Crash Suspect Arrested by U.S. Marshals in Wood County ? Wood County accident lawyer

Michael Garczynski, 34, was arrested by The U.S. Marshal’s Northern Ohio Violent Fugitive Task Force at his girlfriend’s home on the 6000 block of Red Oak Drive in West Toledo Wednesday. Garczynski was accused of being the cause of an accident that involved five people crashing into a ditch on State Rt. 199 near Perrysburg on November 17.

Deputy U.S. marshal, Rodney Hartzell, said that they had received a tip of Garczynski’s whereabouts at his girlfriend’s house, but also said that there had been a few false tips made from people that knew the suspect just to throw them off. Those accused of doing so will have warrants out for their arrest for knowingly giving false tips.

State Highway Patrol Investigating Turnpike Accident ? Truck accident attorney Toledo Ohio

On Wednesday Ohio State Highway Patrol, led by Lt. Glenn Peterson, were investigating an accident that accorded on the Ohio Turnpike where a tractor-trailer rig went into the closed lanes of a work zone just west of State Rt. 53. The truck hit three workers and crashed into three maintenance vehicles.

Driver of the truck was Edward Mills, 53, of Doylestown, Ohio was taken to the

neurological intensive-care unit at Mercy St. Vincent Medical Center in Toledo and was unavailable to be interviews by officials. Foster John Fletcher, 53, of Perrysburg was a turnpike assistant maintenance foreman was hit and killed during the accident. The other two surviving workers were James Roudebush, 55, of Millbury and Anthony J. Stout, 24, of Clyde, Ohio were taken to The University of Toledo Medical Center and are still in critical condition. The two survivors also could not be interviewed as of yet.

Lt. Peterson said that it is still uncertain what caused this accident but they were looking into the speed of the rig. Also that from interviews with some of the witnesses at the site of the crash they saw the truck slowly veer into the closed work area.

A woman in Monroe, Michigan was killed after hitting a tree on a snowmobile.

Dawn Bergmooser, 49, Monroe, Michigan was out riding a snowmobile Saturday January 28 with some friends when she lost control of the vehicle and hit a tree. She was rushed to Mercy Hospital in Cadillac, MI and was later pronounced dead.

Ohio Man Dies in Snowmobile Accident ? Shelby Ohio snowmobile accident lawyer

Friday January 20 Gary L. Gundrum, 52, Shelby, OH was killed while riding on a snowmobile. According to police Mr. Gundrum was traveling 60 mph and didn’t notice a curve in the road and lost control. This then led to a ski on the vehicle to hit a tree sending him flying head first. He suffered from major head and chest injuries from the crash. Alcohol was not involved.

Parrish Quaterman, 46, was sentenced to 5 years of prison on Monday. He plead guilty to aggravated vehicluar manslaughter and operating amotor vehcile under the influence.

The sentencing stems from a fatal crash that occurred last August where Quaterman ran a stop sign at the intersection of State Route 199 and Dowling Road, hitting and killing 40-year-old Lisa Emahaiser. Quaterman was found to have marijuana in his sytem at the time of the crash.

Truck crashes, catches fire on highway | Toledo Ohio truck accident lawyer

A tractor-trailer rolled over and caught fire on Wednesday. The truck was one of five vehicles that was in the accident.

The accident happened along I-95 during rush hour. Rachel Wood, 31, entered the highway and while in the shoulder of the road, struck a 2010 Nissan Frontier. The Frontier then swerved into the middle lane and struck the tractor-trailer. The trailer then flipped onto its side and struck a concrete barrier, causing it to catch fire.

The driver of the truck, Nerys Granados, along with the driver of the Nissan and some passengers were taken to a nearby hospital. Granado sustained serious but non-life threatening injuries.

Robert Loja was unloading a trailer on October 24, 2008 when he was struck by a driver who was blinded by the glare of the sun. Right before she hit Loja, she also hit a small cone and a "Men Working" sign. As a result of the injuries he sustained, Mr. Loja had to have his left leg amputates above the knee. His right leg was also mangled in the accident.

16-Year-Old Oregon Boy Killed in Truck Accident ?Oregon Ohio Truck Accident Attorney

A pick-up truck collided with a tipping semi-truck at the intersection of Wynn Road and Navarre Avenue in Oregon, Ohio.

Cody Van Hersett, 16, a sophomore from Clay High School Oregon, Ohio was traveling westbound on Navarre Ave January 12 in the afternoon when he hit a semi-truck that was turning left from Navarre Ave onto Wynn Road head on. Harsett was pronounced dead at the scene. Driver of the semi-truck Lyle Schmidt, 78, of Merrill, Wisconsin was not injured during the accident. He had been a truck driver since 1960 and had driven over four millions with out an accident.

Mr. Schmidt was charged but pleaded no contest to one second-degree misdemeanor count of vehicular homicide, which carries a maximum penalty of 90 days in jail. Judge Jeffrey Keller of Oregon Municipal Court sentenced him to up to 90 days in jail Monday, but if he does not violate probation will only receive 70 days. Lyle Schmidt was also ordered to two years probation, pay $830 in fees and court costs, and loss of his driver’s license for two years. Mr. Schmidt was very emotional and was not allowed to face the family of Cody when he apologized for what had happened.

Ohio is the only state that labels pit bulls automatically as “vicious”, but that may come to an end. “Vicious dog” is currently defined by law as “one that, without provocation, has seriously injured a person, has killed another dog, or is of the general breed known as ‘pit bull’”. The new bill will take pit bull off of that law. Rep. Barbara Sears is the one that has sponsored the bill and the House passed it 69-29 last spring. Many people are against the law being changed because pit bulls have been used to guard drugs and be involved in dog fighting.

House Bill 14 will just changed the label “vicious dog” just to ones that have injured a person and those that have would be confiscated and euthanized. Also there will be a new “dangerous dog” classification, which is for dogs that have caused minor injuries to a person that wasn’t provoked, killed another dog, or is a three-time offender under a new “nuisance dog”. A nuisance dog will be the minimum classification by one that without provocation and not in the premises of the keeper, has chased, menacingly approached, or attempted to bite a person. If the dog is classified as “dangerous” than pay $50 to the county auditor to register the dog and get tags that make clarify it as dangerous. Also they will have to let the local dog warden when the animal gets loose, bites someone or animal, and also the transfer of ownership or if the dog dies. The last part of the bill makes felons have to wait a three-year period before they can own certain dogs.

3 injured in crash on State Rt. 116 | Van Wert Ohio car accident lawyers

An accident on Saturday left 3 people injured, one seriously. The accident happened on State Rt. 116 when Morgan Pugh, 17, was southbound on Ringwal when she failed to yield to a car driven by Eileen Manken, 56.

Manken's vehicle was struck on the right side, and both vehices traveled off the southeast corner of the intersection, struck some signs, and rolled before stopping in a field.

