side walls and preventing soil slipping into the trench."

Sheriff John McCormick reported: "The death of Graeme Scott was entirely unnecessary and preventable had trench boxes and edge protection been used and the spoil deposited more than three metres from the trench edge in accordance with accepted good practice.

"Unfortunately, this event is one more example of health and safety practice, training and procedures being ignored in the interests of expediency with lethal results."

An iron worker has filed a lawsuit against Bechtel Power Corporation. The lawsuit states that Daron Nowark was working completing a construction project when his left leg was crushed between two pieces of metal, one weighing more than 15,000 pounds. The accident happened in November of 2008.

Keith Buttd, 52, was working for J.R. Reed Motor Carrier about 6 a.m. on Tuesday when his truck slid on Route 116. The truck was pulling a flatbed trailer full of construction steel. The truck struck a support beam for the gas pump island and continued on until it came to rest on a steep embankment.

Mr. Butts was pronounced dead at the scene of the accident. He was hauling steel to Canaan, Vt., at the time of the accident. There is not further information about the driver r his family.

According to a release from the state highway patrol, David Karrick, 44, was the drivier of a 2011 Isuzu straight truck along CR 6 when he failed to stop at the stop sign at South SR 53. He collided with Ramond Williams, 53, who was driving a semi truck.

Both parties were transported to nearby hospitals. Mr. Karrick was taken to Mercy Tiffin Hospital and Raymond Williams was tansported by Life Flight to Mercy St. Vincent Hospital.

The crash remains under investigation. Alcohol and drugs are not thought to be factors and David Karrick has been cited for failure to stop at stop sign.

The accident closed the roadway for several hours because of damage to the pavement.

A three vehicle accident sent three people to the hospital. The accident involved a car, a truck, and a semi truck. Mnay details involving the accident, however, are still not known. 23-year-old Martin Mundie was helping convert a pig shed into a workshop when he fell through the skylight in the roof, to the concrete floor and broke his arm and his wrist.

When he was taken to the hospital, he needed a bone graft and two operations to insert three plates and six pins.

Mundie’s boss, Joseph Adams, was fined $4500 for health and safety violations which contributed to the accident.

A Health and Safety Executive investigation found that Adams had not assessed any of the risks for his employees, had not put any safety measures in place or given his workers any safety equipment.

Alan Mackinnon, an inspector, said: "Mundie has been left with significant and lasting injuries that could easily have been avoided if Joseph Adams had thought about the obvious risks involved when working on a roof.

He did not provide any equipment to allow the men to work on the roof safely.

He could have arranged for his employees to work from a mobile elevated work platform, wear safety harnesses while they were on the roof or for properly fixed crawling boards with barriers to be used. Not providing any of these safeguards is simply unacceptable.

If Joseph Adams had taken simple safety measures, Mundie would not have sustained these injuries."

The weather in Northern Ohio has been a strange one this year. Unseasonable rain and temperatures in the 50’s! During one of the numerous rain storms this year a full size pick up truck driven by a Huron woman rolled down a ditch and lodged into a swamp off the east edge of Cedar Point Road.

They put her on a back board and took her to Firelands Regional Medical Center where she remained until later that night.
Sandusky police Lt. Robert Vanscoy said the truck was traveling north on Cedar Point Road when it veered off the road to the left. Duttera then overcorrected. The truck came back across the road, went off the right side and plunged into the edge of a swamp, according to the report.

An area bicyclist is recovering from injuries she sustained serious injuries after being hit Monday night by a minivan.
Judith Daiello was listed in fair condition at Mercy St. Vincent Medical Center in Toledo as of Wednesday afternoon.
The driver who hit her Trek Alpha 15 bicycle from behind on Ohio 269 is expected to be charged with failure to maintain assured clear distance, said Sgt. Joe Wentworth, of the Sandusky post of the state Highway Patrol.
Garrett L. Timmons, also was southbound in a 2000 Chrysler Town and Country minivan when he hit the rear of Daiello's bicycle, according to the report.
The collision caused Daiello to be ejected from the bicycle and thrown into a ditch off the right side of the road. Her bicycle also ended up there.
An ambulance initially transported Daiello to the Bellevue Hospital emergency room. A LifeFlight helicopter then flew her to Mercy St. Vincent.

An accident on Interstate 55/70 shut down all southbound lanes of the interstate Tuesday night.

Illinois State Police said a 70-year-old male who’s not will not be released, lost control of his semi, and crashed into the guard rail.

The accident caused the semi to become stuck and damaged about 300 to 400 yards of the guard rail.

All southbound lanes of the interstate were shut down for about two hours. A tow truck was eventually able to release the semi from the rail.

A 14-year-old Cochella boy was killed in a hunting accident over Thanksgiving weekend. He was shot by his teenage cousin, a relative said on Monday.

According to the Riverside County Sheriff’s Department, Isreal Delatorre of Cochella died on Saturday afternoon after he was unintentionally shot on Little Thomas Mountain Road near Garner Valley.

Guillermo Deltaorre, a hunting safety instructor since the 1990’s, was with the two boys on the deer hunt. Israel was the instructor’s nephew.

Guillermo’s son spotted a dear and Delatorre told Israel not to move, but he moved in front of the shooting range of the deer.

Sheriff’s department spokesperson Cpl. Courtney Donowho said the department has ruled the shooting as accidental and would not be releasing any more information out of respect for the family.

The Toledo man was indicted today by a Wood County Grand jury for charges stating that he intentionally caused a crash in Perrysburg Township last month.

Michael Garzynski was indcted on four counts of felonious assault and two counts of endangering children.

The charges stem from an incident that occurred on November 17th in which authorities say that he grabbed the sterring wheel of the vehcile he was a passenger in, intetnionally causing a crash. The vehicle flipped and went into a water-filled ditch on Route 199 south of Eckel Junction.

When police arrived on the scene they found Graczynski standing on the side of the orad outside of the vehicle while two women and two young children were trapped inside the car. he offered them no help.
