Dean, 31, who had worked at a Pallet-manufacturing plant for only five days was crushed in a pallet press and killed instantly. The pallets are made by exposing chipped and processed wood to high heat and pressue within hydraulic presses. One of the presses needed maitence, requiring Dean to sit iniside the press to perform the work.

Rather than the supporing raised press - which weighed 35,000 pounds - with the die blocks recommended by the press manufacturer, the only means of support provided were two narrow, hallow pipes placed between the ram and the top of the press. The hallow, and narrow pipes gave way and the top press crashed down on Dean, killing him instantly.

Dean's estate sued the pallet manufacturer that employed him, alleging it violated state and common law international tort statutes in that it deliberately removed safety equiptment or guards, providing a rebuttable presumption that the removal was committed with intent to injure another.