The fire departmen had to free Ms. manken from her vehicle. Both she and her passenger were taken to parkview Hospital. Ms. Pugh was taken from the scene to Van Wert Hospital and later flown by helicopter to Parkview. She is listed in serious condition.

The crash remains under investigation.

Roque Renteria, 14, was a member of his high school track team. One afternoon several team members began wrestling with one another instead of running laps as the substitute teacher ordered. Renteria’s mother sued the school district on his behalf, claiming that it failed to supervise the students during practice.

The school district countered that the incident happened so quickly that the coaches had not time to prevent it. They also stated that Renteria was just at fault as the other students because they were all rough housing.

The parties settled for $18.4 million, which included $11.4 million structured by the purchase of a single-premium tax-free annuity.

Authorities have identified 58-year-old Rocco Antonelli as the man killed in a truck accident along I-78 this morning.

The accident happend at 6:49 a.m. Mr. Antonelli had parked his box truck on the shoulder of the road when Alexandro Luis Morales, who was driving his 2006 Freightliner tractor-trailer, struck the box truck.

after he strck the truck, Morales swerved to the left, crossed over the eastbound lanes and landed in the center median.

A traffic accident involving a fire truck has left one man dead and two firefighters seriosuly injured.

The accident happened on Monday night when a Ford truck pulling a trailer ran into a median and the crashed into the fire truck. The truck had been there putting out a grass fire. At the time of the accident the fire was out and the men were trying to put away their equipment.

The driver of the truck was pronounced dead at the scene, and two firefighters were flown to a nearby hoospital. Investigators are still trying to find out why the Ford ran off of the road.

Reports say a tanker truck driven by 53-year-old Edward Mills swerved through the cones where four Ohio Turnpike workers were in the area performing repairs to a bridge.

One of the workers started blowing an air horn to warn other workers. Nate Overmyer was able to move out of the way of truck.

The condition of Mills is unknown. This accident is still under investigation.

As realtor Robert Fenlon, 50, approached a house that he was scheduled to show to prospective buyers, homeowner Mary Kay James, opened the door and let her three unleashed dogs out into the yard. The dogs chased Fenlon and one of them jumped on his chest and knocked him to the ground.

During the assault, James stayed in her house and did not call the dogs back. She only came out of the house when police summoned her and paramedics were treating Fenlon.

Fenlon suffered from a broken wrist that required an external fixator and surgery that cost around $39,000 in medical expenses. Due to the permanent injury to his wrist, Fenlon could no longer work as an air conditioner repairman making around $32 and hour. Fenlone is unable to earn the same amount as before the injury and estimated his loss of income between $256,000 and $512,000.

Fenlon sued James, alleging she failed to control her dogs when she knew they had violent tendencies and failed to keep reasonable control over them as required by state law. Before the accident, James had been cited three times for allowing her dogs to escape, preventing neighbors from leaving their homes. Police also recorded aggressiveness in the dogs when they previously visited the house and witnessed one dog nipping at a child.

James argued that the dogs never bite Fenlon and that he was negligent in knocking on the bay window rather than the front door and kicking one of the dogs.

Fenlon was awarded $273,100. After he filed a motion for delay damages of $54,900, the parties settled on $300,000 plus costs.

The two men were cutting some beams on the second floor and something went wrong. The building fell in a direction they obviously didn't want it to fall.

On I-75 Saturday morning the back of a rescue squad vehicle was extremely damaged after a semi truck crashed into it while firefighters were arriving on the scene of a previous accident.

Two firefighters were injured.

The driver of the semi, 53-year-old Edward Mills, was flown to Mercy St. Vincent's. He is listed in serious condition.

The westbound lanes of the Turnpike were closed for hours after the crash.

The family of Timothy Pittas, 26, who died on December 12th has filed a lawsuit against Qualityscapes Inc.

Timothy was killed while working for for the family landscaping business. His clothing became stuck in the auger of a salt spreader. The lawsuit is against the manufacturer of the salt spreader. Upon further investigation into these salt spreaders, it was found that Timothy was not the first victim, and that these salt spreaders are quite dangerous.

The salt spreader did not have an emergency shutoff device nor did it have a guard to prevent clothing from becoming entagles in the auger. The machinery also did not come with any sort of warning in which they stated that clothing could become caught.

The lawsuit seeks more than $50,000 in damages.

A 45-year-old Ohio woman was injured when her SUV was struck by an oncoming train.

It appears that Crystal Keller, 45, went around the lowered railroad-crossing gates and was hit just after 5 p.m. on Monday. The train hit the passenger side and pushed the vehicle into a gate, breaking it.

The woman was transported from the hospital and is listed in stable condition.

A 6-year-old boy was badly bitten and bruised after he was attacked by a dog on Monday night. The incident took place when a mother and son went over to the house of a family friend. Couple killed After Colliding with a Tractor-trailer | Akron Truck Accident Lawyer

67-year-old Theodore Thompson and his wife 70-year-old Patricia Thompson died at the crash scene of their accident.

According to reports Theodore was driving in his 2002 Dodge Caravan at when he signaled for a right turn from Route 57. As the truck was passing from behind on the left, Thompson attempted make his and the two vehicles collided.

The truck driver was treated at Akron City Hospital.

Rittman police and the Ohio Department of Transportation assisted at the scene. The crash remains under investigation.

The widow of a man killed in an accident with a flatbed trailer has filed a lawsuit against the driver of the flatbed.

The accident happened on the night of June 30th. Stephen Hutinett, 52, was driving his Ford F-150 pickup when it cillided with a faltbed trailer that was bbeing towed by a dump truck. Stephen was killed upon impact and his wife, Sharon was seriously injured.

The lawsuit alleges that the trailer broke away from the dump truck and went into the path of Stephen's truck. The lawsuit also states that safety chains were not used, the trailer's rear brakes weren't working, and there were no working trailer lights. Both the driver of the dump truck and the owner of the trailer are named as defendants in the lawsuit.

Recently, a worker at Steel Systems Installations sustained a severe leg injury while working. A plastic manufacturer is being prosecutes after one of its employees severed a finger in an accident while on the job.

The worker, who was employed by DuBois Ltd, was working at their factory when his finger got trapped in the rotating dial of a color dosing unit. This is a machine that will add the color to plastic.

His finger, the left middle, was very badly injured and had to be amputated above the knuckle. On top of this he had to go through ten months of physiotherapy. He was unable to return to work for several weeks.

Through the investigation it was found that the safety guard which would prevent workers from contacting the machine, was removed. Dubois Ltd was fined for this incident.

Settlement reached in tower collapse wrongful death | Toledo Ohio work injury lawyer

A settlement was recently reached for the wrongful death case of two workers who were killed while on the job.

The two workers were about 40 feet up on a radio tower when a bucket truck that was being operated by an employee of Barnhart Crane & Rigging Co. backed over a guy wire that supported the tower. As a result of one guy wire breaking, another wire failed as well and the tower collapsed. The two men fell to their death depite being correctly tied off to the tower and practicing all fo the proper safety precautions.

