Read the story below, or click above to watch the video.TOLEDO, OH (WTOL) - Now that the Toledo Humane Society has approved the adoption of pit bulls, people want to know who's responsible if a pit bull attacks and injures someone.
A downtown Toledo attorney says a pit bull is responsible for injuries to 8-year-old Mariah Nierman but that no one can be forced to pay for her pain and suffering.
Mariah was visiting a friend in east Toledo last October when a pit bull severely injured her right hand and wrist. She needed multiple stitches and will be permanently scarred.
"Someone should be responsible... for the medicals, for the pain and suffering," said attorney Mike Bruno, who represents Mariah and her family. He says the pit bull owner had no renter's insurance and the landlord is in Minnesota and will not pay. He says the family has thousands of dollars in hospital bills with no one required to pay them.
Bruno also says insurance companies won't offer high-risk coverage to protect future pit bull owners.
But Humane Society Director John Dinon believes the new and strict requirements for adopting pit bulls -- like proving liability coverage -- will prevent problems. He says the liability question has been thoroughly investigated.
"I think it's seven or eight companies that don't distinguish between pit bulls and other dogs," Dinon said. "So there is insurance out there if you are interested in adopting a pit bull."
Bruno remains skeptical and says new pit bull owners could get the coverage then fail to pay the continuing premiums.
