Q: What is the maximum amount I can expect from a medical malpractice incident?

A: In December, 2002, the Ohio State Legislature passed S.B. 281, which limited the non-economic damages plaintiffs could receive in medical malpractice cases. The legislature capped damages at $350,000 per plaintiff, or $500,000 per incident. For catastrophic injuries, the legislature increased the cap to $1 million.