Upon further investigation it was found that these deaths were entirely preventable. The driver of the truck admitted that he knew the location of the guy wires that he eventually struck. The driver did not use a spotter while he was backing up, which is company guidelines.

The two cases were settled for $3 million each by the familes of te two who lost their lives.

3 Men Injured in an Industrial Accident | Sandusky Ohio Workers Compensation lawyer

The names of the three men seriously injured in an industrial accident in Sandusky County Friday morning have not yet been released.

According to reports, at the Martin Marietta Magnesia Specialties LLC plant, a 24-foot-tall rebar-strengthened concrete form collapsed.

Two of the men were flown to the University of Toledo Medical Center, the former Medical College of Ohio Hospital, and the third was taken by ambulance to Mercy St. Vincent Medical Center, Woodville Township.

When firefighters arrived, two of the workers had been pulled from underneath the collapsed structure, and the third was pulled out by other construction workers at the site. The men were alert and talking.

Both Martin Marietta and the Health and Safety Department are investigating the incident.

A 54-year-old man was killed in his own driveway yesterday. Jack Drobot was splitting wood on his property and had been talking with a truck driver in his driveway. He climbed onto the side panel of the truck's cab.
After the conversation was finsished, Drobot got off of the truck, but the driver did not see him when he went to do a U-turn and his back tires ran over Jack.
He was taken by ambulance to a nearby hospitla where we was prnounced dead. The truck driver was driving under a suspended license at the time.

Dog and owner attacked by pack of dogs | Toledo Ohio dog bite attorney

Eira Thomas was walking her one-year-old cocker spaniel along the beach when she and her dog were attacked by a group of five dogs. The dogs appeared to be Rottweilers.

Ms. Thomas had to be taken to the hospital while her dog, Bella, had to be put down. She stated that as they were walking along the beach the dogs just came out of nowhere and attacked.

A man arrived on the scene a short time later apologizing for his dogs and stating that he didn't realize she was there.

Ms. Thomas left the scene and rushed Bella to the hospital becuase of the serious injuries she sustained and then went to the hospital herself immediately after.

The police have not been able to locate the man and his five dogs though. They are continuing the investigation and looking for anyone who might have some information.

The Charles Boy Law Offices would like to extend condolences to frineds and family of Cody Van Hersett. Cody was killed after school on Thursday afternoon when his pickup truck crashed into a semi.
The accident happened around 2:30p.m. at the intersection of Wynn and Navarre in Oregon. Cody was 16 and a sophomore at Clay High School. He played hockey, was active in school and loved by many.
The driver of the semi, 78-year-old Lyle Scgmidt, was not hurt during the accident. Van Hersett died on the scene.
The crash remains under investigation.

Shauna Cooke was bitten several times on her hands, legs and side after she tried to separate two of her dogs that began fighting.
A neighbor said Cooke's family didn't want to talk with the media.
Reports say, six dogs in Cooke's care apparent went up to a fence after they spotted a person walking a dog along the street. Two of Cooke's dogs began fighting with one another, and Cooke intervened.
The mixed-breed dog that was injured in the fight with the pit bull had to be put down from injury.
Reports say If the pit bull is also not put down, they will face a 20,000 fine. Police were waiting last night to talk with Cooke's husband before possibly euthanizing the pit bull.

A Nebraska Supreme Court has ruled that a woman that was seriously injured in a fall down an empty elevator shaft at her workplace can sue a real estate company operated by her employers. Darlene Howsden was an employee of a Lincoln funeral home in 2009 when she attempted to cut through a makeshift hallway that employees often used. The hallway was through an elevator shaft by the top of an elevator car that usually rested on the basement floor of the building. Ms. Howsden was unaware that the car was not on the basement floor and fell 16 feet to the building’s basement floor and was severely injured.

She received workers’ compensation benefits but decided to sue the real estate company that owned the mortuary to recover additional damages. Roper’s Real Estate tried to convince the court that it is owned and operated by the same shareholders as Roper & Sons Inc. which operated the mortuary making workers’ compensation benefits Ms. Howsden’s sole remedy for damages. However, the court did not agree.

Ms. Howsden can now proceed with her lawsuit for unspecified damages, including lost wages, pain and suffering for the back injuries she received.

The report also explains that two safety systems on the truck did not work because the vehicle had been rewired to bypass the hopper door safety system. The factors that Ohio courts seem to consider when deciding whether to set aside a settlement agreement are as follows:

No evidence of actual negotiation. In situations where there is no indication that there was any sort of negotiation between the insurance company and the victim, but rather the insurance company “threw out a number” and the victim quickly accepted, there is a chance that the settlement may be set aside.
Payment only for medical bills incurred. If the victim was only awarded money for his or her medical bills and nothing else, that factor may weigh in favor of the settlement being set aside.
Neither the victim nor the insurance company were aware of the victim’s injuries. Even if there is some type of negotiation, if neither the victim nor the insurance company were on notice of the true extent of the victim’s injuries at the time of the settlement, that may provide an argument for the settlement agreement to be set aside on the basis of a “mutual mistake.”
The settlement amount is the exact same as the amount of property damage. If the victim was only awarded money for the amount of property damage to the vehicle and nothing else, that factor weighs in favor of the settlement being set aside. Such a payment would indicate that neither the insurance company nor the victim contemplated the potential for incurring medical bills as a result of the accident.
The release was signed a few days after the accident. If the release in question was signed very shortly (i.e. within the same week) as the accident, that factor weighs in favor of the settlement agreement being set aside. This scenario seems to indicate an over eager insurance company taking advantage of a victim by the promise of getting them cash fast.

There may also be other arguments that a victim can make based on the given situation. However, it is important to keep in mind that a victim who settles early will be facing a steep uphill battle if they have to fight to get the settlement agreement set aside. In fact, chances are that even if someone has one or more of the above factors working in their favor, the court will still defer to the black and white language of the settlement agreement, particularly if it indicates that the settlement is for “all injuries, whether known or unknown.” That is why it is so important to speak with an attorney immediately following any motor vehicle accident or other personal injury claim.

A mail man was bitten on the hand and thigh on Monday while he was on his normal mail route. Around 11 a.m. two pit bulls attacked Mark Albert, 35.

Alberti was taken from the scene to a nearby hospital where he was treated for the wounds he sustained. He was released a short time after.

Alberti has been working for the postal service since 2001. He tried to use pepper spray on the dogs, but it did not deter them. While he was being attacked a couple of women drove by and threw rocks at the dogs, causing them to run away.

The dogs' owner is 26-year-old Reginald Gray. He said that his children had let the dogs out without his knowledge.

A lawsuit was recenty settled that involved a highway contruction zone incident and two injured workers. The lawsuit stems from an incident in December of 2009. On that day a 24-year-old driver of a Sara Lee truck was traveling on U.S. 31 in an active construction zone where the speed limit was 35 mph. The driver of the truck was going 65 mph and wad not being attentive to the road conditions. He failed to observe that a contruction truck, which was parked in accordance with regulations. The construction truck had activated the flashing amber strobe lights. The impact of the collision caused the truck to hit and injure two workers who were near the truck.

