Supreme Court Rules Injured Worker Can Sue Boss For Firing After Injury | Toledo, Ohio personal injury lawyer

The Suprem Court ruled on Thursday June 9th that a worker who is injured while on the job can sue his boss after he was hurt but before he had a chance to file a worker's compensation claim.

The case involved DeWayne Sutton, 34, who was fired from his job only an hour after he reported an injury to the Owner of Tomco Machining Company.

In order to win the case the Sutton had to prove that he was fired in retalliation and that his boss had no justification for the dismissal.

The law in Ohio prohibits employers from firing, demoting or taking any other punitive action against a worker who has filed a worker's comp claim. The justices found that workers are entitled to that protection during the time in between injury and filing.

The Ohio Supreme Court ruled in favor of the injured worker in a 4-3 decision.
