Windy Weather Car Accidents

Am I responsible for a car accident caused by heavy winds?

With recent storms and tornadoes making their way through our area, many Ohioans are probably thinking about heavy winds and the damage that they can cause.

The truth is, heavy winds don’t only pose a problem to structures such as homes and businesses, but they can also be dangerous to anyone on the roadway. This brings up the question of, if you cause an accident due to heavy winds, who is at fault? Are you responsible for the damages? Windy Weather Car Accidents

If you are driving and the weather takes a turn for the worse with powerful winds that seem to be keeping you from controlling your vehicle, you should pull to the side of the road. Just as you would be advised to pull over in a snow storm, the same is to be said about strong winds. They have the potential to cause serious damage to you and others on the road.

Be Cautious in Bad Weather

If you are driving and a storm rolls in with high winds that makes your car blow left of center, against your own control, you need to be very cautious. As explained above, it is wise to pull off the shoulder of the road if you feel as though the weather conditions are causing you to be unable to effectively operate your vehicle. It is of course best if you refrain from driving in such conditions in the first place. If the weather report warns of high winds and inclement weather, do not drive if you do not have to.

If a driver is cited in an accident that occurs during windy weather, they will most likely receive a Failure to Control citation. The same goes for an accident caused in winter weather, as explained in a past post written by our office. If you have questions regarding Failure to Control Citations in inclement weather, this blog post may be helpful.