One of the workers who was hit was a 22-year-old from Mexico who came to the U.S. to work and support his family. As a result of his injuries one of his legs had to be amputated below the knee.

The other worker was a 26-year-old husband and father to a three-year-old son. This you man's leg was crushed as well and hos leg had to be amputated above the knee. His spleen was also removed, which destroyed his ability to fight off desease and infection. The state police have released information saying that a 26-year-old man died after his motorcycle was struck by a turning vehicle.

Corlew was taken to Northeast Georgia Medical Center in Gainesville where she is reported to be in critical condition.

According to the Georgia State Patrol reports, Corlew was cited for a seat belt violation and charged with DUI as well as driving on the wrong side of the road.

An Ohio man was killed last week in a head-on collision with a pick-up truck. The accident happened about 5:15 p.m. On December 18 on State Route 183.

According to the State Highway Patrol, James Wriston's Monte Carlo was hit head-on by a Dodge Ram who went left of center as they attempted to pass a vehicle.

Mr. Wriston, 41, was pronounced dead at the scene of the accident. Two people in the truck and a passenger in the car were injured as well.

The names of the Victims in An accident involving a 1989 Peterbilt semi truck and a GMC pickup that happened on Tuesday, December 6 at the intersection of Avenue 36E and Highway 80 in Wellton, Arizona, have not been released.
According to reports, the GMC pickup failed to stop at the stop sign on Avenue 36E and pulled out in front of the semi truck which was carrying manure, totaling both Vehicles.
Two people were taken by helicopters to Phoenix-area hospitals.
Firefighters found the semi truck completely crushed and upside down with fuel leaking onto the ground and onto the driver. The GMC pickup was about 70 yards from where the wreck occurred, and it was completely crushed as well.
Firefighters were able to remove both drivers, there was no passengers I neither vehicle.
The physical status of the two victims is currently unknown.

The name of a 21-year-old Springfield Township man that was critically injured this morning when he was struck by a semi truck has not been released.
Police say the man had gotten into an argument with his mother a short time earlier. He was upset and this may have been a suicide attempt.
According to the Oakland County Sheriff’s Office, he jumped from the shoulder into the path of the truck in the area of Dixie Highway and Norman Road at 10:39 a.m.

On Wednesday, a double tanker truck carrying 8,800 gallons of gasoline and burst into flame on the eastbound Pomona Freeway.
The tanker stopped under the Paramount overpass and the big rig driver along with a passenger managed to get out of the truck in time without getting hurt.
No one was injured, but it was reported that a firefighter suffered a broken leg while fighting the blaze.
The incident caused extensive structural damage to the overpass and a portion of it is scheduled for demolition.
The biggest inconvenience will be to motorists who have to find alternate routes until the freeway is reopened.
The cause of the fire is not known at this time but is currently under investigation.

A delivery truck ran into the rear of a tractor trailer on Monday afternoon. The passenger in the delivery truck, Steven Stewart, was killed in the collision. Steven,49, was from Albany, NY.

John Brooks, 28, was the driver of the delivery truck. He was taken from the scene of the accident by helicopter to a bearby hospital.

The driver of the tractor trailer, Sothene Agba Yamahore, 37, stated that he was driving slowly with his hazard lights on because of mechanical problems.

Eastbound lanes were closed from 4:30 to 10 p.m. Traffice got by on the left shoulder.

Graeme Scott was laying pipes into a trench in Glasgow's Cranhill Park when the trench collapsed.

A Co-worker of Scott, Thomas Brand jumped down into the trench and could tried to save him, however he was unsuccessful. Scott had been covered in debris and soil.

Scott died of a chest injury and probable suffocation caused by the trench collapsing on him.

Reports say that on the day of Scott's death, under the direction of foreman William Parry, neither of the two trench boxes, given to the men to work inside while in the trench, were used.

Police said, "The purpose of the trench box is to provide a safe working environment for those working within the trench by supporting the side walls and preventing soil slipping into the trench."

Sheriff John McCormick reported: "The death of Graeme Scott was entirely unnecessary and preventable had trench boxes and edge protection been used and the spoil deposited more than three metres from the trench edge in accordance with accepted good practice.

"Unfortunately, this event is one more example of health and safety practice, training and procedures being ignored in the interests of expediency with lethal results."

According to a release from the state highway patrol, David Karrick, 44, was the drivier of a 2011 Isuzu straight truck along CR 6 when he failed to stop at the stop sign at South SR 53. He collided with Ramond Williams, 53, who was driving a semi truck.

The car and truck both landed on their sides, with th truck's axel broken. The semi-truck ended up in the lateral canal off of the road.

Highway Patrol says that three people were taken to the hospital and that items were scattered all over the roadways. The canal suffered structural damage from the accident.

23-year-old Martin Mundie was helping convert a pig shed into a workshop when he fell through the skylight in the roof, to the concrete floor and broke his arm and his wrist.

When he was taken to the hospital, he needed a bone graft and two operations to insert three plates and six pins.

Mundie’s boss, Joseph Adams, was fined $4500 for health and safety violations which contributed to the accident.

A Health and Safety Executive investigation found that Adams had not assessed any of the risks for his employees, had not put any safety measures in place or given his workers any safety equipment.

Alan Mackinnon, an inspector, said: "Mundie has been left with significant and lasting injuries that could easily have been avoided if Joseph Adams had thought about the obvious risks involved when working on a roof.

He did not provide any equipment to allow the men to work on the roof safely.

He could have arranged for his employees to work from a mobile elevated work platform, wear safety harnesses while they were on the roof or for properly fixed crawling boards with barriers to be used. Not providing any of these safeguards is simply unacceptable.

An area bicyclist is recovering from injuries she sustained serious injuries after being hit Monday night by a minivan.
Judith Daiello was listed in fair condition at Mercy St. Vincent Medical Center in Toledo as of Wednesday afternoon.
The driver who hit her Trek Alpha 15 bicycle from behind on Ohio 269 is expected to be charged with failure to maintain assured clear distance, said Sgt. Joe Wentworth, of the Sandusky post of the state Highway Patrol.
Garrett L. Timmons, also was southbound in a 2000 Chrysler Town and Country minivan when he hit the rear of Daiello's bicycle, according to the report.
The collision caused Daiello to be ejected from the bicycle and thrown into a ditch off the right side of the road. Her bicycle also ended up there.
An ambulance initially transported Daiello to the Bellevue Hospital emergency room. A LifeFlight helicopter then flew her to Mercy St. Vincent.

An accident on Interstate 55/70 shut down all southbound lanes of the interstate Tuesday night.

Illinois State Police said a 70-year-old male who’s not will not be released, lost control of his semi, and crashed into the guard rail.

The accident caused the semi to become stuck and damaged about 300 to 400 yards of the guard rail.

All southbound lanes of the interstate were shut down for about two hours. A tow truck was eventually able to release the semi from the rail.

The driver of the semi was not injured and no other cars were involved.

A 14-year-old Cochella boy was killed in a hunting accident over Thanksgiving weekend. He was shot by his teenage cousin, a relative said on Monday.

According to the Riverside County Sheriff’s Department, Isreal Delatorre of Cochella died on Saturday afternoon after he was unintentionally shot on Little Thomas Mountain Road near Garner Valley.

Guillermo Deltaorre, a hunting safety instructor since the 1990’s, was with the two boys on the deer hunt. Israel was the instructor’s nephew.

Guillermo’s son spotted a dear and Delatorre told Israel not to move, but he moved in front of the shooting range of the deer.

Sheriff’s department spokesperson Cpl. Courtney Donowho said the department has ruled the shooting as accidental and would not be releasing any more information out of respect for the family.

The Toledo man was indicted today by a Wood County Grand jury for charges stating that he intentionally caused a crash in Perrysburg Township last month.

Michael Garzynski was indcted on four counts of felonious assault and two counts of endangering children.

The charges stem from an incident that occurred on November 17th in which authorities say that he grabbed the sterring wheel of the vehcile he was a passenger in, intetnionally causing a crash. The vehicle flipped and went into a water-filled ditch on Route 199 south of Eckel Junction.

When police arrived on the scene they found Graczynski standing on the side of the orad outside of the vehicle while two women and two young children were trapped inside the car. he offered them no help.

Canfield-Hartley employee Chris Thompson, was loading trash into the back of the garbage truck around rush hour on Monday November 28, 2011. Thompson was struck by a 2010 Chevy Malibu. The crash had him pinned between the car and truck where he remained for about 45 minutes while local Fire and EMS departments tried to free him. He suffered severe injuries to his waist and legs and was flown to the University of Toledo Medical Center late Monday night where he was listed in serious condition.

The Chevy Malibu’s driver — Anthony Demore, of Sandusky — was also injured and taken to Firelands Regional Medical Center which is located in Sandusky Ohio.

Police have a 38-year-old man in custody facing Felony charges. He is a suspect of a hit and run incident that injured a 19-year-old woman and a 20-year-old man Friday night.

The two victims are Clinton Township residents. They were hit by the man in a pick up truck around 7 on Friday. The accident occurred on 15 Mile Road, east of Griswald Street in Clinton Township.

According to witnesses the suspect did not brake or stop at the scene. The victims were taken to Mt. Clemens Regional Hospital where the 19-year-old was in extreme critical condition with head trauma and the 20-year-old was in serious, but stable condition.

An eyewitness followed the suspect and got the plate number and a description of the vehicle. Police arrested the suspect, a Macomb Township man, within hours of the incident.

Charles E. Boyk Law Offices is sad to report; a Tampa mother who was 6 months pregnant has died after being hit by a car Wednesday night.

Two women Monica Alvarez and Shanita Little were walking to the store along N 43rd Street when a driver going in the same direction hit them.

Alvarez, who was 6 months pregnant, and her one-year old daughter Imani Golden were airlifted to Tampa General Hospital.

Doctors were not able to save Alvarez. They performed a c-section to remove her unborn baby boy, but the child did not survive. Her daughter Imani is in critical condition with injuries to the head and lungs and is listed in critical condition.

The other mother and child, Shanita Little and Marquisha Wilson, were taken to St Joseph's Hospital. Police say they were banged up and had some cuts, but were now stable and recovering.

Police said both the darkness and the lack of sidewalks played major roles in the crash.

The driver is a 25-year old man that claims he didn't see the women and their strollers until it was too late.

It's not clear whether he will face any charges. Alcohol and drugs were not the cause of this accident.

Other excited shoppers were stuck inside the dark Port Clinton Ohio Wal-Mart due to a power outage caused by an injury accident. An excited driver lost control of their vehicle on State Route 163 and crashed into a transformer. The transformer also caught on fire leaving residents from Port Clinton to the Village of Marblehead without power for over an hour.

McDonald’s worker Brandy Ramsey went to hand a customer his breakfast when a black Labrador lunged out the vehicle’s window and bit her pinkie finger.

“I grabbed my hand and saw blood gushing out of my pinkie,” said Ramsey, who works at the Milan Road McDonald’s. “I screamed and he yelled at the dog.”

Ramsey ran to the sink and the customer drove off.

Ramsey told police the man was wearing a pullover with “Perkins High Basketball Coach” emblazoned on it.

“The only thing I’m upset about is that he didn’t even apologize,” she said. Ramsey later showed police the two puncture marks on her finger. She didn’t want to press charges and only wanted the incident documented.

On Monday, truck driver Herschel Roberts was sentenced to three years in prison for driving over a bicyclist in September of 2009.

A Texas family-law judge no longer can be prosecuted for savagely beating his teenage daughter in 2004. But that doesn't mean he should be immune from punishment for his brutal act.
Hillary Adams, who has cerebral palsy, was 16 when she set up a video camera in her bedroom because she'd been beaten before. Her father, Judge William Adams, was angry because she had illegally downloaded videos on her computer. With the hidden camera rolling, he delivered 20 hard hits with a belt as she screamed and pleaded for mercy.
Because the statute of limitations has expired, police say the judge cannot be charged with injuring a child or other assault-related crimes. He is relieved of his duties while a judicial conduct commission and the Texas Department of Family and Protective Services investigate.
A family services agency also is involved. Although Ms. Adams and her mother no longer live with the judge, he has joint custody of a 10-year-old daughter.
It is unconscionable for any adult to assault a child, but the offense is even more egregious for a judge. In the past year alone, Judge Adams has handled nearly 50 cases in which he evaluated whether parents were fit to raise their children.
Since the video was posted on YouTube, questions have been raised about the judge's rulings. Yet he remains unrepentant, telling a TV station that the video "looks worse than it is."
One glance at the video proves him wrong. His claim that Ms. Adams is trying to get back at him for reducing her financial support is irrelevant.
Texas officials say they've been flooded with calls to remove Judge Adams from the bench. They should promptly comply. Anyone whose own conduct is so abhorrent must never again be in a position to sit in judgment of another family.

Man charged with animal cruelty for stabbing dog | Toledo Ohio Dog Bite Attorney

A north Toledo man, who stabbed his dog six times because the dog bit his hand, has been charged with animal cruelty.
The charge against David Riling, Jr., is a misdemeanor, said John Dinon, director of the Toledo Area Humane Society. The "pit bull" was later euthanized by the Lucas County Dog Warden because of its injuries and because it was aggressive, Mr. Dinon said.
Mr. Riling told Toledo police officers he was eating dinner Tuesday night when his "pit bull" tried to take his food, police reports state. He said he pushed the dog away and it bit him, cutting a finger on his right hand and his left thumb.
Mr. Riling called police about 11 p.m. to report the bite, and said, "The dog bit me, so I'm going to kill him," according to the report. He then followed the dog into the basement with a knife, to "show the dog who was superior." While in the basement, the dog lunged at him, according to the report he told officers, so he stabbed the dog in the neck and throat six times.
Officers later arrived, and Mr. Riling told them he wanted the dog removed from his home. Authorities said that Mr. Riling appeared intoxicated while they were there taking the report, and admitted to drinking "a few beers." Mr. Riling told the officers he was heading to Mercy St. Vincent Medical Center for treatment.
The dog was taken to an emergency clinic, and was transferred to the dog warden Wednesday. Mr. Dinon said that animal cruelty cannot be charged as a felony in Ohio for a perpetrator's first offense, regardless of the incident's severity.

Ottawa County Crash Leaves One Woman Seriously Injured | Toledo Ohio Car Accident Lawyer

Ashley Tennant was flown to Mercy St. Vincent Medical Center in Toledo with serious injuries following a car versus truck crash Tuesday afternoon in Portage Township.

Tennant was headed north on Ohio 53 at around 3 p.m. when she was struck by an International box truck headed west on Ohio 163.

According to the report Troopers are still trying to determine if Tennant was attempting to turn left onto Ohio 163, or if she was planning to continue north on Ohio 53.

The markings at the crash scene made it difficult to determine her intended direction of travel.

Tennant suffered serious injuries and was unconscious when rescue crews arrived. As of late Tuesday her condition at the hospital was not available.

The driver of the truck, Brian O'Neill, was not injured.

Troopers are still investigating, but they suspect Tennant was at fault in the crash. There's no indication alcohol was a factor.

The Charles E. Boyk Law Offices is saddened to report that a Bowling Green State University student has passed away after a car accident in Lucas County.
The collision occurred at the intersection of Brint and Washburn Roads in Richfield Township, right outside the village of Berkey.
Kathleen Smallman, was driving southbound on Washburn Road at around midnight on Tuesday. According to the report Smallman stopped at the stop sign, but then failed to yield at the intersection to a 2002 Chevy Silverado pickup truck. It struck her vehicle on the left side. Smallman was pronounced dead on the scene.
Smallman was a Metamora, Ohio native, studying journalism and pre-visual communication at BGSU.
According to the report both of the drivers were wearing seatbelts. They do not believe alcohol or drugs were a factor. There is currently no indication as to why Smallman failed to yield at the intersection.
Sylvania resident Kevin Russell was driving the other vehicle. Highway patrol said he was not injured in the crash. The accident is still under investigation.

Fatal Dog Mauling | Toledo Ohio Dog Bite Attorney

Investigators in Lorain County said the fatal dog attack was a horrible accident.

According to investigators and the police report, Michael Williams, died when he was mauled by a pack of nine dogs that belonged to his father. The attack happened at his father's house on State Route 511 where Williams was found dead in the driveway.

"My heart breaks," said the victim's father. Michael Kywa who also spoke to FOX 8 News, "I wish it happened to me and not to him."

Kywa wasn't home when the dogs attacked but they were normally allowed to roam around the fenced-in yard.

Dr. William Fox is the veterinarian who was called to the scene where he said the victim's dad was clearly distraught. "He was shocked, totally shocked, like all of us about this situation," said Dr. Fox. "He continually asked me, 'Why it happened? Why it happened?'"

Fox eventually euthanized seven of the dogs at the scene, where two were already killed by responding officers. "By putting them to sleep, it took a lot of the liabilities away. We probably couldn't find homes for them, under Ohio laws, any dog that's attacked a human is considered vicious and dangerous," said Dr. Fox.

Investigators say the dogs were various breeds, including Mastiff and Pit-bull mixes. Before Tuesday, neighbors like John Schmidt say they never turned on anyone.

The coroner has not ruled on an official cause of death, but that's likely to be released soon. Investigators say it appears to be a case where the dogs turned on someone but they may never know what triggered the animals.

Monday night a Mercer County emergency response volunteer was seriously injured while working at the scene of an accident.
Mercer County Sheriff Jeff Grey said Marvin D. Collins, 56, of Fort Recovery was struck while assisting with traffic control on US 127.
Grey said Kameron J. McCarty, 21, drove over an orange reflective traffic cone and struck a parked pickup truck, pushing it into another parked pickup truck, with both trucks striking Collins.
Collins was taken to Mercer Health by St. Henry EMS, then transferred by medical helicopter to Miami Valley Hospital.

Both McCarty and his passenger were not injured in the crash. Farmer was arrested at the scene on an outstanding warrant held by Celina Police Department for theft. Grey said deputies also found a syringe during their investigation. Charges of possession of drug paraphernalia are pending and expected to be filed at a later time.

Late Tuesday a black pick up truck struck a bicyclist in Perkins and fled the scene of the accident. Police are continuing their search to find the driver of the truck.
About 11:15 p.m. the truck was headed east on Perkins Avenuewhen it struck the cyclist just east of Hayes Avenue. The collision knocked the bicycle and its rider off to right side of the road, into a patch of mud and grass.
The bicyclist's name was not immediately available, but police said his injuries didn't appear to be life-threatening.
Shortly after the accident the victim was conscious and speaking with the firefighters. He was loaded into an ambulance and taken to Firelands Regional Medical Center.
One witness told police this: "It's a large, oversized black truck." The witness told police there were no other unique markings on the truck - but it was an older-style pickup.
The witness said the truck swerved and she saw a flash of metal "that almost looked like something fell off the truck," Hilton said.

Michigan man injured in train/semi accident

Authorities in Wood County said a Michigan truck driver was hurt Wednesday morning after he drove his tractor-trailer into the path of an oncoming train at a crossing on U.S. Rt. 6 near Bradner.
Lawrence Esler, of Rapid River, Mich., was airlifted to the University of Toledo Medical Center, former Medical College of Ohio, after the 9 a.m. crash. Wood County Sheriff Mark Wasylyshyn said Mr. Esler appeared to have leg injuries and did not lose consciousness at the scene, though officials hadn't been able to get an update on the man's condition.
The CSX Transportation train hit Mr. Esler's truck on the driver's side near the door. Authorities were still investigating why Mr. Esler didn't stop at the crossing, which is equipped with signal lights and gates.

According to a report a 52-year-old woman who fell into Lake Erie from a boat heading from Michigan to Ohio swam to shore and was found and seemed to be suffering from hypothermia.
The Monroe County, Michigan's sheriff's department said in a statement that the husband of Amy Nearhood of Temperance reported Sunday night that she went overboard around the mouth of the River Raisin. Boats and helicopters searched the water near Monroe for her.
More than an hour after she was reported missing, an employee at DTE Energy Co.'s coal-fired plant in Monroe found Nearhood walking on the utility's property. She was taken to a hospital for treatment of hypothermia.
According to the report the boat was heading from the Monroe area to the Ottawa River Yacht Club in Toledo, Ohio, when she fell overboard.

Greyhound bus overturns | Toledo, Ohio bus accident lawyer

The driver of a Greyhound bus bound for St. Louis lost control on the Pennsylvania Turnpike early Saturday. The bus went careering across the highway and up an embankment before it landed on its side on the interstate, briefly trapping a woman and sending 14 people to hospitals.

Rescue crews freed the woman who was trapped in the wreckage in a rural area about a mile east of the Lebanon-Lancaster exit. Twenty-nine people, including the driver, were aboard. Officials at three hospitals said 14 people altogether were brought in. Four uninjured passengers were picked up by another bus; the conditions of the others were unclear. The bus from New York City stopped in Philadelphia and had traveled about 75 miles westbound on the turnpike when it overturned at about 6 a.m. on the way to a stop in Columbus, Ohio. Greyhound set up a hotline -- (800) 972-4583 -- for relatives and friends to get information about people on the bus that crashed in Pennsylvania.

Lucas County Crash; one confirmed dead | Toledo Ohio Car Accident Attorney

Two people have been confirmed dead and one was seriously injured after a two-vehicle crash at the intersection of Jeffers and Neowash Roads in Providence Township.

The crash occurred around 9 a.m. Monday morning. Two vehicles collided causing the death of Deborah Kendall. Deborah, of Grand Rapids, Ohio was northbound in a Toyota 4Runner when a 1994 Ford F-150 pickup truck failed to yield the right of way and struck Kendall's vehicle on the right side. Kendall was ejected from the vehicle and was pronounced dead at the scene. Both of the two occupants of the F-150 were ejected from the truck. Brandon Strong, of Swanton, Ohio landed on the side of the road. Strong later died at the University of Toledo Medical Center from injuries sustained from the crash. Cody Jahns, of Toledo, was also taken to the University of Toledo Medical Center where he is being treated for his injuries.

The hazard of this product is that while in use, the plastic pitcher can separate from the blade assembly, leaving the blade in the bsae and exposing rotating blades. This poses a hazard to consumers to the possibility of laceration.

So far there have been 11 reports of the blade assembly separating. Seven of those reports have been for serious lacerations to the consumer's fingers and hands.

In 2009 two Ohio men were honored as heroes for their actions after a car accident but are now suing the woman they rescued from her burning car. David Kelly said the smoke and fire did so much damage to his lungs that he can no longer carry a laundry basket upstairs in his home; he is also claiming that he saw hair melting on Theresa Tanner's head and is now haunted by the memories. Theresa Tanner had told police that on the day of her accident she had an argument and wanted to end her life, she was critically injured but survived. She told investigators that she didn't remember anything after she veered off the road.

A Toledo teenager was killed late Saturday in a traffic crash near Highland Park, just blocks from his home.
Deshyren Koonce, was a rear passenger in a car driven by Darron Parker at 11:30 p.m. Mr. Parker's vehicle was hit from behind by a car driven by Arthur Hayes, at the intersection of South and Geneva avenues. The collision sent Mr. Parker's vehicle veering into a steel light pole.
According to the report, both cars were eastbound on South Avenue, with Mr. Hayes closely following Mr. Parker's vehicle. When they reached the intersection with Geneva Avenue, Mr. Parker slowed but Mr. Hayes was unable to brake. He attempted to swerve and miss the vehicle, but hit the rear bumper, sending the car sliding into the pole.

The Charles E. Boyk Law Offices, is saddened to report that a 63-year-old man from Point Place, Larry Collins. Collins was unfortunately caught in the middle of a high speed chase to catch the Rite Aid robbery suspect, on Saturday September 3^rd.

The chase ended when officers ended up shooting and killing the armed robbery suspect Brian Lipp. At least seven other people were injured during the chase including two Toledo police officers. There were multiple crashes due to the chase itself.

The Hamilton family was involved in the crash, but were treated and released from a local Toledo hospital. The Hamilton's were alright just really shaken up from the crash.

Larry Collins family said in a brief statement that their father was incredibly loved and will be terribly missed. Thoughts are with the Collins family during this hard time.

The investigation is still ongoing and Toledo police are starting to piece it all together.

Chief Mike Navarre of the Toledo Police says, "The tragedy of today's event is the death of an innocent person just driving on 75. I don't know where they were going or what they were doing, one minute they're driving along the next minute their life is ended. Because of the senseless act of a person who is desperate for money to feed a drug habit."

This is such a sad story and ending of a life, Larry Collins. According to the report Larry Collins was trying to merge right to avoid hitting the suspect's vehicle when Collins Lincon and a Toledo Police cruiser collided head on. The two officers who were in the cruiser were taken to St. Vincent's Mercy Medical Center with non-life threatening injuries.

Brian Lipp the suspected robber not only lead Toledo Police on this high speed chase around Toledo but also robbed a couple places all while getting high. Lipp, who police feel was trying to get money for his drug addiction, was eventually shot multiple times and killed by police.

Pit-bull owner sentenced in attack | Toledo Ohio dog bite attorney

A Franklin County judge was unmoved yesterday by a man's tearful claim that he shouldn't be held responsible for a nearly fatal attack on a 12-year-old boy by his pit bull.
Common Pleas Judge Laurel A. Beatty sentenced Donald Moore to 13 years in prison for the attack on a Hilltop sidewalk.
A jury convicted Moore last month of felonious assault and failure to confine a vicious dog for the incident on May 9, 2010, when his pit bull broke free of its tether and clamped its jaws on the throat of Ryan Fuller.
A neighbor used a butcher knife to stab the dog when no one else could get the dog to release the boy. The dog later was euthanized.
The jury also convicted Moore of failure to confine a vicious dog for an attack by the same pit bull on a 41-year-old woman on S. Eureka Avenue on Oct. 5, 2009. However, the jury found him not guilty of felonious assault in that case.
The now-13-year-old boy, who testified during the trial and his mother were in the courtroom for the sentences. Angela Fuller spoke briefly in court, asking the judge to remember that her son, whose neck remains scarred, will be affected by the attack for the rest of his life.
Beatty sentenced Moore to eight years for the felonious assault and added five years after finding that he is a repeat violent offender. She sentenced him to 18 months on each of the confinement convictions, but ruled that those sentences would run concurrent to his other prison time.
Moore's girlfriend, Stephanie Shahan, was sentenced last month to two years in prison after pleading guilty to felonious assault, assault and failure to confine a vicious dog.
Ohio law defines pit bulls as vicious dogs and imposes strict requirements on how they must be confined by their owners and keepers.

Mother bit by pit-bull while picking up her child | Toledo, Ohio dog bite attorney

A Norwalk woman was bitten by a pit bull mix while picking up her child at a nearby apartment complex.
The 23-year-old victim and mother had a scratch on her face and bruises on her face and forehead, Norwalk Police Sgt. Jim Montana said.
The dog bit the woman in the back. "It was a good bite," said Norwalk Police Sgt. Jim Montana said. "It didn't take a chunk (of skin) out. It did leave some bite marks."
The woman eventually found her 6-year-old son.
The owners were told about the 10-day quarantine requirement for dogs that bite humans. A report was to be sent to the county's dog warden and health department, as well as the city law director.

The Charles E. Boyk Law Offices is saddened to report that 19-year-old Justin Stolp of Petersburg, Michigan died early Thursday morning.
Preliminary investigation reveals the single-vehicle crash was caused by a collision with a deer.
Stolp was the passenger of the 2000 Ford Explorer SUV. Driving the vehicle was 18-year-old Dakota Hoffman of Deerfield, Michigan.
The crash happened at 3:25 a.m. near the intersection of Deerfield Road. After striking the deer, the vehicle ran off the roadway and crashed into the ditch. It rolled several times before coming to rest in the yard of a private residence.
According to the report, Hoffman was ejected from the vehicle. He was transported by ambulance to the hospital.
Stolp was trapped in the vehicle and had to be extricated. He was then flown by air ambulance to Mercy St. Vincent Medical Center where he later died.

Quadriplegia can also be caused by an infection in the brain or spinal cord or loss of blood to the brain or the spinal cord
Paraplegia
o This is when you are paralyzed from the waist down. It is a result of damage to your spinal cord and can be total or partial paralysis. Usually this results in loss of feeling, loss of leg function and sometimes can cause an extreme pain and suffering and a stinging feeling from the pinched nerves. Usually causes a loss of bladder control, bowel control, spasms, usually causes changes in sexual functions and ruins fertility. There is usually a shortened life span associated with Paraplegia. Paraplegia can also be caused by an infection in the spinal cord or a loss of blood to the spinal cord
Herniated Disc & Bulging Disc
o A herniated disc is also called a bulging or ruptured disc. These types of injuries are common in trucking accidents because of the g-forces associated with the accident. When a disc is violently forced out of its place it puts immense pressure on the spinal channel and therefore puts immense pressure on the nerves in the spinal column. Your facet joints are what allows you to twist, turn and bend, in other words they are what helps you from breaking in half. They deal with your range of movement, strength, flexibility, and integrity. One of the most common FJS symptoms is lower back pain. If your facet joints get injured in an accident they can develop arthritis and that can develop into chronic pain syndrome and cause a lifetime of pain and stiffness. Whiplash

The Charles E. Boyk Law Offices is here to report that a head-on collision sent one nine year old girl to the hospital. Amanda Vanatta, the nine year old girl from Findlay, Ohio, has been in the hospital since the end of July.

Amanda is going into the fourth grade at Washington Elementary in Findlay. On July 22^nd, Amanda was in riding in the car with five other people when they were involved in a head-on collision along route 12 in Arcadia. Amanda was the only one who suffered major injuries.

Amanda has been in intensive care for about four weeks, and has had at least four surgeries.

In the meantime, friends launched a Facebook event page called "Praying for Amanda." They're asking for prayers and donations.

"Amanda, when she leaves, she's going to need a lot of long-term care, and that costs money," said family friend Bryan Bethel, "and that's what we're doing."

Amanda's mother, Lisa Leathem, has been by her daughter's side, at Toledo Children's Hospital, since the accident.

Three people are recovering Sunday morning after a rollover crash off of Dorr Street, in west Toledo.

We were told that a pick-up truck rear ended another truck near the intersection of Dorr and Richards. The impact of the trucks caused one of the vehicles to roll on its side. Three people were rushed to Toledo Hospital with what appeared to be non-life threatening injuries.

6 injured in Ohio 12 head-on accident | Toledo, Ohio car accident attorney

We are saddened to report that six people were injured Friday afternoon in a head-on collision of two cars on Ohio 12, east of Arcadia, Ohio.

Andrew Kimble, was the driver of one car, who had to be extricated from the wreckage by the Washington Township Fire Department. Kimble was taken by ambulance to Blanchard Valley Hospital.

The driver of the second car, Helaina Todd, and four juveniles in her car were all taken by Emergency Medical Service to Fostoria Community Hospital.

The crash occurred Friday afternoon July 23, 2011 on Ohio 12, west of County 257 in Washington Township.

Kimble was driving west on Ohio 12 in a 2001 Saturn, and Todd was eastbound in a 2010 Kia. Kimble's car went left of center and hit the Todd car head-on.

Todd's car went off the south side of Ohio 12 and came to rest in a ditch, while Kimble's car went off the north side of Ohio 12 and rolled onto the passenger side.
Air bags deployed in both vehicles, and all were wearing seat belts, Hartman said.

EMTALA applies when someone goes to a hospital emergency room and is in an emergency medical condition and either asks for an exam or for medical treatment their medical condition. EMTALA also applies if another person makes a request for medical treatment on another person's behalf. The hospital emergency room has to provide treatment to the patient so that they are stabilized, the patient can then be transferred or so that the condition is treated. Failure to follow the EMTLA law will result in EMTALA violations.
An emergency medical condition as defined by EMTALA includes the following:
o Serious impairment to bodily function
o Significant dysfunction of a bodily organ
o Dysfunction of a body part
o Jeopardizing the health of a pregnant woman or unborn child

Filing an EMTALA Violation:
o A formal complaint of an EMTALA violation is filed with the regional office of the Centers for Medicare and Medicaid Services (CMS). Once the complaint is filed with CMS, the complaint will be investigated. CMS usually sends investigators to the hospital to review the hospital's procedures and policies in order to determine whether they show any EMTALA violations. If proof of an EMTALA violation is found, the hospital will be penalized
EMTALA Penalties for EMTALA Violations:
o If a hospital does not follow the legal requirements of EMTALA, the hospital is subject to a fine. The amount of the fine can equal $ 50,000 per violation if the hospital has more than one hundred beds

Man, 31, charged with sexual battery of girl, 13 | Toledo, Ohio Sexual Assault Attorneys

Former local resident Joshua E. Bierce, is being accused of sexually abusing a young relative of his. He was turned over to the Huron County Sheriff's Office and it is not known why he was originally in the custody of the Wyandot County Sheriff's Office and the jail records she that he was not booked on any charges in that county. The police captain said that he is accused of having sex with a 13 year old girl and is being charged with sexual battery that is related to an occurrence on August 1 of 2010. If he is found guilty he could face a fine of up to $10,000 and anywhere from 1 to 5 years in prison. The Law Director in Norwalk said the girl said it was a continuing pattern of sexual abuse. Sexual battery is any sexual conduct that involves a biological parent, adoptive parent or step-parent and statutory rape is a sex offense that involves a victim who is younger than 13 years old. He is not being charged with statutory rape because she was not under the age of13. The girl's biological dad is the one who filed the complaint and after the results of some tests were received and the investigation was completed, there was a warrant for Joshua Bierce and he was then arrested, he has a $25,000 bond.
